1. The applicant is the Yick Yee Family Company, a general partnership, c / o
Boyd Yee, Managing Partner, 1811 Mace Road, Eagle, Idaho 83616. Phone

2. The present owner of the subject property is Schrandt Family Limited
Partnership, c / o Dick Schrandt, 3303 E. Linden, Caldwell, Idaho 83605.

3. Legal Description is enclosed.
4. Proof of ownership of subject property (warranty deed) and notarized
consent of property owner is enclosed.
5. The parcel is vacant awaiting development.
6. There is no present use of the property.
7. The proposed use of the property is to be a theme type sit down
restaurant of approximately 3,000 sq. Ft. With 41 parking spaces.
8. The subject property has a present zoning of CG.
9. Thirty copies of a vicinity map of a scale of one inch equals three
hundred feet (1H=300') are enclosed.
10. Characteristics of the subject property which make conditional use
desirable are:
a. Restaurants are allowed with the present zoning
b. New construction will be done with the high grade materials and
accepted construction techniques which will complement the new
construction at the corners of Fairview Ave. & Locust Grove Street.
c. The restaurant will provide Meridian residents an alternative to
restaurant visits in Boise.
d. The restaurant will add to the tax base for Meridian, Idaho, and provide
employment opportunities for Meridian residents.
11. The City ofMeridian will provide a list of mailing addresses of all
property ownersI(from authentic tax records of Ada . County) who are within
three hundred feet of the external boundaries of the land being considered,
and a list of all owners within the area being considered for a conditional
use.
12. The applicant (Yick Yee Family Company) will pay the Conditional Use
Application fee of $275.00 + $1.67 each for certified mailings for each
property owner listed within 300 ft. Total Fee:

and the Laws of the State of Idaho, that the Planning and Zoning Commission of the
City of Meridian will hold a public hearing at the Meridian City Hall, 33 East Idaho
Street, Meridian, Idaho, at the hour of 7:00 p.m., on October 14, 1997, for the purpose
of reviewing and considering the Application of Yick Yee Family Co., for a Conditional
Use Permit for land located in a portion of Lots 14 and 15 of Pleasant Valley
Subdivision, NW %, NW %, Section 8, T.3N, R.1 E, Boise Meridian, Ada County, Idaho,
and which property is generally located at the SE corner of Fairview Avenue and
Locust Grove. The Application requests a Conditional Use Permit for a theme type sit
down restaurant.
A more particular legal description of the above property is on file in the City
Clerk's office at Meridian City Hall, 33 East Idaho Street, and is available for inspection
during regular business hours.

The plans for Wingers Restaurant have gone through the preliminary
review process by the Water Superintendent, John P. Anderson, and
it appears that all drainage will remain on site and that there are
no Nampa & Meridian Irrigation District facilities on site.
Because of this, we are returning $500.00 of the fees you submitted
for the Land Use Change Application. Enclosed please find money
order #6403003483 in the amount of $500.00.
According to Mr. Anderson, if the above -referenced project is
constructed according to the plans received, it does not appear
that it will impact the Nampa & Meridian Irrigation District's
operation.

Yee: My name is Boyd Yee and 1 am representing the Yick Yee Family Co. I have been
through the Planning and Zoning review and so forth and I guess we are here tonight to
ask the City Council for a conditional use permit to build this theme type restaurant that
is called Wingers.
Corrie: Council any questions of Mr. Yee?
Rountree: I see you brought a menu did you bring some samples?
Yee: I brought a picture of the restaurant (inaudible) Obviously there was some
previous discussion about signs and whether we missed it through Planning and Zoning
review or whatever 1 guess I am also what are the possibilities of getting a pile on sign
for the restaurant. I have brought some pictures of some signs that are existing. Here is
one in (inaudible) and this is some signs that were in (inaudible) the sign that is on the
building. 1 brought some blue prints along that showed some dimensions and so forth.

Johnson: I will now open the public hearing and ask the applicant or the applicant's
representative Boyd Yee to address the Commission at this time.
Boyd Yee, 1811 Mace Road, Eagle, was sworn by the City Attorney.
Yee: Well I think you have the package that I brought in, there was some elevations
and some pictures and there was the application. In the mean time we have reviewed
the comments from the engineers and the planning director and so forth. We don't have
any issue with any of the comments that have been provided. Last Friday I met with the
tech committee at the Ada County Highway District. They were not privy with this
drawing so the only comments that they had on their tech review was that this driveway
be 225 feet from Locust Grove which it is that there be 50 feet back up from the parking
lot entering Fairview which there is.. (Inaudible) there is a signed cross parking

