At the August 19, 2004 hearing, testimony was provided by the following people: Staff testified on the proposed applications. Chris Hobbs testified in favor ofthe proposed application. Key Commission Changes to Staff Recommendation: . The Commission made no modifications to the conditions included in the staff report. Outstanding Issues for City Council: . None, the applicant has submitted a letter trom Meridian's Fire department approving the proposed turn-around discussed at the August 19,2004 Planning and Zoning Commission hearing. BEFORE THE PLANNING AND ZONING COMMISSION IN THE MATTER OF THE REQUEST FOR CONDITIONAL USE PERMIT FOR A DAYCARE CENTER IN A C-G ZONE Case No. CUP-O4-027 RECOMMENDATION TO CITY COUNCIL Primary Colors, Inc., Applicant 1. The property is located at the southwest comer of Cobalt Point Way and Copper Point Drive within the Silverstone Business Campus, Meridian. 2. The owner of record of the subject property is Sundance Inc. 3. Applicant is Primary Colors. 4. The subject property is currently zoned C-G. The zoning district of C-G is defined within the City of Meridian Zoning and Development Ordinance, Section 11-7-2. 5. The Applicant requests the Conditional Use Permit for a Daycare Center in a C-G zone. The C-G zoning designation within the City of Meridian Zoning and Development Ordinance requires a Conditional Use Permit be obtained for most uses including those requested by the Applicant. (Meridian City Zoning and Development Ordinance, Section 11-8-1). 6. The Meridian Planning and Zoning Commission recognizes thatthe proposed application is in compliance with the Meridian Comprehensive Plan. 7. The use proposed which is the subject of this will, in fact, constitute a conditional use as determined by City policy. RECOMMENDATION The Meridian Planning and Zoning Commission hereby recommends to the City Council of the City of Meridian that they approve the requested Conditional Use Permit as requested by the Applicant for the property described in the application, subject to the following: A. Adopt the Special Recommendations of the Planning and Zoning Commission as follows: RECOMMENDATION TO CITY COUNCIL OF APPROVAL OF CONDITIONAL USE PERMIT FOR A DAYCARE FACILITY BY PRIMARY COLORS - CUP-O4-027 - Page 1 A. Adopt the Recommendations of the Planning and Zoning and Engineering staff as follows: SITE SPECIFIC CONDITIONS (Conditional Use Permit) 1. All conditions of the previously approved Annexation/Zoning, Development Agreement, Silverstone Business Campus Subdivision, and the Preliminary Plat for Silverstone Business Campus Subdivision shall also be considered conditions of this Conditional Use Permit (CUP-04-027). 2. No building or other structure shall be erected, moved, added to or structurally altered, nor shall any building structure or land be established or change in use on this site without first obtaining a certificate of zoning compliance (CZC) trom the Meridian Planning and Zoning Department. 3. The Applicant shall coordinate the location and design of trash dumpsters with Sanitary Services Company (SSC) staff. Trash enclosures must be built in the location and to the size approved by SSC. All dumpster(s) must be screened in accordance with MCC 11- 12-1.C. 4. All siguage shall be in accordance with the standards set forth in MCC 11-14. All signs will require a separate sign permit in compliance with the sign ordinance. Unless otherwise approved, no temporary signage, flags, banners or flashing signs will be permitted. 5. A drainage plan designed by a State of Idaho licensed architect or engineer is required and shall be submitted to the City Engineer (Ord. 557, 10-1-91) for all off-street parking areas. Storm water treatment and disposal must be desigued in accordance with Department of Environmental Quality 1997 publication Catalog of Storm Water Best Management Practices for Idaho Cities and Counties and City of Meridian standards and policies. Off-site disposal into a surface water is prohibited unless the jurisdiction which has authority over the receiving stream provides written authorization prior to development plan approval. The applicant is responsible for filing all necessary applications with the Idaho Department of Water Resources regarding Shallow Injection Wells. 6. Sanitary sewer and water service shall be trom existing service lines on the property. Assessment fees for sewer and water will be calculated and paid at the time of building permit issuance. 