To prevent and treat disease and disability; to promote healthy lifestyles; and to protect mrd promote the health and quality of our environment.
STORMWATER MANAGEMENT RECOMMENDATIONS
We recommend that stormwater be pretreated through a grassy swale prior to
discharge to the subsurface to prevent impact to groundwater and surface water
quality. The engineers and architects involved with the design of this project
should obtain current best management practices for stormwater disposal and
design a stormwater management system that is preventing groundwater and
surface water degradation. Manuals that could be used for guidance are:
1) State Of Idaho Catalog Of Stormwater Best Management Practices For
Idaho Cities And Counties Prepared by the Idaho Division Of
Environmental Quality, July 1997.
2) Stormwater Best Management Practices Guidebook. Prepared by City Of
Boise Public Works Department, January 1997.

The Nampa & Meridian Irrigation District requires that a Land Use Change/Site Development
application be filed for review prior to final platting. Contact Donna Moore at 466-7861 for
further information.
All laterals and wasteways must be protected. All municipal surface drainage must be retained
on site. If any surface drainage leaves the site, the Nampa & Meridian Irrigation District must
review drainage plans. The developer must comply with Idaho Code 31-3805. It is
recommended that irrigation water be made available to all developments within the Nampa &
Meridian Irrigation District.

Subject: 549341 Whitestone Estates No. 3 Subdivision Preliminary Plat Approval
Dear City Council:
On behalf of Whitestone Development Company,' L.L.C., ,we are requesting approval of the Preliminary
Plat of Whitestone Estates No. 3 Subdivision which occupies 1.66 acres in the W 1/2 of the E 1/2, Section
14, T.3N., R.1W., B.M., Meridian, Ada County, Idaho.
Meridian School District has purchased the parcel of land lying between the Kennedy Lateral and Waltman
Street. This parcel of land was proposed for single-family housing with the Whitestone Preliminary Plat
approved several years ago. The purpose of this application is to reconfigure the seven lots remaining after
the Meridian School District purchase. This development proposes single-family housing in an existing R-
4 zone. The property is bounded on the North by West Pintail Drive, on the south by the Kennedy Lateral,
on the west by unplatted ground and on the east by Van Hees Subdivision. The proposed seven lots will
tike access from South Whitestone Way, West Pintail Drive and South Lodestone Avenue., All R-4 zone
lots are 8,000 square feet or larger.
We are proposing to vacate the portion of South Whitestone Avenue lying south of West Pintail Drive.
South Whitestone Avenue is proposed to be reconfigured in a knuckle cul-de =sac. configuration.. The
vacation application will be submitted to Ada County Highway District upon approval of this prelirliinary
plat application. All existing utilities located in the vacated portion of South Whitestone Avenue will be
relocated to the north. Curb, gutter and sidewalk will enclose the south end of South Lodestone Avenue to
complete this street.
We are not requesting any special considerations for setbacks or lot frontage requirements.
The roadways, curbs, gutters and sidewalks of this development will be constructed in accordance with
Ada County Highway District's standards and Meridian's city ordinance. All sidewalks will be five feet
wide.
The proposed use is in conformance -,ith Meridian's Comprehensive Plan and complies with Meridian's
ordinances.
There are no existing wells and septic systems in this development. The houses in this development will be
connected to Meridian's sewer and water systems. All lots will have access to a pressurized irrigation
system. The irrigation system will be owned and maintained by the Nampa & Meridian Irrigation District.

This report pertains to soil physical properties and internal soil drainage conditions found
on the Whitestone Estates Subdivision No. 2, Ada County, Idaho. Test holes were examined and
logged at three locations where retention ponds will be placed. Field notes for the test holes and
a plat map showing the approximate location of each are attached.
Test Hole No. 1 (THl) currently has free water (water table) at a 44" depth. There are no
mottled or gleyed colors above a 48" depth. At this time, (mid -irrigation season), the water table
is at or near its peak elevation and it is not anticipated to rise much, or any higher.
Test Hole No. 2 (TH2) currently has free water (water table) at a 56" depth. There are no
mottled or gleyed colors above a 42" depth. At this time, (mid -irrigation season), the water table
is at or near its peak elevation and it is not anticipated to rise much, or any higher.
Test Hole No. 3 (TH3) currently has free water (water table) at a 74" depth. There are no
mottled or gleyed colors above a 58" depth. At this time, (mid -irrigation season), the water table
is at or near its peak elevation and it is not anticipated to rise much, or any higher.