Johnson: Thank you Mr. Yee, questions from the Commissioners?
MacCoy: I will start off, is your establishment a chain?
Yee: It is a relatively new franchise started about 3 or 4 years ago. There is one just
finished in Pocatello, there is one being built in Idaho Falls now and I think there are ten
of them operating in Utah and Arizona. By next year I understand the folks that are
franchising these will have another 15 on board.
MacCoy: I recognized the name that is the reason I was wondering. It says here, just
curious here, is that American food or are you going to have all kinds of food?
Yee: Well the name of the restaurant the franchise is called Wingers and their featured
item are buffalo wings either as an appetizer or as a meal entree or as a combination
with ribs or as a combination with barbecued chicken and some sandwiches and pasta
dishes.
MacCoy: Since you have a chain, is your building construction (inaudible) is it is a
standard, it is a terminology we use in the business anyway. Is it one that you are
following a path in somebody else's place.
Yee: Right, obviously when we bought the franchise they also supply you with a
(inaudible) drawings and so forth. What we are building is actually a prototype which
basically if you look at the elevations depending on how you face the building it could be
a north or south elevation for the entry east and west and the backs and so forth are
always the way depending on how you site the building.
MacCoy: What is your construction?
Yee: It will be stick frame, it has kind of, it looks like a trolley car with kind of a unique
entry way. The outside is drivet is has some nice furnishings on the inside. Did you see
some pictures?
MacCoy: Yes I did, I noticed your ceiling in the place is (inaudible) and your floor
probably was picked the same way.
Yee: This design is approximately a little over 3000 square foot. The people that
franchise this, their intent was to build a restaurant that would work for secondary sites
or smaller communities. The thought in mind for the square footage and the
construction so forth was that you wouldn't have to pay an arm and a leg like you do in
Boise to build a restaurant. I think conceptually what they are trying to do really fits well
for the town of Meridian.
MacCoy: You ! iave said here this evening and I guess you get the feel that we are
concerned even though we don't make that decision that we are concerned about

have been able to come into this project and into Wilson Lane off of Locust Grove. It
hasn't been a serious of situation of providing an adequate service to the properties that
are developing. When the properties to the east of D & B develop there will need to be
loop of water line come back out to Fairview and then we get back into Fairview again
as far as the supply corridor. I dont think it is a serious situation at all with this project
with Wingers.
Borup: Well I wouldn't think so with their proximity to Locust Grove, I was just looking at
the overall future development. I was more somewhat curious about he had mentioned
that in others too.
Yee: Well when you bring it up it is kind of a comment that ACHD made too. They are a
little reluctant. I think Fairview is one of those roads that has been paved within the last
five years and I have talked to Intermountain Gas and they have said that they don't
have the ability to cut into Fairview but they would find (inaudible) they don't think that
ACHD is going to let them cut into Fairview. So you may have the same problem here in
trying to run a water line if you are outside the easement of cutting into Fairview.
Borup: That was my thought also.
Johnson: Anyone else?
Smith: Mr. Chairman, I don't mean to be nit picky but I am going to be anyway. The
pictures show kind of a corner entry and what the plan depicts is a center entry building.
(Inaudible) But we are not going to have a ramp with railings?
Yee: No, I think that was because when they shot the 'elevations and so forth and for
Mr. MacCoy's benefit I think that was an ADA standard that they had to ramp up for
wheel chairs because of the elevation of the building. It was (inaudible) this will not be
ramped up.
Smith: Towards the top at the parapet, this is all drivet?
Yee: No I think that is the white tile.
Smith: I would like to see actual elevations with heights and materials called out on
them being submitted for the City Council when they review it.
Yee: Are they on the elevations that I submitted?
Smith: All we have is this picture,

