RE: Request from Mr. and Mrs. Bohrn for variance:
Vineyards Subdivision, Phase 2 Block 4 Lot 04
The Board of Directors for The Vineyards Homeowners
Association has asked that I contact you regarding the
request from Mrs. Bohrn to allow for the conversion of the
three car garage into space for a pre-school.
The Board opposes the request for two reasons. Mrs. Bohrn
moved into the Vineyards and established the pre-school in
violation of the restrictive covenants, Article II, section
2.1 that states that ho lot shall be used except for
residential purposes, and no lot shall be used for the
conduct of any trade or business. Secondly, section 2.1.2
states that .each lot shall include at least a two (2) car
enclosed garage.
Mrs. ~ohrn was contacted about the covenant violations. She
informed the Association that the use of the property for a
pre-school was temporary until she could locate a site
suitable for the business. The Board approved a temporary
conditional waiver. One of the conditions is that no
vehicles may be parked on the driveway or street.
.Her request to use the garage space for the pre-school
suggests' she intends to use the property long term for the
pre-school, and would need to park vehicles on the street
or driveway, both in violation of the conditional waiver.
The Board of Directors for the Vineyards requests that
Planning and Zoning and the City of Meridian Council
support the Association and its restrictive covenants which

the attractive appearance of the subdivision. Please deny
the request from Mrs. Bohrn for a variance from City Codes
that require a residential property to have a two car
garage.

Association has asked that I contact you again regarding
the business you intend to operate from your home and the
modifications made to the Property. As stated in my letter
dated May 5, 2004, you must submit an Architectural Review
form to the Board to request a waiver of the restriction on
conducting a business within a Property in the Vineyards
subdivision.
The CC & R's for the Vineyards subdivision state in Article
II, section 2.1, that no lot shall be used except for
residential purposes, and no lot shall be used for the
conduct of any trade or business or professional activity-
Please complete and return the enclosed Architectural
Review form within ten days, providing details about the
number of children that will attend this preschool and the
hours of operation. Attach a copy of your license.
Failure to submit a request for waiver may result in the
Association taking legal action against you. Please
contact me if you have any questions or would like to
discuss 'this matter.

The Board of Directors for The Vineyards Homeowners
Association has asked that I contact you regarding an
apparent deviation from the covenants for your
neighborhood. In particular, the Board is requesting that
you refrain from parking or storing the Starcraft camper on
your property where it is visible to the public.
The CC & R's for the Vineyards subdivision state in Article
II, section 2.15, that no boats, trailers, tractors,
recreational vehicles, (i.e., any trailers, campers, motor
homes, automobile campers or similar vehicle or equipment)
be parked or stored on any portion of the Property unless
enclosed by a structure or screened from view in a manner
approved, in writing, by the Architectural Committee.

In accordance with your uCity of Meridian Notice of Hearing- dtd 9th of September, 2004 this
written petition against the variance requested by Earl and Donna Bohrm is submitted with no
animosity towards them and their residence in our community. We wish them the satisfaction of
living in a neighborhood with a friendly, caring neighbors.
Our issues against the variance request from MeC 11-10-6 to allow a childcare/preschool to be
operated in a garage area of a single-family home in an R-4 zone is as follows:
1. Variance Is violation of the Vineyards Subdivision Covenants, Conditions, and Restrictions
ProvIded for the furtherance of a general plan for the protection, maintenance, subdivision,
improvement and sale of the Property, and to enhance the value, desirability and attractiveness
of the Property. The Childcarejpreschool to be operated in a garage area of a single-family home
is in violation of Article II, 2.1 of the Vineyards Subdivision General Covenants, Conditions, and
Restrictions.
2. North Santa Rosa Place is a closed end Cul-de-sac that has traffic problems because of vehicles
parked on either side of the road. This is a hazard to pedestrians and autos (see-attached
photos). Any additional traffic will be a significant impact on the community.
3. We are very concerned about the impact to our property value and the ability to maintain a
reasonable resale capability.
4. There is no community need for a childcare/preschool within the Vineyards. Near the entrance
to the Vineyards Is the "Children Unique Style Childcare- (1915 W. Cherry Lane) which Is
available to parents.
S. There is no adequate parking for parents to safely discharge and pIckup their children because
of the existing present conditions.
