Knopp P&Z Commission Hearing Date: August 5, 2004 Recommendation: Approve with conditions (All Ayes) Summary of Public Hearing: . The applicant, Larry Knopp, and the developer, Jon Wyman, testified in favor of the application. . One letter of support was received from Ginger Cooper. . No other testimony was given from the public . Six Special considerations were detailed per the staff report. The Commission's questions centered on these issues. Key Commission Changes to Staff Recommendation: . The condition regarding landscaping the buffer between land uses along the west boundary was modified to match the Alternative Compliance approved by Council for the Lynwood Plaza final plat. Outstanding Issues for City Council: . None. However, please note that the proposed conditions from Settlers Irrigation District were intentionally removed from the Recommendation to Council because the Settller's irrigation facility does not cross the subject property and does not serve it. BEFORE THE PLANNING AND ZONING COMMISSION IN THE MATTER OF THE REQUEST FOR A CONDITIONAL USE PERMIT FOR A DRIVE- THROUGH PHARMACY (MEDICAP) IN AN L-O ZONE Case No. CUP-O4-020 RECOMMENDATION TO CITY COUNCIL LARRY R. KNOPP, Applicant 1. The property is located on the north side of Cherry Lane, approximately 1/4 mile east of Ten Mile Road, Meridian. 2. The property owner of record is Oakwood Enterprises, LLC, 114 E. Idaho, Suite 230, Meridian and they have given their consent for the applicant to submit the conditional use permit application. 3. Applicant is Larry R. Knopp, Architect, 355 S. 3rd Street, Boise, ill 83702. 4. The subject property is currently zoned L-O (Limited Office District). The zoning district ofL-O is defined within the City of Meridian Zoning and Development Ordinance, Section 11-7-2. 5. The Applicant requests the Conditional Use Permit for a drive-through phannacy use in the L-O zone. Drive-through uses are deemed a conditional use in the L-O zone by Meridian City ordinance. 6. The Meridian Planning and Zoning Commission recognizes that the proposed application is in compliance with the Meridian Comprehensive Plan. 7. The use proposed which is the subject of this will, in fact, constitute a conditional use as determined by City policy. RECOMMENDATION TO CITY COUNCIL OF APPROVAL OF CONDITIONAL USE PERMIT FOR A PHARMACY WITH A DRIVE-THROUGH WINDOW BY LARRY R. KNOPP - CUP-O4-020 - Page I 6. RECOMMENDATION The Meridian Planning and Zoning Commission hereby recommends to the City Council of the City of Meridian that they approve the requested Conditional Use Permit as requested by the Applicant for the property described in the application, subject to the following: A. Adopt the Recommendations of the Planning and Zoning and Engineering staff as follows, with a comment from the Commission that many of the required conditions have been addressed in the site/landscape plan provided by the applicant with a revision date of August 2, '04, received by the city clerk August 5, 2004: PLANNING & ZONING / PUBLIC WORKS 1. All surface parking shall conform to the minimum dimensions per ordinance of 9' x 19' with 25' wide drive aisles. 2. The landscaping is approved with the following modifications: . The row of parking north of the phannacy drive through has a narrow planter on the west end. The planter must be widened to be at least 5 feet wide inside curbs and add a tree to the planter. . The row of parking east of the building has a narrow planter on the north end. The planter must be widened to be at least 5 feet wide inside curds and add a tree to the planter. Also add a tree to the planter on the south end of the parking row. . The street buffer along Cherry Lane requires 4 trees; two trees are currently shown. Add two more. . The buffer between land uses must comply with the approved Alternative Compliance established with the final plat for Lynwood Plaza. 3. This conditional use permit shall be subject to the expiration provisions set forth in MCC 11-17-4.B. 4. Applicant must comply with the conditions of the plat for Lynwood Plaza. 5. All exterior lighting, whether attached to the building or located within the parking lot, shall be down-shielded or otherwise altered so that the light does not spill over onto adjacent properties or right-of-way. All parking lot lighting shall be in accordance with Ordinance 11-13-4C. All signage shall be in accordance with the standards set forth in Section 11-14 of the City Zoning and Development Ordinance. All signage is subject to design review and shall require separate permits. RECOMMENDATION TO CITY COUNCIL OF APPROVAL OF CONDITIONAL USE PERMIT FOR A PHARMACY WITH A DRIVE-THROUGH WINDOW BY LARRY R. KNOPP - CUP-O4-020 - Page 2 12. 7. All construction and site improvements shall conform to the requirements of the Americans with Disabilities Act and the adopted building and fire codes. 8. A drainage plan designed by a State of Idaho licensed architect or engineer is required and shall be submitted to the City Engineer (Ord. 557, 10-1-91) for all off-street parking areas. Storm water treatment and disposal must be designed in accordance with Department of Environmental Quality 1997 publication Catalog of Storm Water Best Management Practices for Idaho Cities and Counties and City of Meridian standards and policies. Off-site disposal into surface water is prohibited unless the jurisdiction that has authority over the receiving stream provides written authorization prior to development plan approval. The applicant is responsible for filing all necessary applications with the Idaho Department of Water Resources regarding Shallow Injection Wells. 