Smith: Then, regarding the sign, your comment about coming from the east, west on
Fairview and being able to see a sign and pull into this driveway. There is an island or a
barrier there that would prevent you from turning left into this drive. So you would have
to go up to Locust Grove and turn south on Locust Grove anyway and come in from the
rear. But I think just the nature of the way the building was designed, the sign on the
building is a very predominant element. It looks like to me if these doors, you assume
these doors are (inaudible) five feet tall. I think a pole mounted sign or even a
monument sign would be fighting this sign on the building and I- don't even know that
you would want to spend the money to build another sign. I think this is really all the
signage you need. It is pretty predominant. It is a predominant piece of the architecture
of the building. I think the materials and the architecture is going to be complimentary to
what is being done over at the video store with the colors and so forth so they will work
well together. One thing I would suggest is extending your sidewalk out to the sidewalk
along Fairview. If somebody is walking up and down the sidewalk or somebody comes
over from across the street and sees Wingers over at Fred Meyer they cross Fairview
they really don't have any sidewalk access to get to you building. They are going to
have to come down the drive, through the parking lot or across your landscape berm.
Yee: That is not going to be a problem, we would be more than happy to do that.
Smith: I would suggest maybe looking at that. What is the material indicated between
the parking lot and building where it says service area? How is that area going to be
treated?
Yee: That is going to be a sidewalk.
Smith: That is all concrete all the way around.
Yee: You can see our trash area we are going to try to hide it with (inaudible) the trash
enclosure should be the same construction of the building. We envisioned hiding the
garage with landscaping, you can see little areas for trash.
Smith: Well just how those things get banged around you probably want to build 'those
out of masonry and then you would be stuccoing that to match.
Yee: We kind of envisioned having like two of those little trash enclosures on wheels
and then they are ramped down on this service area. So we physically have to pull them
down and pull them down the ramp and then the truck picks them up and (inaudible).
Smith: I am not sure I am familiar with that you are referring to. That is the extent of my
comments. It is unfortunate that we didn't have the elevations and the floor plans that
were submitted.

Flashing signs and temporary signs will not be permitted. All signs are subject to review and
approval of the Planning & Zoning Department. Sign permits are to be obtained prior to
construction. Upon three days' notice to any tenant, the City of Meridian may remove any
unauthorized signage.
8. Screened trash enclosures are to be provided in accordance with City Ordinance. Coordinate
dumpster site locations with the City's solid waste contractor, Sanitary Services, Inc. Locate
dumpsters so as not to impede fire access.
9. All driveway and parking areas shall be paved, with all driveway accesses approved by the

SITE SPECIFIC COMMENTS
Sanitary sewer service to this site will be via a main line extension from the sewer mains
installed in Locust Grove Road. The treatment capacity of the Meridian Wastewater
Treatment Plant is currently being evaluated. Approval of this application needs to be
contingent upon our ability to accept the additional sanitary sewage generated by this
proposed development. The project designer is to coordinate main sizing and routing with
the Meridian Public Works Department.
2. Water service for this development shall be off of an extension of an existing water main in
Locust Grove Road. Water service to this development is contingent upon positive results
from a hydraulic analysis by our computer model. The project designer is to coordinate sizing
and routing with the Meridian Public Works Department. The water mains and fire hydrants
shall be installed by the developer and then dedicated to the City for ownership and
maintenance.
3. Provide parking lot lighting plans to the Meridian Public Works Department. Illumination of
the site shall be designed to not cause glare or adversely impact neighboring residential
properties or the traveling public, as determined by the City of Meridian.
4. All landscaping is to meet the requirements of Ordinance Section 11-2-414.D.2. With
pavement area shown, a total of 12 three-inch caliper trees are required. Applicant is also
responsible to relocate/replace trees removed from D&B's site on the eastern edge of the
proposed restaurant site. Detailed landscape plans will be reviewed during the building permit
approval process. A minimum 25 -foot landscape setback is required on Fairview Avenue
beyond required right-of-way.

FINDINGS OF FACT AND CONCLUSIONS OF LAW
The above entitled matter having come on for public hearing on
October 14, 1997, at the hour of 7:00 o'clock p.m., the Applicant,
appearing through its representative, Boyd Yee, the Planning and
Zoning Commission of the City of Meridian having duly considered
the evidence and the matter makes the following Findings of Fact
and Conclusions of Law.
FINDINGS OF FACT
1. A notice of a public hearing on the application for the
conditional use permit and application for annexation and zoning
was published for two (2) consecutive weeks prior to said public
hearing scheduled on October 14, 1997, the first publication of
which was fifteen (15) days prior to said hearing; that the matter
was duly considered at the October 14, 1997 hearing; that the
public was given full opportunity to express comments and submit
evidence; and that copies of all notices were available to
newspaper, radio and television stations.
2. The property is located within the City of Meridian at
the Southeast corner of Fairview Avenue and Locust Grove. The

