The new contract total of $35,555,582.76 is (-$9,417.24) below the original contract value due to the 2 previous deductive change orders. Therefore no additional funds are required. The work adds conduits and conductors to AMS sensors in the blower building, RAS transfer building, and RASIWAS station 2; conduit is PVC coated in the chemical feed and PSPS buildings due to the corrosive environment. The equipment and materials associated with this additional work had to be installed prior to pouring the slab on grade concrete. The additional work caused a delay in the projects critical path by seven calendar days because it delayed this concrete pour. Reason for change: This modification was requested by the Engineer in FO 004. There was a design plan discrepancy and the work should have been included in the construction contract. Cost Negotiation Process: JC submitted CPR #8 to the City PM, City inspector, and B&C for their review and comment. Backup documentation was provided to the reviewers The proposed cost was found to be appropriate for the scope of work. The CPR cost was approved. Final Cost= $17,281.30 Days= 7 CPR #10A Fire Alarm Panel Description Summary: This CPR includes the following additional work items: 1) Increase the PLC size from 36" to 48" at no additional cost to the City 2) Propose fire and electrical room layouts at no additional cost to the City 3) Fire alarm panel modifications for deluge system per RFI 54 and Field Order 006. 4) An additional 10 calendar days is being requested for the additional work outlined above. The additional work delayed the Chemical Building concrete construction. Reason for change: There was a design plan discrepancy and the work should have been included in the construction contract. Cost Negotiation Process: JC submitted CPR #10A to the City PM, City Inspector, and B&C for their review and comment. Backup documentation was provided to the reviewers. The proposed cost was found to be appropriate for the scope of work. The CPR cost was approved. Final Cost= $47,822.97 Days= 10 CPR #12A Gas Detector Description Summary: Relocate the level sensor and gas sensor per Field Order 007 and Challenger RFC #6 to a location that the Operators could view the sensor. Reason for change: The location of the acetic acid storage tank level display needed to be located at the operator level. The current P&ID drawings had them located at the top of the tank. Cost Negotiation Process: JC submitted CPR #12A to the City PM, City inspector, and B&C for their review and comment. Backup documentation was provided to the reviewers. The proposed cost was found to be appropriate for the scope of work. The CPR cost was approved. Final Cost= $9,706.79 Days= 3 CPR #24 Galvanizing Description Summary: Complete hot -dip zinc galvanize coating in accordance with ASTM A123 and A153 on the following steel members: 1) Building interior structural steel for the primary sludge building, aeration building, and RAS/WAS station building. 2) Pipe Bridge structural steel. 3) Ladders and building interior exposed pipe supports. Reason for change: Operations prefers galvanized steel versus coatings because of the reduced maintenance and upkeep. Cost Negotiation Process: JC submitted CPR #24 to the City PM, City inspector, and B&C for their review and comment. Backup documentation was provided to the reviewers. The proposed cost was found to be appropriate for the scope of work. The CPR cost was approved. Final Cost= $16,824.36 Days= 0 CPR #28 Additional Week of Screening Description Summary: JC had to rent a screen that will remove cobbles (larger than 3" in size) from native soils during drain rock and pipe bedding screening operations. Pipe bedding shall meet ISPWC Section 305, Type II Aggregate Material requirements; drain rock shall meet ISPWC, Section 801, Table 1, Drain Rock 3 inches requirements. Screened cobbles will be disposed of onsite with other waste material or incorporated into the project; backfilling structures with cobbles in unscreened and unprocessed native material is acceptable. The City has approved CPR #16 which covered two weeks of these operations. It was determined that one additional week was required to complete the necessary screening. Reason for change: The Geotechnical Engineering Report provided for the project indicates that no materials larger in size than gravel (less than 3") exist in the native soil. After completing excavations, cobbles (larger than 3") were found in the native soil. Cobbles need to be removed from the native material to produce drain rock and pipe bedding. The screen required to separate the cobbles simultaneous to the drain rock and pipe bedding is more expensive to rent than a machine that will separate two materials. Cost Negotiation Process: JC submitted CPR #28 to the City PM, City inspector, and B&C for their review and comment. Backup documentation was provided to the reviewers. Change Proposal # Meridian WRRF Liquid 201 8 JC CONSTRUCTORS Stream Capacity Expansion 5.CONTRACT NO: 6.PROPOSAL DATE 17-0146 17 -Jul -17 DESCRIPTION OF CHANGE DESCRIPTION OF ADDITIONAL WORK: Work required to add the Air Monitoring System (AMS), see attached RFI 41 and Field Order 004, is additional work. DESCRIPTION OF ADDITIONAL TIME: An additional seven calendar days are being requested with this CPR. The original schedule showed commencing the Chemical Building slab on grade concrete on February 27, 2017; this work did not commence until March 23, 2017, twenty five days late. The delay was due to the above additional work as well as work identified in CPRS 10 and 12, delays by Challenger placing conduit, and delays by JCC on building layout. During the additional days requested in this CPR, JCC and Challenger identified problems, communicated with the Engineer/City, processed RFI 41, allowed the Engineer time to respond to RFI 41 and issue FO 004, identified additional work required in FO 004 (edits to eleven plan sheets), and procured materials for the additional work. This work had to occur before pouring concrete at the Chemical Building and concrete construction was on the critical path. See attached Baseline Project Schedule submitted February 12, 2017 and the three week updated schedule submitted March 22, 2017 for more information substantiating the additional calendar days. EXPLANATION: The AMS additions were requested by the Engineer in FO 004. UNITS OF WORK: Complete work on a lump sum basis. COSTSUMMARY A. (There may be some additional costs associated with some of these conduits.) -AMS-2 unit has no signal to PLC's in all buildings. Is this wanting to be added to the project? Q: In the 8" concrete plenum wall inside the structure, what size should the openings be at the future blower locations? A: The opening size for future Aeration Blowers 4, 5, and 6 should match that of the larger aeration blowers being