9. All required improvements must be complete prior to obtaining a Certificate of Occupancy for the proposed development. A temporary Certificate of Occupancy may be obtained by providing surety to the City in the form of a letter of credit or cash in the amount of 110% of the cost of the required improvements (including paving, striping, landscaping, and irrigation). A bid must accompany any request for temporary occupancy. 10. Sanitary sewer and water service shall be via existing service lines to be installed as part ofthe Lynwood Plaza project. 11. Underground year-round pressurized irrigation must be provided (from an existing system) to all landscape areas on this site. Submit 10 copies of a revised site and landscape plan to the City Clerk's office at least 10 days prior to the next public hearing on this application. FIRE DEPARTMENT 1. Acceptance of the water supply for fire protection will be by the Meridian Water Department. 2. Final Approval of the fire hydrant locations shall be by the Meridian Fire Department. a. Fire Hydrants shall have the 4 W' outlet face the main street or parking lot aisle. b. The Fire hydrant shall not face a street which does not have addresses on it. c. Fire hydrant markers shall be provided per Public Works spec. d. Locations with fire hydrants shall have the curb painted red 10' to each side of the hydrant location. e. Fire Hydrants shall be placed on corners. f. Fire hydrants shall not have any vertical obstructions to outlets within 10'. The phasing plan may require that any roadway greater than 150' in length that is not provided with an outlet shall be required to have an approved turn around. 4. All entrance and internal roads shall have a turning radius of 28' inside and 48' outside radius. 5. Provide a 20' wide Fire Lane for all internal & external roadways. 6. Insure that all yet undeveloped parcels are maintained free of combustible vegetation. 7. Operational fire hydrants and temporary or permanent street signs are required before combustible construction begins. 8. Building setbacks shall be per the Building Code for one and two story construction. 9. The roadways shall be built to Ada County Highway Standards and shall have a clear driving surface, available at all times, which is 20' wide. Streets with less than a 29' street width shall have no parking. Streets with less than 33' shall have parking only on one side. 10. Commercial and office occupancies will require a fire-flow consistent with the International Fire Code to service the proposed project. Fire hydrants shall be placed an average of300' apart. 11. The fire department requests that any future signalization installed as the result of the development of this project be equipped with Opticom Sensors to ensure a safe and efficient response by fife and emergency medical service vehicles. This cost of this installation is to be borne by the developer 12. Maintain a separation of 5' from the building to the dumpster enclosure. 13. Provide a Knoxbox entry system for the complex. 14. Paint the curb red at all fire lanes and provide signage "No Parking Fire Lane". 15. The first digit of the Apartment/Office Suite shall correspond to the floor level. 16. All portions of the buildings located on this project must be within 150' of a paved surface. POLICE DEPARTMENT: 1. The Police Department has no concerns related to the site design submitted with the application. RECOMMENDATION TO CITY COUNCIL OF APPROVAL OF CONDITIONAL USE PERMIT FOR A PHARMACY WITH A DRIVE-THROUGH WINDOW BY LARRY R. KNOPP - CUP-O4-020 - Page 4 SANITARY SERVICES CORP.: 1. Waste enclosure dimensions: Prior to issuance of a certificate of zoning compliance, the applicant shall provide a site plan that has a minimum of 10ft. clearance inside of the enclosure gates with the gates in the open position. 2. The applicant shall verify that the trash enclosures will be approved by NMID in the location depicted on the plans submitted with the application. 3. Please contact Bill Gregory at SSC (888-3999) for detailed review of your proposal and submit stamped (approved) plans with your certificate of zoning compliance application. PARKS DEPARTMENT: 1. Connect the project to the micropath stub from Devlin Place Subdivision when the building in the northeast corner develops. B. Adopt the Recommendations of ACHD as follows: 1. Comply with the conditions of approval for MPP03-013/MCZC03-036, Lynwood Plaza Subdivision C. Adopt the Recommendations of Nampa Meridian Irrigation District as follows: 1. Applicant shall apply for a land use change application prior to final platting. 2. All laterals and waste ways must be protected. 3. The District's Rutledge Lateral courses through the proposed project. This easement must be protected and any encroachment without a signed License Agreement and approved plan, before any construction is started, is unacceptable. 4. All municipal surface drainage must be retained on site. If any surface drainage leaves the site, the Nampa & Meridian Irrigation District must review drainage plans. 5. The Developer must comply with Idaho Code 31-3805. 6. NMID recommends that irrigation water be made available to all developments within the Nampa & Meridian Irrigation District.
