Subj: Testimony Presentation Against Variance Request By Earl and Donna Bohrrn

In accordance with your "City of Meridian Notice of Hearing" dtd 9th of September, 2004 this
written petition against the variance requested by Earl and Donna Bohrrn is submitted with no
animosity towards them and their residence in our community. We wish them the satisfaction
ofliving in a neighborhood with a friendly, caring neighbors.
Our issues against the variance request from MCC 11-10-6 to allow a childcare/preschool to be
operated in a garage area of a single-family home in an R-4 zone is as follows:
1. Variance is violation ofthe Vineyards Subdivision Covenants, Conditions, and Restrictions
provided for the furtherance of a general plan for the protection, maintenance, subdivision,
improvement and sale of the Property, and to enhance the value, desirability and
attractiveness of the Property. The childcare/preschool to be operated in a garage area of a
single-family home is in violation of Article 11,2.1 of the Vineyards Subdivision General
Covenants, Cpnditions, and Restrictions.
2. North Saritaltosa Place is a closed end Cul-de-sac that has traffic problems because of
vehicles parked on either side of the road. This is a hazard to pedestrians and autos (see-
attached photos). Any additional traffic will be a significant impact on the community.
3. Weare very concerned about the impact to our property value and the ability to maintain a
reasonable resale capability.
4. There is no community need for a childcare/preschool within the Vineyards. Near the
entrance to the Vineyards is:tlae t'(JhiWren Unique StyleChildcare" (1915 W. Cherry Lane)
which is available to parents.
5. There is no adequare parking for parents to safely discharge and pickup their children
because of the existing present conditions.

CITY OF MERIDIAN
NOTICE OF HEARING
NOTICE IS HEREBY GIVEN pursuant to the Ordinances of the City of Meridian
and the Laws of the State of Idaho, that the City Council of the City of Meridian will hold
a public hearing at the Meridian City Hall, 33 East Idaho Avenue, Meridian, Idaho, at the
hour of 7:00 p.m. on Tuesday, October 5, 2004 for the purpose of reviewing and
considering the application of Earl and Donna BohIftifor a Variance from MCC 11-10-
6 to allow a childcare/preschool for five or fewer children to be operated in a required
garage area of a single-family home in an R-4 zone for Earl and Donna Bohm located
at 1451 North Santa Rosa Place.
A more particular description of the above property is on file in the City Clerk's
office at Meridian City Hall, 33 East Idaho Avenue, and is available for inspection during
regular business hours, Monday through Friday, from 8:00 a.m. to 5:00 p.m.
A copy of the application is available for review. Any and all interested persons
shall be heard at said public hearing, and the public is welcome and invited to submit
testimony. Oral testimony may be limited to three (3) minutes per person. Written
materials should be submitted to the City Clerk no later than seven (7) days prior to the
above hearing date so that all interested parties may examine them prior to the hearing.
All materials presented at public meatings shall become property of the City of Meridian.