Gigray: I think to be consistent, that's a good observation. That could be "of'.
Rountree: Okay. I have this dated 10/19. That's the only question I had on the format
of it.
Gigray: Mr. Mayor I didn't know whether or not Councilman Rountree just wanted a little
explanation as to the format.
Rountree: I think that would be helpful. It's self explanatory other than the last page
didn't seem to be consistent with the first pages and they are now.
Gigray: The idea of this obviously with the Order of Decision is that there is a based on
your Findings of Fact and Conclusions of Law and what you've been doing and for the
cause you find. We've pull this off as a Order of Decision and as a conditional use
permit and then it can be retrofitted just so that when the conditional use permit is out

Jacobs: As you remember from last time, I sent a letter requesting this hearing
be continued to this date. At that time, ACHD had made a request that we
weren't prepared to deal with at that time. On September 2"d we met with two
ACHD's representatives, Meridian P & Z representative, my client and a
representative from the school district. ACHD had requested that the turn around
or the way we had designed the street intersection at the south west corner of
the subdivision would be changed to reflect how we designed them. The other
intersection at the south east corner. So at that meeting, we worked out the
details of that particular intersection and the plat you have reflects that. The
utilities that we intend to have the public utilities within the public street. Move
that manhole that is outside of that public right-of-way and that corner and put
that within the street five feet off of the lip of gutter and also move the fire hydrant

and put the fire hydrant where it should be and trunk it in the public utilities within
the public street. There would be two services that we would extend through that
25 foot, which is emergency access, which will be paved to the school property to
the south, where we can extend water through there and a sewer connection for
the school property, then the two lots that are there 11 and 12 we will have to
adjust the utilities to serve those lots. One of the lots is a platted lot, which my
client has retained the ownership on and we will include that in this plat to
accommodate this change. To accomplish this, we've had to reduce the frontage
on the two lots 11 and 12, to 30 feet from 40 feet, to provide that 25 foot wide
access to the school property, we've had to make that reduction, so we are
requesting that consideration. The school will own that 25 foot of access,
emergency access. We will need to have the school district, the Ada County
Highway District, and my client to sign on this plat as owners of the property.
There is some ACHD right-of-way which will be exchanged during the process of
this plat and since they are owners of part of that property, they will need to sign
the plat so we can get it recorded. Do you have any other questions?

Borup: This is strictly emergency access from the school. They are going to
have a break way post in there.
Jacobs: That is my understanding, yes. The school district does not desire a
public access to that property other than pedestrian access.
Borup: Any comments on the ACHD report about the design of the—I believe
they said they wanted a hammerhead, or a knuckle.
Jacobs: A knuckle similar to what we had proposed on the southeast corner of
this project. So we've replicated that on the southwest corner. They have not
formally approved this. Larry Sale was here tonight, I appreciate his efforts to try
and stay long enough to assist me in this application, he has indicated that the
highway district does not have a problem with this proposal.
Borup: It's clear now, I tried to differentiate between the knuckle and the snoopy.
The snoopy was a new term.

request to the Nampa/Meridian Irrigation District to tile the (Inaudible) lateral. It is
my understanding that they will do that this fall (Inaudible).

MacCoy: Is there anything from the public and I don't see any of the public out

Freckleton: Staff, members of the commission. I just want to make one little
point of clarification, on the utilities that would be extended down that common
lot, it's my intention to extend the public main down that common lot and
eventually loop that public main through the school site and back out to Waltman.
So that I can complete the loop. I've got a ten inch main off of Linder Road, that I
want to loop all the way out. So that would be a mainline, not just a service line.
The only other thing that I was thinking of as far as preliminary engineering on
getting sewer service to the school site, can you do that with a service line Keith,
or can you—or do you run out of grade? Does it need to be a main line?
Jacobs: I'm not sure whether that needs to be a mainline, the school is in the
process of designing that particular property for an elementary school. "I don't
know what their design is. If we can extend just a six and serve the property, that
would be what our intent would be, however, I would coordinate that with them to
provide whatever they need, obviously. That's the only way they can get service
without a lift station and that's not a desirable option, so we would make that and
present that information to public works at that time. I'm sure the school would
not have a problem with looping that water through their property. I can't speak
for them on that behalf, but I would think that would be reasonable thing at least
for fire protection if nothing else to have a back fed Linder, on the south side.

