Request for a Conditional Use Permit for a Daycare Facility for up to 40 children

We have reviewed this submittal and offer the following comments.
APPLICATION SUMMARY
The applicants, Condra and David Steeves, have requested approval of a conditional use permit
(CUP) for an existing 1,390 square foot residence to be used as a daycare facility for up to 40
children. The Schedule of Use Control requires a Conditional Use Permit for daycare facilities
in the R-8 zone.
The applicant is requesting Alternative Compliance to allow reduced landscape buffers and also
requesting permission to include compact parking spaces. Staff has strong concerns regarding
the potential impacts of the daycare facility on the surrounding neighborhood and recommends
denial of the proposed project based on these concerns.
LOCATION & SURROUNDING USES
The subject property is located at 1258 E. Cougar Creek Drive, on Lot 13, Block 1 of Cougar
Creek Subdivision. The subject property is located on the northern side of Cougar Creek Road,
approximately halfway between Locust Grove Road and N. Wren Avenue.
North - Single Family Residential, Zoned R-8.
South - Single Family Residential, Zoned R-8.
East - Single Family Residential, Zoned R-8.

OWNER OF RECORD
The owners of record are Kelly J. and Stephanie R. Perry, and they have given their consent for
the applicant to submit the requested conditional use permit.
STANDARDS FOR CONDITIONAL USES
The Commission and Council shall review the particular facts and circumstances of each
proposed conditional use in terms of the following, and may approve a conditional use
permit if they shall find evidence presented at the hearing(s) is adequate to establish (11-17-
3):
A.
That the site is large enough to accommodate the proposed use and all yards, open
spaces, parking, landscaping and other features as may be required by this
ordinance;
Staff finds that the subject property is not large enough to accommodate the landscape
buffers required by the ordinance and the full-size parking spaces required by ordinance.
The applicant is requesting alternative compliance for the 20'required landscape buffer
on the east and west sides of the subject property and requesting permission to allow two
of the required parking spaces to be compact parking spaces. While the site plan does
include all required parking for the daycare facility (if the daycare facility serves 30
children and has two staff members), it should be noted that two of the required parking
spaces are inside the garage of the residence and that the three remaining spaces are
located on the driveway of the residence. The applicant is requesting a 15' front yard
setback for the parking spaces based on the interpretation that the R-8 zone has a 15'
front yard setback for living areas.
B.
That the proposed use and development plan will be harmonious with the Meridian
Comprehensive Plan and in accordance with the requirements of this Ordinance;
The Comprehensive Plan Land Use Map designates the property as "Medium Density
Residential," and it is currently zoned R-8. Staff finds that the requested use is in
compliance with the approved Future Land Use Map. Staff finds that the CUP is not in
compliance with City ordinances regarding landscaping and parking.

That the design, construction, operation, and maintenance will be compatible with
other uses in the general neighborhood and with the existing or intended character
of the general vicinity and that such use will not adversely change the essential
character of the same area;
Staff finds that the proposed development has the potential to adversely change the
existing or intended character of the general vicinity. While a smaller daycare facility
may be compatible with surrounding residential uses, staff finds that the proposed

daycare facility serving up to 40 children is too large in scale for a residential
neighborhood. The proposed daycare center serving up to 40 children will increase
traffic in the neighborhood and has the potential to generate noise not compatible with
residential uses. Commission and Council should listen to public testimony regarding the
compatibility of the daycare facility with adjoining residential uses. No public comments
regarding the proposed application have been received to date.
That the proposed use, if it complies with all conditions of the approval imposed,
win not adversely affect other property in the vicinity;
Staff anticipates that the proposed use will adversely affect adjacent properties. The
traffic and noise that will potentially be generated by the daycare facility serving up to 40
children will adversely affect other property in the vicinity. The Commission and
Council should rely upon public testimony to determine ifthe development will adversely
affect any property in the vicinity.
That the proposed use will be served adequately by essential public facilities and
services such as highways, street, police, and fire protection, drainage structures,
refuse disposal, water, sewer or that the person responsible for the establishment of
proposed conditional use shan be able to provide adequately any such services;
Staff finds that the proposed development can be adequately served by the essential
public facilities and services listed above. Police and fire comments are included in the
agency comments section of the staff report. Sanitary Services Company (SSe) will
provide refuse disposal services to the property.
That the proposed use will not create excessive additional requirements at public
cost for public facilities and services and win not be detrimental to the economic
welfare of the community;
Staff finds that the proposed daycare facility will not be detrimental to the economic
welfare of the community, nor would it create the need for any new facilities or services
to be paid for by the public.
G.
That the proposed use win not involve activities or processes, materials, equipment,
and conditions of operation that win be detrimental to any persons, property, or
general welfare by reason of excessive production of traffic, noise, smoke, fumes,
glare or odors;
Staff finds that while the proposed daycare facility will increase traffic and noise, no
excessive smoke, fumes, glare or odors will result from the proposed use.
That the proposed use win have vehicular approaches to the property which shan be
so designed as not to create an interference with traffic on surrounding public
streets;

Staff finds that the proposed use will not create significant interference with any traffic
on the surrounding public streets. The existing driveway will be used by the proposed
daycare facility.
That the proposed use win not result in the destruction, loss or damage of a natural,
scenic or historic feature considered to be of major importance.
Staff finds that no natural or scenic feature will be lost, damaged or destroyed by issuance
of this conditional use. The property has already been developed as a single family
residence and all existing trees will be retained.

