Summary of Public Hearings:
. At the August 5th meeting, the Commission discussion primarily focused on access to
Eagle Road, traffic flow/patterns and cut-through, the locations of stub streets and
driveways, landscape buffers, fencing, consistency with the approved annexation and
zoning application/development agreement and timing of the development.
. Bob Unger, representing the applicant, presented testimony in favor of the application.
. There were four people that testified on the proposed development: David Thurston,
Steve Grant, Greg Eagy, and Linda Morris. Concerns about the subject development
primarily focused on the proposed transitional use/buffer to the west, compatibility with
the single-family residences to the west, cut-through traffic, a lack of a master plan for
the whole Ustick Road/Eagle Road intersection, effects on property values in the area,
and the future of the users ditch to the south. Testimony was also provided regarding
landscaping and fencing on the site.
Key Commission Changes to Staff Recommendation:
. The Commission's recommendation for the proposed Conditional Use Permit (CUP-
04-023) to the Citv Council is for denial. The Commission recommended denial
because the concurrent Preliminary Plat (PP-04-021) was denied at the August 5th
hearing, and because the subject development is premature due to outstanding issues
that need to be resolved both with ITD and with the neighboring parcels.
Outstanding Issues for City Council:
. As noted above, the Planning & Zoning Commission denied the associated Preliminary
Plat (PP-04-02I). The applicant has appealed this decision of the Commission to the City
Council. The appeal application will be heard prior to the public hearing for the subject
Conditional Use Permit.

RECOMMENDATION TO CITY
COUNCIL
The property is approximately 10.05 acres in size and is located on the west side
of Eagle Road, approximately 600-feet south of Ustick Road, within Section 5,
Township 3 North, Range I East.

Janet Ruwe is the current property owner, who has provided notarized consent for
the subject application.

The applicant is FOLlO, Inc., represented by Bob Unger.

The subject property is currently zoned CoG. The zoning of CoG is defined within
the City of Meridian Zoning and Development Ordinance Section 11-7-2.
The applicant requests the Conditional Use Permit for a Planned Development
which includes detailed approval of thirty (30) multi-family buildings, each
building containing four (4) units, and conceptual approval of seven (7)
commercial pad sites. The Planned Residential Development desigoation within
the City of Meridian Zoning and Development Ordinance requires a Conditional
Use Permit be obtained for most uses including those requested by the Applicant.

The multi-family use proposed which is the subject of this will, in fact, constitute
a conditional use as determined by City policy.
The Planning & Zoning Commission recogoized the concerns of David Thurston,
Steve Grant, Greg Eagy, and Linda Morris, who verbally testified at the public
hearing.

RECOMMENDATION
The Meridian Planning and Zoning Commission hereby recommends to the City
Council of the City of Meridian that they deny the applicant's request for Conditional
Use Permit approval for a Planned Development on the property described in the
application, based on the following:
. The concurrent Preliminary Plat application (pP-04-021) was denied and
therefore, the subject Conditional Use Permit is not appropriate.
. The subject development is premature at this time and there are
outstanding issues that need to be resolved both with ITD and with the
neighboring parcels.
