RE: Amended Magic View Subdivision
Dear Ms. Stiles:
The Owners of the Amended Magic'View Subdivision would like to request a modification of the
development Agreement. Per the conditions of the original Development Agreement the Owner
must seek City Council Approval through a public hearing. By this application we are
requesting City Council have a public hearing to add the following wording.
1. RECITALS: 4. USES pERMITTED BY THIS AGREEMENT:
Modify item 4.1 to include the following use as a conditional use for the southeastern
parcel: Drive-through Restaurant.

The uses allowed pursuant to this Agreement are only
those uses allowed under "City"'s Zoning Ordinance
codifiez[ at Meridian City Code § i 1-7-2 G which are
herein specified as follows:

allowed without modification of this Agreement.
5. CONDITIONS GOVERNING DEVELOPMENT OF
SUBJECT PROPERTY:
5.1
"Developer" shah develop the "Property" in accordance
with the following special conditions:
5. I ~ The property should be zoned L-O, Limited Office
District, and the Applicant shall use the subject
pr6perty to develop professional Office uses with any
other uses permitted in the subject zone only as a
condition/d use.
5.1.1
Any existing imgation/drainage ditches crossing the
· property to be included in this project, shall be tiled
per City Ordinance 11-9-605.M. Plans will heed to
be approved by the appropriate irrigation/drainage
district, or lateral users association, with written
confirmation of said approval submitted to the
Public Works Department. No variances have been
requested for tiling of an~, ditches crossing this
project.

Since the Subway Sandwich Shop was approved last night at the Planning and Zoning
meeting with the condition that the Development Agreement be modified to include the
provision for a Drive-through Restaurant on the Southeast Parcel, I have been putting
together the required information to submit for this revision.
Please find attached the packet I have assembled for submission to the City of
Meridian.
I am in need of a few items from your office to complete the package, they are:

subdivision.
A signature on the Miscellaneous APplication, cover sheet.
And an 8 1/2 x 11 of thc plat of the entire site.