feet (Inaudible). Is it four or five feet? Four feet, that parking area is 32 feet
deep off of the alley and it is 32 feet wide. There is 5.9 feet on the east side of
the garage. Now, in my application, it showed work storage that is a functioning
two car garage and consequently with the area we have at present and with a
two car garage, we meet six. We are not looking at heavy duty parking, we're
talking about a bridal boutique and upstairs residents. The upstairs residents will
use the garage and it is the same people that have the downstairs. Any other

On October 7, 1998, the Commissioners of the Ada County Highway District (hereafter called
"District") took action on the Preliminary Plat as stated on the attached staff report. .
In order that the Final Plat may be considered by the District for acceptance, the Developer shall
cause the following applicable standard conditions to be satisfied prior to District certification
and endorsement:
Drainage plans shall be submitted and subject to review and approval by the
District.
2. If public street improvements are required: Prior to any construction within the
existing or proposed public right-of-way, the following shall be submitted and
subject to review and approval by the District:
a. Three complete sets of detailed street construction drawings prepared by
an Idaho Registered Professional Engineer, together with payment of plan
review fee.
b. Execute and Inspection Agreement between the Developer and the District
together with initial payment deposit for inspection and/or testing services.
C. Complete all street improvements to the satisfaction of the District, or
execute Surety Agreement between the Developer and the District to
guarantee the completion of construction of all street improvements.

Preliminary Plat - Whitestone Estates # 3/MPP-10-98 w/o Linder s/o Franklin Rd
Whitestone Estates # 3 is an 8 -lot residential subdivision on 1.66 -acres. The site is located 660 -feet west
of Linder Road and approximately 1/4 mile south of Franklin Road. This development is estimated to
generate 70 additional vehicle trips per day based on the Institute of Transportation Engineers Trip
Generation manual.
On June 26, 1996, the Commission reviewed and approved the preliminary plat for Whitestone
Subdivision, a 145 -lot residential subdivision on 42 -acres. The subject application is proposed as the
final phase of that subdivision. Originally, the applicant planned to extend the streets and the subdivision
south to Waltman Street, which is south of the Kennedy Lateral. However, the applicant has sold off the
southern portion of the site to the Meridian School District and is not planning to develop the southern
half of the subdivision.
This application was deferred from the August 26, 1998, Commission meeting as requested by the
applicant so that the applicant and staff could work on a solution for a knuckle at the intersection of
Pintail Drive and Lodestone Avenue. District staff, Meridian staff, the applicant and a representative of
the Meridian School District have met and a solution has been reached. The following report reflects
that solution.

Lodestone Avenue and Whitestone Way south over the Kennedy Lateral to connect with
Waltman Street. The applicant has since sold the property south of the Kennedy Lateral to the
Meridian School District; therefore, the applicant is not proposing to extend these roadways
across the Kennedy Lateral (see attached map). Staff supports the applicant's proposal to not
extend Lodestone Avenue and Whitestone Way south of the Kennedy Lateral, because the
roadways will not serve any other parcels other than the school site, and the Meridian School
District has stated that they do not want the streets extended to their site. The applicant will be
constructing an emergency access that can be used by pedestrians from Lodestone Avenue to
the northern boundary of the school site, between Lot 9, Block 7, and Lot 11, Block 7, of the
proposed subdivision.
D. On August 26, 1998, the applicant proposed to terminate the south end of Lodestone Avenue
with a rounded stub street, that extended approximately 70 -feet south of Pintail Drive, because
the restrictions caused by the right-of-way and lot lines dedicated through Whitestone Estates
#2. The subject application proposed to utilize the stub as a snoopy turnaround. This is not an
acceptable location for that type of turnaround. Staff was concerned that vehicles using the