Landscape buffer: The required landscape buffer for a daycare facility in a residential
area is 20.' Due to site constraints and the location of the existing residence it is
impossible for the applicant to provide a 20' landscape buffer on the eastern and western
edges of the subject property. The applicant is requesting alternative compliance to allow
a buffer of 12' on the eastern edge of the property and 11' 6" on the western edge of the
property. If the CUP is approved, the applicant will need to provide additional
information on how they will provide additional landscaping for the proposed alternative
compliance.
Onweiler Lateral: The Onweiler Lateral runs along the northern edge of the subject
property. The applicant is proposing a 6' chain link fence at the northern edge of the
property to restrict access to the canal. Staff is recommending that if the CUP is
approved that this fence be modified or replaced with a fence that will be difficult for
children at the daycare facility to climb and access the lateral.
Parking Calculations: Ordinance 11-13.5 lists a parking requirement for daycare
facilities of one space for every ten children and one space per employee. The five
proposed parking spaces meet parking requirements of the code if the daycare facility is
approved for 30 children and two staff members. The applicant is requesting
permission to use two compact sized spaces in the existing garage and to use the
existing driveway as parking for the daycare facility. The applicant is requesting a 15'
front yard setback for the parking spaces based on the interpretation that the R-8 zone
has a 15' front yard setback for living areas.

One and two family dwellings will require a fire-flow of 1,000 gallons per minute available
for duration of 2 hours to service the entire project. Fire hydrants shall be placed an average
of 400' apart. International Fire Code Appendix D

reputation of Small Hands Preschool is well-known in our area and we are excited to

To Whom It May Concern:
I, Cynthia A. Robertson, ofl290 E.Cougar Creek Dr. (next-door neighbor on the east side of the
proposed preschool site) have met with the owner of Small Hands Preschool, Condra Steeves,
and she has addressed the concerns I have as of the date of this document. If the preschool is
generally operated as per my discussions with Ms. Steeves (i.e., 10- I 5 children per session; up to
four sessions per day between the hours of9 a.m. and 3 p.m. each weekday; release and waiver
of liability signed by each parent whose child or children attend the preschool; at least two
teachers on site at all times children are present), then I do not object to the Small Hands
Preschool operating next door to my home. Furthermore, if the school is operated so that the
children are generally inside the house except for arriving and departing the school and for one
15-20 minute recess break per session, I do not require a noise buffer of twenty feet as suggested
by the Meridian Planning and Zoning Commission.

To whom it may concern,

In reference to the Preschool facility going in
to our subdivision of Cougar Creek. Ms. Condra Steves
has answered all of our questions and concerns. We
understand that only 10 to 15 children will be in a class
with only 2 classes going at any given time. and that
many are neighborhood kids that will walk to the
school or come in car pools so as to limit traffic at the
facility. The business hours are from 9am to 3 pm.
Monday through Friday, when most in the
neighborhood are at their secular jobs, and won't
interfere with their coming and going. We greatly look
forward to the addition of this school in our area and
plan to have our 4 year old son Lucas attend. We think
it will be a real asset to our neighborhood.

My name is Stephanie Perry. My husband and I currently own the home located at 1258
East Cougar Creek Drive. I am writing this letter to express my support of Small Hands
Preschool moving Into this location.
We have lived in this home for eight years. As our family has grown, we have been
looking at moving for a couple ,of years. CIDTentJy, we are weeks away from having our
fourth baby and the home has become too small tEl meet our needs. We also own a lawn
care business. We have a truck and tWEI trailers that we use for this business along with
our own two personal vehicles. We also need a home that has adequate parking for our
business. This home simply isn't meeting our needs anymore, Our parking issues have
also been a burden on the neighborhood.
We have tried to selllhe home on two previous ocçasjons, but were UllJUcccssful. There
is a group home next door IIl1d wi of our interested buyers were turned away when we let
them know about it. We did not know about it when we purchased the home, and we
only feel that it is fllÍr to let any interested buyer know ahout it. Our master bedroom is
right next to their driveway. We can hear all of the residents as they play basketball,
smoke, play their stereo and also an of the employees coming and going during shift
changes. These shift changes occur at 7:00 in the morning, in the afternoon and also at
11 :00 at night. This bas made our home very diffkult to sell.
We feel that having Small Hands Preschool move into this location will alleviate these
problems and improve our neighborhood. Small Hands will put up shrubs IIl1d bushes to
create a sound barrier between our home and both neighbors. They will also increase the
driveway space. If this pennít is granted, this location will be used solely as a preschool
and no longer as a residence. We will move from the homo and take all of our vehicles
and trailers with us. The emplcíyees of Small Hands will be able to park in the garage,
and they will only be at the looation fioom approximately 9:00 a.m. to 3:00 p.m., while
most of our neighbors are III wolk. Thc preschool will cause minimal1raffic around 9:00,
noon and 3:00. The parents will drop off their students and leave, and the classes have
been stalilered to avoid traffic congcstion. There will not be any parents parking at the
home. There will not be anybody at the home in the evenings and weekends. This will
alleviate the current puking issues here.
A contract bas also been sign¡:d between Stay Green Lawn Care and Small Hands
Preschool. The lawn will be maintained to look like a residence. There will be no
business signs in the front yard.

