October 12, 2004 for Packard Acres Subdivision No.3 we will not be able to attend this public hearing.

As our oral and written teJimony presented for the Meridian Planning and Zoning Commission Public Hearing on Septemeber
16, 2004 and prior meetings indicates we are not opposed to annexation and dewlopment of Packard Acres No.3 but are
wry much opposed to enlf¡achment of Wingate Lane because of liability and safety issues. The owners of land along side
Wingate Lane agreed to "open and maintain a private road 15' in width", that starts at Ustick and ends at our property by a
Private Road Agreement and this notarized and recorded document dated 1913 still remains in force and effect to date. We
haw abided by this agreement and utilzed Wingate Lane since 1968 to access our property at the south end of this private
road.
Issues concerning other phases of Packards Estates or private property outside the boundaries of Packard Acres Subdiloision
No.3 should not be addressed in this public hearing or considered pertinent to the Application of Packeard Estates
Dewlopment , LLc for the Annexation and Zoning and the Preliminary Plat Approval for Packard Acres Subdivision No.3. as
they are issues that should be addressed by the home owners association or between private property owners.
