Apartments)
I am writing to object to application H-2017-0007 submitted by Brian Porter to rezone the eastern 5
acres of the 12.38 parcel from R-4 to R-40 to allow the construction of the proposed Goddard Creek
Apartments.
I live in the Kelly Creek Subdivision which is located next to this proposed 82-unit apartment
complex. This proposed apartment complex will be built next to and south of the existing 171-unit
Selway Apartment complex. The proposed Goddard Creek Apartment and the existing Selway
Apartments both are located next to, and west of, the Kelly Creek Subdivision. The current city plan
zones the proposed Goddard property as R-4/Office. It has always been our understanding that this
property would be limited to office development and R-4 residential use, and that no additional
apartment complexes would be allowed. Now, a petition has been submitted to change this so the
Goddard Creek Apartments may be built.
The proposed Goddard Creek Apartments will negatively impact Kelly Creek Subdivision in many
ways. First, auto traffic through the subdivision will substantially increase. The entrance to the
proposed Goddard Creek Apartments will be on Goddard Creek Way. Because of the difficulty of
turning left from Goddard Creek Way onto West McMillan, many Selway Apartment residents already
drive through the Kelly Creek Subdivision to Linder Road. This is particularly noticeable during
morning and afternoon “rush hours” when some, but certainly not all, are driving above the speed
limit. Adding another apartment complex with an additional 82 units will only exacerbate this traffic
problem. Our neighborhood streets were not designed to accommodate this volume of traffic. The
risk to our children and pedestrians who are often walking to and from school during these busy hours
will only increase.
Second, adding another apartment complex will significantly change the nature of our residential
community. The Selway Apartment is located on the western border of Kelly Creek. With our 372
homes and the 171 units in Selway Apartments, our community is 68.5% single family homes and
31.5% apartment units. The proposed Goddard Creek Apartments will add another 82 units, thereby
reducing the percentage of single family homes to 59.5% single family homes. Indeed, the impact on
those who live in western section of Kelly Creek Subdivision will be far greater and much more
unfair. These people purchased their homes believing that they would be living in a residential
neighborhood. I know of one neighbor who specifically checked with the zoning department before
she purchased her home on the west side of Kelly Creek. She was told that the land to the west was
to be developed as office space. The proposed Goddard Creek Apartments will substantially change
this. Clearly, her disappointment and frustration is understandable. These residents, in particular, will

feel the impact of increased traffic, increased noise and congestion, and decline of their home’s
value.
I understand that every community needs rental apartments, but these apartment complexes should
be disbursed throughout the community so as to not negatively impact just one or a few
neighborhoods. Kelly Creek already has a 171-unit apartment complex on its western border.
Because one apartment complex is already located there is not a justification to add yet another
apartment complex. The Kelly Creek residents whose homes are near this proposed apartment
complex do not deserve this. It is unfair. They bought their homes with the good faith understanding
that the land to the west was zone for office building, not another apartment complex. For these
reason I request that the application to rezone the property from R-4 to R-40 so as to permit the
construction of the Goddard Way Apartment complex be denied.
