'~:I~ MAYORS [Jj.'PICE crT" 'JF~1CBH:)~AN Dear City Council Membern: We are writing in response to the application of VISion First, LLC for an Annexation and Zoning of 76.72 acres for the proposed Kingsbridge SubdMsion. We live on 5.6 acres (zoned Agricultura~ located off Victory Road and S. Selatir Place adjacent to the northeast comer 01 the proposed development. I attended the planning and zoning meeting on September 16th regarding this same application. M. the conclusion of that meeting, the commissionern rejected the application from Vision First, LLC and listed muitiple reasons for the rejection. To our knowledge, none of the issues cited has been fixed. Yet, Vision First, LLC is presenting their application to the city council. I will attend the meeting on October 19th with the same objections to this application as reinforced by the commissionern when this application was rejected last month. Our concerns continue to be: 1. Density of the proposed development - The current zoning for the property in question is low density and is compatible to the sunrounding area. Why allow a rezone to R-4 when the sunrounding area is all RUT? On the eastem side, we all have 5+ acres. Ironically, Vision First, LLC's proposed plat have their most dense lots on the eastem side adjacent to these acreages. When we purchased our property, we were led to believe that the property in dispute would be developed with one-acre lots comparable to the Dartmoor Subdivision and in harmony with the adjacent rural neighborn. 2. Victory access stub-out - The proposed plat indicates a stub-out on the eastem side 01 the proposed development and the third from last paragraph in the Kingsbridge rezone application indicates "..provide luture connectivity to the north (Victory Road)..". This would appear to allow access via South Selatir Place. Selatir Place is a rural road (no sidewalks, narrow, banrow pits for irrigation drainage) and is a neighborhood of 1-5+ acre upscale homes. It was developed with the intent and agreement to serve as a dead-end street. Please refer to the agreement dated Septerrnber 10, 1993 and filed with the Ada County Recorder which states: "The Developer shall extend South Selatir Place as a dead-end cul-de-sac within the interior of the residential lots of the development, with no reservation of a right-ol-way easement over the residential lots for future extension of the street to other properties." 3. Development before year 2009 - We are under the impression that the Dartmoor CC&R's restricts the development of the proposed land until 2009. 4. No communication between Vision First, LLC and adjacent property owners - Vision First, LLC has made no effort to communicate and/or solicit input regarding the proposed development with any impacted neighborn other than Dartmoor residents. It seems that Vision First, LLC is communicating with Dartmoor since Dartmoor could restrict development of the proposed property until 2009 based on their CC&R's.