Standard Requirements:
1. A request for modification, variance or waiver of any requirement or policy outlined herein
shall be made in writing to the ACHD Planning and Development Supervisor. The request
Shall specifically identify each requirement to be reconsidered and include a written explanation
of why such a requirement would result in a substantial hardshi or r inequity. The written
request shall be submitted to the District no later than 9:00 a.m. on the day scheduled for
ACHD Commission action. Those items shall be rescheduled for discussion with the
Commission on the next available meeting agenda.
Requests submitted to the District after 9:00 a.m. on the day scheduled for Commission action
do not provide sufficient time for District staff to remove the item from the consent agenda and
report to the Commission regarding the requested modification, variance or waiver. Those
items will be acted on by the Commission unless removed from the agenda by the Commission.
2. After ACHD Commission action, any request for reconsideration of the Commission's action
shall be made in writing to the Planning and Development Supervisor within two weeks of the
action and shall include a minimum fee of $110.00. The request for reconsideration shall
specifically identify each requirement to be reconsidered and include written documentation of
data that was not available to the Commission at the time of its original decision. The request
for reconsideration will be heard by the District Commission at the next regular meeting of the
Commission. If the Commission agrees to reconsider the action, the applicant will be notified
of the date and time of the Commission meeting at which the reconsideration will be heard.
Payment of applicable road impact fees are required prior to building construction in
accordance with Ordinance #188, also known as Ada County Highway District Road Impact
Fee Ordinance.
4. All design and construction shall be in accordance with the Ada County Highway District
Policy Manual, ISPWC Standards and approved supplements, Construction Services
procedures and all applicable ACHD Ordinances unless specifically waived herein.
5. The applicant shall submit revised plans for staff approval, prior to issuance of building permit
(or other required permits), which incorporates any required design changes.
6. Construction, use and property development shall be in conformance with all applicable
requirements of the Ada County Highway District prior to District approval for occupancy.
7. No change in the terms and conditions of this approval shall be valid unless they are in writing
and signed by the applicant or the applicant's authorized representative and an authorized
representative of the Ada County Highway District. The burden shall be upon the applicant to
obtain written confirmation of any change from the Ada County Highway District.
8. Any change by the applicant in the planned use of the property which is the subject of this
application, shall require the applicant to comply with all rules, regulations, ordinances, plans,

original preliminary plat and now, the School District has purchased approximately 12
acres south of the Kennedy Lateral which required us to modify the existing preliminary
plat which you have in front of you to fill in the remaining two acres there on the north
side of the Kennedy Lateral. Pin Tail Drive has been improved for the most part.
Utilities and services are in, however, we did require to reconfigure basically the corners
of the project to accommodate for the new turn around that ACHD require prior to this
with the old preliminary plat. They were to extend to the south. So we've reconfigured
the corner lots to accommodate the new turn arounds. Again it's a pretty straight
forward project. The services are in. There is a 25 foot pedestrian access easement
there on the westerly side of the property which the school district requested for access
to the school once it's built. I'd happy to answer any questions if you have any.

MacCoy: Is there anything from the public and I don't see any of the public out
here that is interested. Staff, do you have any comments?
Freckleton: Staff, members of the commission. I just want to make one little
point of clarification, on the utilities that would be extended down that common
lot, it's my intention to extend the public main down that common lot and
eventually loop that public main through the school site and back out to Waltman.
So that I can complete the loop. I've got a ten inch main off of Linder Road, that I
want to loop all the way out. So that would be a mainline, not just a service line.
The only other thing that I was thinking of as far as preliminary engineering on
getting sewer service to the school site, can you do that with a service line Keith,
or can you—or do you run out of grade? Does it need to be a main line?
Jacobs: I'm not sure whether that needs to be a mainline, the school is in the
process of designing that particular property for an elementary school. -I don't
know what their design is. If we can extend just a six and serve the property, that
would be what our intent would be, however, I would coordinate that with them to
provide whatever they need, obviously. That's the only way they can get service
without a lift station and that's not a desirable option, so we would make that and
present that information to public works at that time. I'm sure the school would
not have a problem with looping that water through their property. I can't speak
for them on that behalf, but I would think that would be reasonable thing at least
for fire protection if nothing else to have a back fed Linder, on the south side.

Johnson: Across the back, we have an 80 foot lot. We allotted for the parking—
for the planter five feet on the west side and I think it's four—is that correct, four
feet (Inaudible). Is it four or five feet? Four feet, that parking area is 32 feet
deep off of the alley and it is 32 feet wide. There is 5.9 feet on the east side of
the garage. Now, in my application, it showed work storage that is a functioning
two car garage and consequently with the area we have at present and with a
two car garage, we meet six. We are not looking at heavy duty parking, we
talking about a bridal boutique and upstairs residents. The upstairs residents will
use the garage and it is the same people that have the downstairs. Any other
questions?

