Continuation hearing on April 20, 2017. False information has been provided by Applicant in the Affidavit of
Sign Posting, and there may be possible irregularities in Noticing.

Dear Mayor, City Attorney, City Council and City Clerk:
Shortly after the March 16, 2017 Hearing on this matter, our HOA was contacted by owners who live within 300
feet of this proposed development, who should have received Notice of Hearing, and have stated they did not. Our
property manager, also did not receive Notice, which is highly unusual, as in the past our managers have always received
Notice of Hearings and Notice of any Neighborhood/Community Meetings, which are forwarded to each board member.
An additional concern is Applicant or his Agent provided false information in the Affidavit of Sign Posting, in
which the Notarized Affidavit states two Notice of Hearing signs were posted. That is not true. Only one sign was
posted. Applicant provided pictures of two signs, however the pictures are front and back of the only sign posted.
Applicant provided a map showing where he states the two signs are placed (they would be about 275 feet apart, if the
second sign had been placed.) The time stamp on the pictures is exactly the same – February 28 at 15:22. Evidence
seems to indicate applicant snapped picture of front of sign, and i mmediately snapped picture of back of sign. It is not
possible to take pictures of two signs 275 feet apart in less than one second.
Had the second sign been posted near Kelly Creek entrance at Goddard and McMillan (as notarized Affidavit
says it was), it would have been highly visible from our main entrance at W. Goddard Creek and McMillan.
We have obtained from the City Clerk the list of those living within 300 feet of the proposed development, and
who should have received Notice of Hearing. For the home at 5015 N. Lolo Pass the owner is listed as Bradley Peterson.
The home was sold on January 17, 2017 to Eric Hinderager, and he has stated he did not receive Notice .
Because of concerns over owners stating they did not receive Notice, and because Applicant provided false
information in notarized sign posting Affidavit, on April 12, we reached out to an individual who has knowledge of
proper noticing and planning department practices. We asked if the community should wait and express our concerns
and evidence at the Continuation Hearing on April 20, 2017. This individual advised us not to wait, but to immediately
meet with the planning department.
On April 13 at 8:00 am a telephone call was placed by Kelly Creek HOA secretary to Bill Parsons, planning
department supervisor requesting he meet with some of the concerned owners either April 13 or April 14. Mr. Parsons
stated he would not meet with the community, and that the planning department has no problem with Applicant
making a false statement on the notarized Affidavit of Sign Posting. Mr. Parsons stated we could bring our pictures and
evidence Applicant provided false information to the hearing on April 20, 2017, but it may or may not be allowed to be
presented. It will be up to the chairperson of the Planning and Zoning Commission the night of the hearing whether or
not any public testimony will be allowed in this matter.
Attached to this email is supporting documentation of owners stating they did not receive proper notification,
and pictures showing clearly that Applicant provided false information on the Affidavit of Sign Posting. Also peculiar and
troubling with this Application, is the Notice of Neighborhood Meeting for December 22 meeting. Our property
manager did not receive it, so the board was not aware, but have been provided a copy. No details, no drawing of what
the development will look like, no mention of rental units. There should have been a drawing showing self-storage and
the 80 + proposed rental units. A copy of the Notice is included in the attachments to this email.
We would appreciate your looking into this matter and doing the right thing for our community.

i live in Kelly Creek Subdivision. My address is 2393 W. Apgar Creek Drive, i live within 300 feet of the
proposed Goddard Creek Apartments and/or storage facility.
My name is on the City Clerk's list of those living with 300 feet of the proposed development; however i
did not receive Notice of the Hearing {March 16, 2016), nor did i know anything about proposed
apartments. Further, applicant and/or his agent made an untruthful statement when information was
given to the City about sign placement. They stated in writing two signs were placed - one near the
corner of McMillan and Goddard Creek. There was never a sign posted near the corner of McMiilian and
Goddard Creek. The only sign is approximately 275 feet from Goddard/McMillan, and i believe it was a
deceptive tactic by Applicant to prevent owners in Kelly Creek from knowing about the proposed
project.
Because I live within 300 feet, and because i did not receive Notice of Hearing, this is a violation of CITY
OF MERIDIAN PLANNING DEPARTMENT STANDARD OPERATING POLICY REVIEW OF HEARING LEVEL
APPLICATION, and because of this violation, i am requesting the City deny the entire application based
on irregularities in Noticing and untruthful statement by applicant regarding sign placement.
i have heard from planning department personnel they were surprised only one family in Kelly Creek
was present at the meeting, as so any were at the hearing to protest the Selway Apartments, it is
impossible to attend a meeting when one does not know about it.
i am requesting Keiiy Creek HOA to submit this letter on my behalf to the above-named recipients.

Five of the seven persons who signed in as attending the March 16 Hearing represent the developer:
Shon Parks, Kristina Keith, John Carpenter, Tim Aluture, James Doolin
Sheryl Tolman resides at 2695 W. McMillan Road. She stated she did not receive Notice of Hearing, just
happened to see the sign, drove close and read it.
Dan and Penny Fisher live in Kelly Creek. They apparently did not sign in, did not receive Notice of
Hearing - happened to see sign. They alerted the HOA of the proposed development. Seems likely
some from Kelly Creek would have attended, had they received Notice 84 apartments units were
proposed.

Dear Neighbor:
I am writing to invite you to attend a neighborhood meeting on a proposed development in
your area. This meeting is for a portion of a 12 acre project located at 2780 W. McMillan
Road. This is an informal meeting held by T-0 Engineers, representing the Owner. Formal

The HOA manager did not receive this Notice of Neighborhood Meeting. It was shared by an owner who
did receive it, who was fine with the self-storage units, and there was no mention of apartments so she
did not go. An architectural drawing, including details of the proposed development should have been
enclosed with the neighborhood meeting notice.

Kelly Creek Property Manager did not receive Notice of this Neighborhood Meeting. A Kelly Creek
owner shared her copy of the Notice she received, hut did not attend, as was OK with self-storage, and
Notice did not say anything about proposed apartments.

October 10, 2016 Community Meeting Notice. Property Manager, Red Door received Notice. Eight
community members attended, including four from Kelly Creek. Tim Aiatore, architect was present, as
well as one of the developers for storage units. The Community Meeting Notice stated they were
proposing a self-storage facility, and detailed plans were presented to those in attendance. They were
very upfront, and stated entrance would be on McMillan, storage units on east 7 acres, and they felt the
five acres on the west would be suitable for an assisted living facility. The architect and developer did
not sign as attendees, likely because they are not part of the community.