After further discussion with Conndra Steeves regarding concerns for the proposed
preschool, we accept the preschool on Cougar Creek. She has promised the following,
which make the terms acceptable.
. No signs to indicate that the house is a school.
. No other indication that ifs a school from the front
e Car pools to drop off and pick up children to hold traffic down.
. Cars will use the dñvewayonly for dropping off and picking up.
. Parents will have instructiOns to not park on the street and not to make U turns
. School hours will be morning and afternoon.
. No one wi11live in the ho\lse.
. The home will be equipped with a security alarm system.
. The home doesn't get rented when school season is not in session.
. Conndra Steeves is submitting the request for a lower speed limit on Cougar
Creek. She mentioned that there were several residents who share this concern.
Also in consideration of the deplorable conditions of the group home located next door,
it's our opinion that the home at1258 E. Cougar Creek is not saleable. Given the
alternatives of rental property ora substantially discounted price, the preschool is
probably the best solution for tbi$ property.
Our concern also remains for high traffic volume and excessive speed on Cougar Creek
Drive. We support Conndra St~es desire and residents on this street who are requesting
the city of Meridian to lower the speed limit.

School, I wish to add my assurances to the concerns expressed to date.
Small Hands Pre-School has always made a conscientious effort to have a
minimal impact on its neighborhood not only for the neighbors' benefit but
also for the safety and assurance of the children. The preschool has always
encouraged carpools and has even helped parents every year to find
neighbors and form carpools. The main purpose of the preschool is to teach
children and prepare them for elementary school, therefore there is minimal
outside time and minimal noise for the neighborhood.
My preference for my children is that their first exposure to school be in a
home-like environment. It is less intimidating and strengthens the idea that
home can and should be a learning environment. This is the setting that
Small Hands Pre-School provides.
Having Small Hands Pre-School in this neighborhood should be considered
an asset to the neighborhood, the local school system, and to the families
residing in the area as the children will be better prepared for elementary
school; will learn values such as respect for others, kindness, honesty, etc.;
and in so doing will be better members of their community and
neighborhood.
I give my full support to Small Hands Pre-School and recommend that they
be allowed to operate in the Cougar Creek Subdivision.

Rarely are we as fortunate as citizens to have a pre school
that is as well rounded as Small Hands Pre School. Staffed
with people who believe in our children and who seek to
expand that knowledge while building a strong foundation

second to none.
Last year my wife and I enrolled our son inSmall Hands
Pre School and were 'delighted. with the results. This

dealing with her parents for over fifteen years. During this time, I observed Conndra's
conduct in a variety of settings. Her integrity is impeccable. She is a hard worker and
capable owner-manager of the pre-school education business called Small Hands
Preschool.
She is a dedicated wife and mother to six children. She is a strong advocate for children,
education and the Meridian School District. In fact, her father, Merlyn Bodily spent most
of his career as an educator teaching high school chemistry for the District.
Her business provides an important service needed by many parents in the area. The

We had hoped to attend the meeÞog on SqJtœ:1Iø the -r but our plans have changed
and we now write to you instead. We are opposed to the daycare fåcility on Cougar Creek
drive for the following reasons:
1. There are several businesses and a group home akœdy located on this street. One
daycare, a mobile glass seniœ, one home oßiœ and the group home with vans
that transport needy people in and out.
2. There are many renta1 homes located on the street. Granted, these are for
residentia1 use but they are also proprietary in IIIIIme for their owners.
3. The speed limit is 25 MPH and many cars appear to drive at that speed or higher.
School zone speeds are 20 MPH.
4. There are many parked cars around this facility a lot of the time, which adds
clutter to the street, 1imits drop off space and is a safety issue for children entering
and leaving the facility. There are also two flatbed trailers parked in the driveway
of this location which further limits access.
5. Our observation is that traffic is already at high volume for a residential street.
Each "day care" child adds two round trips per day to traffic on this street.
6. Your notice descn"bes this request as a day care but the handout that was provided
by the Steeves is for a preschool. Please explain.
7. We have three children in our family and we are coocemed fur their safety on this
street.
In summary, we feel that the number of commercialproJerties on this street is too high
already and adding additional business degrades the residenbal value and pride of
ownership for those that are simply ~ that desire quiet and quality of life. We
also feel that traffic on this street is high due to business and residentia1 use combined
and the speed limit is too high especially tOr day care and Pre School.
Please don't allow another business on tIù residential street and please lower the speed
limit to 20 mph for the safety of tile residents who live here.
