At your September 21st meeting, the City Council remanded all three applications
associated with Alexandria Subdivision back to the P&Z Commission. This was the
result of a letter of reconsideration submitted by the property owner, Mr. Lonnie
Johnson, who outlined several reasons they feR the City Council should reconsider
the denial (see Mr. Johnson's letter dated September 9, 2004). Since the
September 21st meeting, staff has had several discussions with the applicant and
City Attorney about the City Council's Remand Order. Specifically, both staff and the
applicant do not believe sufficient discussion or direction occurred regarding the
reasons for the remand. Absent more specific direction from the City Council, the
P&Z Commission would hold a second public hearing on the same applications they
already approved (with no modifications).
Staff requested this issue be placed on the Pre-City Council agenda so that we and
the applicant can outline the reasons we feel the applications should not be
remanded to the P&Z Commission and to receive more specific direction regarding
the non-residential portion of the development and its type of uses as it relates to the
Locust Grove neighborhood center (e.g. office, retail or medium density residential).