property is described in the application for a conditional use
permit, which description is incorporated herein as if set forth in
full. The Applicant is not the owner of record of the property.
The record owner of the property is Schrandt Family Limited
Partnership, c/o Dick Schrandt, and he has consented to the
application for the conditional use permit.
3. Pursuant to the application, the property is presently
zoned as CG, General Retail and Service Commercial, and is vacant.
The proposed use of the property is to construct and operate a
theme type sit down family restaurant of approximately 3,000 square
feet with 41 parking spaces. The Applicant presented a site plan
depicting the location of the proposed use. Further, pursuant to
the application, the Applicant agrees to pay any additional sewer,
water or trash fees or charges, if any, associated with the use,
whether that use be residential, commercial or industrial.
4. Boyd Yee, representative for the Applicant, testified
substantially as follows at the public hearing. His partnership
intends to build a restaurant named Wingers at the location. The
Applicant has no problem with any of the staff comments or the
comments of ACRD, and will do all it can to comply with the
comments,�conditions, and ordinances of Meridian.
5. In response to questions by Commissioner MacCoy, Mr. Yee
testified substantially as follows. His establishment is a
relatively new franchise which started about 3-4 years ago. There
is one in Idaho Falls, one in Pocatello, and 10 in Utah and

Arizona. There will be primarily American food, featuring buffalo
wings, ribs, barbecued chicken, sandwiches, and pasta dishes. The
building will appear as it does in the submitted illustration, it
will be a stick frame building with an appearance similar to a
trolley car. The restaurant is a little over 3,000 square feet.
A pole sign is preferred, and would be done well with muted colors,
but a monument sign could be done also. With the turn barricade in
Fairview at the corner of Fairview and Locust Grove, the concern is
that customers won't see the sign if it is low to the ground until
they have passed. The Applicant will fully comply with all ADA,
lighting, and other requirements and conditions.
6. Commissioner Borup commented that the building is very
attractive and right up next to the road, how was that decided? In
response, Mr. Yee stated that the restaurant has such a facade on
it, they wanted it close to the road so everyone could see it.
Commissioner Borup then commented that the restaurant really will
not need any signage in addition to the front, which is
predominant.
7. Commissioner Borup then asked City Engineer Gary Smith if
the staff comments regarding the water line coming in from Locust
Grove are different than the Water Department which said the water
line would come in from Fairview. Engineer Smith replied that the
eventual goal is to have waterlines on both sides of Fairview as
development spreads along the south side of Fairview. However,
there shouldn't be a problem with bringing the water line in from

Locust Grove for this project.
8. Commissioner Smith commented that he would like to see
actual elevations with heights and materials. Mr. Yee replied that
the Applicant has submitted the elevations and floor plan.
Commissioner Smith further commented that the building is
predominant enough that no additional signage is really needed.
Also, a sidewalk should be constructed through the berm to allow
pedestrians easier access to the front of the building.
In
response to additional questions 4y Commissioner Smith, Mr. Yee
testified substantially as follows. There will be a sidewalk
between the parking lot and building for the service area, the
trash will be hidden by an enclosure constructed of the same
materials as the building, and the trash enclosures will be on
wheels to be ramped down to the service area.
9. Bill Geyer, representative for the Schrandt Family
partnership, testified substantially as follows. He does not
understand the Water Department's comments regarding the water line
from Fairview Avenue and is concerned as to whether that will be a
requirement of the development. Commissioner Borup responded that
he believes it is something the Department would like to see
someday, but not a requirement at this time. City Engineer Smith
responded that the water line does not have to be put in from
Fairview unless the Applicant.would like to. Mr. Geyer further
testified that the Schrandt Family partnership has been involved
with the property at issue for 3 1/2 to 4 years, and has borne the

financial burden of finding the perfect Applicant for that parcel.
They believe this Applicant is the perfect business and hope that
the plan will be acceptable and will be approved because it will be
a great use for the City.,

comments, which respective comments are incorporated herein as if
set forth in full.
11. The Meridian Fire Department, Meridian Police Department,
Meridian Sewer Department, Meridian Water Department,

District Health Department and Nampa & Meridian Irrigation District
submitted comments, which respective comments are incorporated

12. There was no further testimony given at the hearing.
CONCLUSIONS OF LAW
1. All the procedural requirements of the Local Planning Act
and of the Ordinances of the City of Meridian have been met,
including the mailing of notice to owners of property within 300
feet of the external boundaries of the property.
2. The City of Meridian has authority to grant conditional
uses pursuant to Idaho Code Section 67-6512 and pursuant to 11-2-
418 of the Zoning And Development Ordinance of the City of
Meridian.
3. The City has the authority to take judicial notice of its

5. In the ZONING SCHEDULE OF USE CONTROL, Section 11-2-409
B., Commercial, Restaurants are listed as a permissive use in the
CG District, and therefore, do not require a conditional use
permit. However, when this parcel of land was annexed, as a
condition of the annexation it was provided that "any use or
development of the property shall only be allowed as a conditional
use with design review." See City of Meridian Ordinance No. 677,
incorporating the conditions of annexation contained in the
Findings of Fact and Conclusions of Law.

