Broadway Avenue Meridian, Idaho 83642 VIA EMAIL RE: H-2017-0062 OXYGEN SUBDIVISION NO 2 The Idaho Transportation Department (ITD) has reviewed the referenced short plat application by James Kissler for Oxygen Subdivision No 2 located east of South Eagle Road, north of East Overland Road, on the east side of Rackham Way, north of Five Mile Creek, on the southeast corner of I-84 and Eagle Road, south of I-84 milepost 46.10. ITD has the following comments: 1. ITD does not object to the short plat of the parcel at this location. 2. No access is requested and none is approved with this application. Applicant must apply for and receive an approved Right-of-Way use permit prior to doing any work or activity within the highway Right -of- Way. I-84 is a full access controlled highway. South Eagle Road is a full access controlled highway in this location. 3. The interstate fence is typically constructed one foot within ITD Right Of Way, but may vary due to terrain and other possible issues. All measurements relative to ITD Right of Way shall be taken from the Right of Way monuments, not from the fence. 4. Noise walls have not been constructed in this location of the I-84 Corridor and will not be constructed by ITD. The applicants should consider land uses with lower sensitivity to traffic noise. Any noise walls will be constructed by the developer on private property. 5. IDAPA 39.03.60 rules govern advertising along the State highway system. The applicant can contact the ITD District 3 Traffic Section at 334-8300 for more information. 6. Idaho Code 40-1910 does not allow advertising within the right-of-way of any State highway.
