Denial of Application - Applicant Brian Porter
I live in Kelly Creek Subdivision. My address is 2393 W. Apgar Creek Drive. I live within 300 feet of the
proposed Goddard Creek Apartments and/or storage facility.
My name is on the City Clerk's list of those living with 300 feet of the proposed development; however I
did not receive Notice of the Hearing (March 16, 2016), nor did I know anything about proposed
apartments. Further, applicant and/or his agent made an untruthful statement when information was
given to the City about sign placement. They stated in writing two signs were placed - one near the
corner of McMillan and Goddard Creek. There was never a sign posted near the corner of McMililan and
Goddard Creek. The only sign is approximately 275 feet from Goddard/McMillan, and I believe it was a
deceptive tactic by Applicant to prevent owners in Kelly Creek from knowing about the proposed
project.
Because I live within 300 feet, and because I did not receive Notice of Hearing, this is a violation of CITY
OF MERIDIAN PLANNING DEPARTMENT STANDARD OPERATING POLICY REVIEW OF HEARING LEVEL
APPLICATION, and because of this violation, I am requesting the City deny the entire application based
on irregularities in Noticing and untruthful statement by applicant regarding sign placement.
I have heard from planning department personnel they were surprised only one family in Kelly Creek
was present at the meeting, as so any were at the hearing to protest the Selway Apartments. It is
impossible to attend a meeting when one does not know about it.
I am requesting Kelly Creek HOA to submit this letter on my behalf to the above-named recipients.