7. Underground year-round pressurized irrigation must be provided (trom an existing system) to all landscape areas on this site. RECOMMENDATION TO CITY COUNCIL OF APPROVAL OF CONDITIONAL USE PERMIT FOR A DA YCARE FACILITY BY PRIMARY COLORS - CUP-O4-027 - Page 2 8. Any drainage areas (detention/retention basins) must be designed to ensure that water will percolate or discharge within a period of time not to exceed 24 hours for all storms up to and including a 100-year storm event. 9. All exterior lighting shall be down-shielded or otherwise altered so that the light does not spill over onto adjacent properties or right-of-way. All parking lot lighting shall be in accordance with MCC 11-13-4C. 10. All development shall comply with the Americans with Disabilities Act (ADA.) 11. Prior to obtaining certificate(s) of occupancy, all development improvements, including perimeter fencing, irrigation, and landscaping, unless otherwise noted in this report, shall be installed. Prior to signature of the final plat by the City Engineer, a letter of credit or cash surety in the amount of 110% will be required for all fencing, landscaping, pressurized irrigation, amenities, sanitary sewer, water, etc. 12. Staff's failure to cite specific ordinance provisions or terms of the approved annexation/preliminary plat/conditional use does not relieve the Applicant of responsibility for compliance. 13. The subject conditional use permit may be revoked or modified by the City Council, upon notice and hearing, for breach or violation of any condition of approval or limitation of the permit (MCC 11-17-11). 14. This conditional use permit shall be subject to the expiration provisions set forth in MCC 11-17-4.B. B. Adopt the Recommendations of the Meridian Fire Department as follows: 1. Final Approval of the fire hydrant locations shall be by the Meridian Fire Department. a. Fire Hydrants shall have the 4 W' outlet face the main street or parking lot aisle. b. The Fire hydrant shall not face a street which does not have addresses on it. c. Fire hydrant markers shall be provided per Public Works spec. d. Locations with fire hydrants shall have the curb painted red 10' to each side of the hydrant location. e. Fire Hydrants shall be placed on comers. f. Fire hydrants shall not have any vertical obstructions to outlets within 10'. 2. The phasing plan may require that any roadway greater than 150' in length that is not provided with an outlet shall be required to have an approved turn around. 3. All entrance and internal roads shall have a turning radius of 28' inside and 48' outside radius. Provide a 20' wide Fire Lane for all internal & external roadways. 5. Operational fire hydrants and temporary or permanent street signs are required before combustible construction begins. 6. Commercial and office occupancies will require a fire-flow consistent with the International Fire Code to service the proposed project. Fire hydrants shall be placed an average of 300' apart. 7. The proposed project lies outside the five-minute response zone goal. Achievement of this goal is subject to budgetary constraints and is intended to enhance the probability of a favorable outcome on a request for Basic Life Support. The budget constraints are typically defined as capital outlay for facilities that are located within 1.5 miles trom a given location and sufficient operational funds to staff the facilities. 8. Maintain a separation of 5' trom the building to the dumpster enclosure. 9. Provide a Knoxbox entry system for the complex. 10. All portions of the buildings located on this project must be within 150' of a paved surface. 11. Three- point turn is needed at end of parking lot. 12. Site must pass criteria of State Fire Marshall for day care center. C. Adopt the Recommendations of Central District Health Department as follows: 1. Central District Health will require plans to be submitted for any child care center. D. Adopt the Recommendation ofNampa & Meridian Irrigation District as follows: 1. Applicant shall apply for a land use change application prior to final platting. 2. All laterals and waste ways must be protected. 3. All municipal surface drainage must be retained on site. If any surface drainage leaves the site, the Nampa & Meridian Irrigation District must review drainage plans. 4. The Developer must comply with Idaho Code 31-3805. 5. NMID recommends that irrigation water be made available to all developments within the Nampa & Meridian Irrigation District.