Prior: Sir, just to expedite matters, if you would like, you could talk about the
conditional use permit and when the time comes up for the preliminary plat,
rather than adding any additional information if you would just like to request that
it be incorporated into your testimony as part of the preliminary plat. You could
do it all under one shot then and we could save a little time if you would like.
Unger: That's fine and I do request that.
Prior: You can do it at the time when we open on the preliminary plat. Thank
you.
Unger: Mr. Chairman, commissioners, I will try to make this short. First of all, we
have received approval from Ada County engineer for the name which would be
O'Hara Townhouse Subdivision, instead of Terra. This project is an existing,
there is two existing four-plexes with car ports and storage sheds. What we're
requesting is to take the four-plexes and subdivide them into zero lot line
townhouses. The zoning on the property is currently R-15 and we're not asking
for any change to that. Why the—our client is asking to do this is of course, to be
able to see the individual townhouses. We currently have existing services to the
site and to the units. One of the conditions of approval will require that we do
have individual utilities including sewer and water. That will be accomplished as
part of our construction on the area. Land uses in the area are apartments and
duplexes and apartments and the zoning in the area is R-15. It's kind of small,
you could see the area over here. Lot number nine is a common lot for the
homeowners and it's for their use and also they would be maintaining it and we
have provided covenants for the use and maintenance which was in you're
packets. The areas that we have in gray are sidewalks and the driveway parking
areas. The green is all lawn and landscaping. This is all existing. We are also
required to provide a per ACHD to provide a cross access agreement and that is
being provided for use of the driveway in the parking areas. Since this is an
existing facility, there will be no new impact on the surrounding area, streets or
services. We feel that since the individual units will be under individual
ownership, there probably be less impact on the area, as far as maintenance of

Whitestone Estates is a 7 -lot residential subdivision on 1.66 -acres. The site is located west of
Linder Road, south of Franklin Road. This development is estimated. to generate 70 additional
vehicle trips per day based on the Institute of Transportation Engineers Trip Generation manual.
On June 26, 1996, the Commission reviewed and approved the preliminary plat for Whitestone
Subdivision, a 145 -lot residential subdivision on 42-acres..The subject application is proposed as
the final phase of that subdivision. Originally, the applicant planned to extend the streets and the
subdivision south to Waltman Street, or south of the Kennedy Lateral. However, the applicant
has sold off the southern portion of the site to the Meridian School District and is not planning to
develop the southern half of the subdivision.

C. In the original approval for Whitestone Estates Subdivision, the applicant proposed to extend
Lodestone Avenue and Whitestone Way south over the Kennedy Lateral to connect with
Walkman Lane. The applicant has since sold the property south of the Kennedy Lateral to the
Meridian School District, therefore, the applicant is not proposing to extend those roadways
across the Kennedy Lateral (see attached map). Staff supports the applicant's proposal to not
extend Lodestone Avenue and Whitestone Way south of the Kennedy Lateral, because the
roadways will not serve any other parcels other than the school site and Meridian School
District has expressed that they do not want the streets extended to their site. The applicant is
proposing to extend a paved pedestrian pathway from Lodestone Avenue to the northern
boundary of the school site, between Lot 8, Block 5, and Lot 9, Block 7, of the proposed
subdivision. Staff supports the location of the proposed pedestrian pathway.
D. The applicant is proposing a "snoopy" turnaround at the south end of Lodestone Avenue. Staff
is concerned that vehicles using the turnaround will be backing into the traffic of either
Lodestone Avenue or Pintail Drive. Staff recommends that the applicant be required to
construct a "knuckle" instead of the proposed "snoopy" turnaround that is proposed. The

report to the Commission regarding the requested modification, variance or waiver. Those
items will be acted on by the Commission unless removed from the agenda by the Commission.
2. After ACHD Commission action, any request for reconsideration of the Commission's action
shall be made in writing to the Planning and Development Supervisor within two weeks of the
action and shall include a minimum fee of $110.00. The request for reconsideration shall
specifically identify each requirement to be reconsidered and include written documentation of
data that was not available to the Commission at the time of its ''original decision. The request
for reconsideration will be heard by the District Commission 'at the next regular meeting of the
Commission. If the Commission agrees to reconsider the action, the applicant will be notified
of the date and time of the Commission meeting at which the reconsideration will be heard.
3. Payment of applicable road impact fees are required prior to building construction in
accordance with Ordinance #1.88, also known as Ada County Highway District Road Impact
Fee Ordinance.
4. All design and construction shall be in accordance with the Ada County Highway District
Policy Manual, ISPWC Standards and approved supplements, Construction Services procedures
and all applicable ACHD Ordinances unless specifically waived herein.
5. The applicant.shall submit'revised plans for staff approval, prior to issuance of building permit
(or other required permits), which incorporates any required design changes.
6. Construction, use and property development shall be in conformance with all applicable
requirements of the Ada County Highway District prior to District approval for occupancy.
7. No change in the terms and conditions of this approval shall be valid lidless they are in writing
and signed by the applicant or the applicant's authorized representative and an authorized
representative of the Ada County Highway District. The burden shall be upon the applicant to
obtain written confirmation of any change from the Ada County Highway District.
Any change by the applicant in the planned use of the property which is the subject of this
application, shall require the applicant to comply with all rules, regulations, ordinances, plans,
or other regulatory and legal restrictions in force at the time the applicant or its successors in
interest advises the Highway District of its intent to change the planned use of the subject
property unless a waiver/variance of said requirements or other legal relief is granted pursuant
to the law in effect at the time the change in use is sought.