installed (SABB2BLW1002 and SABB2BLW1003). Q: How should the openings for the future blowers be closed off? A: Per Key Note 3 on Drawing M-300-0102: "Provide 1/2" -thick plywood bulkhead over future wall openings. Coat to match wall fmish. Q: For the Chem Feed Building Electrical Room, can painted plywood be used instead of the insulation/gypsum board assembly shown on Detail C, A-390-0722? A: No. Because the electrical room is conditioned, insulation is required for COMcheck compliance. IBC Section 2603.4 requires a minimum 1/2" gypsum board "thermal barrier" where rigid insulation is installed in the interior of a building. The plywood could be added in addition to the gypsum in locations that the electrician would like to see additional backing. The locations that it was added would need to be fire treated. The original schedule showed commencing the Chemical Building slab on grade concrete on February 27, 2017; this work did not commence until March 23, 2017, twenty five days late. The delay was due to the above additional work as well as work identified in CPRS 8 and 12, delays by Challenger placing conduit, and delays by JCC on building layout. During the additional days requested in this CPR, JCC and Challenger identified problems, communicated with the Engineer/City, processed RFI 54, allowed the Engineer time to respond to RFI 54 and issue FO 006, identified additional work required in FO 006 (two plan sheets and specifications), and procured materials for the additional work. This work had to occur before pouring concrete at the Chemical Building and concrete construction was on the critical path. See attached Baseline Project Schedule submitted February 12, 2017 and the three week updated schedule submitted March 22, 2017 for more information substantiating the additional calendar days. Agreement. The sale and provision of equipment and services (the "Project") described In the proposal, to which this document makes reference below (the "Proposal'), are sold and provided by Apex Integrated Security Solutions, Inc. ("Apex") upon the following terms and conditions. These terms and conditions are integral and shall govern all transactions with the customer identified below (the "Customer") relating to the Project, as ifthe same were fully set forth in the Proposal. This document, together with the Proposal and the applicable Software Support Agreement, shall constitute the entire agreement ("Agreement") between Apex and the Customer relating to the Project. Any attempt to amend or otherwise modify the terms and conditions of the Agreement by oral representations or agreements, course of dealing or Customer documents, including without limitation any purchase order or similar document, is hereby rejected and shall have no legal effect. Customer acknowledges that the Agreement was received and reviewed by Customer in advance of any document generated by Customer. 2. Price and Terms. Prices quoted by Apex in the Proposal shall be binding for thirty (30) days from date ofthe Proposal. Payment terms are net thirty (30) days from the date of invoice. Upon receipt of customer's signature on the Agreement, Apex may immediately invoice Customer for an amount equal to fifty percent (50%) of (a) the cost ofthe entire Project, or (b) the cost ofthe equipment included in the Project, whichever is greater. Apex may delay commencement of work, unless and until such initial invoice is paid in full. Upon completion ofthe Project, Apex shall prepare a final invoice; provided, however, that If the Proposal provides for progress billing, Apex shall prepare interim invoices, in which case such interim invoices must be paid in full prior to Apex commencing the next phase ofthe Project. Apex hereby expressly reserves the right to deactivate or otherwise disable software installed as part ofthe Project, unless and until all outstanding Invoices are paid in full. 3. Taxes. Prices quoted in the Proposal exclude sales, use, excise and all other taxes, licenses, permits and other fees, unless otherwise expressly stated in the Proposal. Any such taxes or fees imposed by local, state or federal taxing authorities shall be added to quoted prices in all cases, except where Customer provides an appropriate tax exemption certificate. Customer shall be ultimately responsible for the payment of all applicable taxes and fees relating to the Project, irrespective ofwhether the same are included in Apex's invoice or not. 4. Limited Warranties and Limitations of Liability. a. Equipment and Software. Equipment and software Installed by Apex as part of the Project maybe warranted by the manufacturer of such equipment or software. Apex shall convey all such factory warranty information to Customer and, in the event of a claim, shall assist Customer to a commercially reasonable extent in communicating with the applicable manufacturer and resolving such claim; provided, however, Apex offers no warranty with respect to any equipment or software included In the Project and shall not be liable for the payment of any amount with respect thereto. In addition, there shall be no warranty with respect to consumable items, including without limitation fuses, batteries and cards, used in connection with the Project. b. Services. Apex warrants to the original Customer that all services provided by Apex in connection with the Project shall be free from defects in workmanship for a period of one (1) year from the date such services are provided. c. Notice. Customer shall provide Apex with written notice of any warranty claim not more than ten (10) days from Customer's discovery ofthe defect relating to such claim. d. Remedies. Customer's sole and exclusive remedy for equipment and software warranty claims shall be the remedy set forth in writing by the applicable manufacturer and as maybe performed by such manufacturer upon submission of a claim by Customer. We could also look into freeing up wall space by incorporating the Communication Network Panels into their associated PLC panels. DESCRIPTION A. Background Council approved the construction phase of the Liquid Stream Capacity Expansion project in January of 2017. The project will allow the WRRF to meet future capacity demands as the City continues to grow, as well as complete part of the first phase of upgrades required to meet the new regulations set forth in our NPDES permit. B. Proposed Project Construction of the Liquid Stream Capacity Expansion project is currently underway. Additional funds are necessary to complete specified items that have been identified throughout the construction process. The additional work includes but is not limited to adding air monitoring system sensors to the blower building, the RAS transfer building, and the RAS/WAS station 2. Fire alarm panel modifications were required for a deluge system in the Chemical Feed Building.