meeting. Onbehalf of the owners, I respectfully request a'variance for the reduced frontagos
of Lots 11 and 12 from 40 feet to 30 feet.
This revised plat is the results of a September 2, 1998 meeting at the Meridian Planning
-Department with Mr. Brad Hawkins -Clark, Ms, Karen Gallagher and Mrs. Steve Arnold with
Ada County Highway District, Mr. Jim Carberry with Joint School District No. 2, Mr. Larry
Van Hees who is the developer and me. At that meeting we discussed the Ada County
Highway District (ACRD) request for a bulb street treatment rather than the turn -a -round,
proposed on the preliminary plat dated July 16, 1998, The District will not approve the turn -
a -round proposed on the preliminary plat:
With that mind, PLS revised the street and lot lines to reflect ACHD's requested changes.
The lot sizes are 8,000 square feet or greater. Lots 11 and 12, 'have public street frontages
which are 30 feet. The school site emergency access is 25 feet wide.
To accommodate this revised plat the following items need to be done.The existing utilities
will need to be relocated to accommodate this proposed change. The City will need to grant
a variance for the lot frontages on Lots 11 and 12. The frontage's have been reduced from 40
feet to 30 feet. The School District and ACRD will need to sign the final, plat as owners to
allow adjustment of the emergency access location and street right-of-way boundary.

We have reviewed this submittal and offer the following comments, as conditions of the application.
These conditions shall be considered in full, unless expressly modified or deleted by motion of the
Meridian City Council:
GENERAL COMMENTS
1. Any existing irrigation/drainage ditches crossing the property to be included in this project,
shall be tiled per City Ordinance 11-9-605.M. Plans will need to be approved by the
appropriate irrigation/drainage district, or lateral users association, with written confirmation
of said approval submitted to the Public Works Department.
2. Any existing domestic wells and/or septic systems within this project will have to be removed
from their domestic service per City Ordinance Section 5-7-517. Wells may be used for non-
domestic purposes such as landscape irrigation.
3. Provide five -foot -wide sidewalks in accordance with City Ordinance Section 11-9-606.B.
4. Submit a letter from the Ada County Street Name Committee, approving the subdivision and
street names. Make any corrections necessary to conform.
5. Coordinate fire hydrant placement with the Meridian Public Works Department.
6. If possible, respond in writing to each of the comments contained in this memorandum by
12:00 noon, August 11, 1998. Submit ten copies of the Preliminary Plat Map with any
required revisions to the City Clerk's Office a minimum of one week prior to the hearing by
the Meridian City Council.
SITE SPECIFIC COMMENTS
1. Sanitary sewer and water service to this site are more or less existing. Some service locations
will need to be relocated as a result of the re -design.

2. One -hundred -watt, high-pressure sodium streetlights will be required at locations designated
by the Public Works Department. All streetlights shall be installed at subdivider's expense.
3. Lot 8, Block 5 doesn't meet the minimum frontage of thirty feet (30') required for a flag lot
per Ordinance 557, 10\1\91. The easterly lot line shall be adjusted to the west to allow a
minimum of five feet (5') between the sewer main and the lot line. The westerly line of Lot
9, Block 7 may also be shifted to the west to maintain an overall common area width of
twenty-five feet (25'). The common lot shall be owned and maintained by the Whitestone
Estates Homeowners Association, with a blanket easement for pedestrian access, and public
utilities. The developer shall be required to install fencing on both sides of the common lot,
and a minimum of twelve foot (12') wide paved pedestrian pathway. Bollards shall also be
installed at the north end of the pedestrian path to prevent vehicular traffic from accessing the
future school site. The existing sewer and water mains shall be extended through the common
lot to the future school site
4. Construct six -foot -high, permanent, non-combustible perimeter fencing except where the City
has expressly agreed, in writing, that such fencing is not necessary. Fencing is to be in place
prior to applying for building permits.
5. A development agreement is required for this project, as a condition of annexation of the
property.
6. Please explain your proposal for the tiling of the Kennedy Lateral. The preliminary plat map
indicates that the existing design is to be constructed in the winter of 1998-99.