7. That the City of Meridian Comprehensive Plan, under LAND
USE, Mixed -Use Area and Locust Grove Road and Fairview Avenue, in
5.16U, states that all development requests will be subject to
development review and conditional use permit processing to insure
neighborhood compatibility.
8. Therefore, under the conditions of the prior annexation
of this parcel of land, and by the authority of the City of
Meridian under the Comprehensive Plan, a conditional use permit is
required for Applicant to operate a restaurant on this parcel of
land.
9. Conditional Use Permit is defined in the Zoning And
Development Ordinance, City of Meridian, Idaho as "Permits allowing
an exception to the uses authorized by this Ordinance in a zoning
district."
10. The City of Meridian has authority to place conditions on
a conditional use permit and the use of the property pursuant to
Idaho Code Section 67-6512 and pursuant to that section conditions
minimizing the adverse impact on other development, controlling the
duration of development, assuring the development is maintained
properly, and on-site or off-site facilities may be attached to the
permit; that 11-2-418 (D) authorizes the City to prescribe a set
time period for which a conditional use may be in existence.

Zoning And Development Ordinance of the City of Meridian and upon

Idaho Code, the Comprehensive Plan of the City of Meridian, and the
record submitted to it and the things of which it may take judicial
notice.
13. Section 11-2-418 C of the Zoning And Development
Ordinance of the City of Meridian sets forth the standards under
which the Planning and Zoning Commission and the City Council shall
review applications for Conditional Use Permits. Upon a review of
those requirements and a review of the facts presented and the
conditions of the area, assuming that the above conditions or
similar ones thereto would be attached to the conditional use, the
Planning and Zoning Commission concludes as follows:
a. The use, would in fact, constitute a conditional use
and a conditional use permit would be required by
ordinance;
b. The use would be harmonious with and in accordance
with the Comprehensive Plan but the prior annexation of
the land was conditioned upon a review of each proposed
use and requires a conditional use permit to allow the

use;
c. The use is designed and is to be constructed to be
harmonious in appearance with the character of the
general vicinity; that if the conditions set forth herein
are complied with the use should be operated and
maintained to be harmonious with the intended character
of the general vicinity and should not change the
essential character of the area;
d. The use would not be hazardous nor should it be
disturbing to existing or future neighboring uses if the
conditions are met;
e.. Sewer and water service is available, but the
Applicant may have to pay additional fees for the use;
f. The use would not create excessive additional
requirements at public cost for public facilities and
services and the use would not be detrimental to the
economic welfare of the community;
g. If the conditions are met, the use should not
involve a use, activity, process, material, equipment or
conditions of operation that would be detrimental to
person, property or the general welfare by reason of
excessive production of traffic, noise, smoke, fumes,
glare or odors;
h. The use will have vehicular approaches to the
property which shall be so designed as not to create an
interference with traffic on surrounding public streets;
and
i. The development of the property will not result in
the destruction, loss or damage of a natural or scenic
feature of major importance.
14. As conditions may be placed upon the granting of a
conditional use permit to minimize adverse impact on other
development, it is recommended by the Planning and Zoning
Commission that the following conditions of granting the
conditional use be required, to wit:

DECISION AND RECOMMENDATION
The Meridian Planning and Zoning Commission hereby recommends
to the City Council of the City of Meridian that it approve the
Conditional Use Permit requested by the Applicant for the property
described in the Application with the conditions set forth in the
Findings of Fact and Conclusions of Law or similar conditions as
found justified and appropriate by the City Council and that the
property be required to meet the water and sewer requirements, the
Fire and Life Safety Codes, Uniform Fire Code, parking
requirements, and the paving and landscaping requirements, and all
Ordinances of the City of Meridian. The conditional use should be
subject to review upon notice to the Applicant by the City.

B. On August 27, 1997, the Commission reviewed and approved a conditional use, MCU -21-
97, for a 7,488 -square foot video store, abutting this site's west boundary. As a condition of
approval, the applicant of that parcel was required to construct a 24 to 30 -foot wide driveway
with 15 -foot radii pavement tapers on Fairview Avenue, located 225 -feet east of Locust
Grove Road (measure from near edge of the driveway to the future back of curb of Locust
Grove Road). District staff recommends that the applicant for this site be required to share a
driveway on Fairview Avenue, located in the previously approved location approximately
225 -feet east of Locust Grove Road. If the previously approved driveway has not been
constructed, the applicant will be required to construct it.
The applicant should provide a minimum of 50 -feet of on-site stacking at the driveway for
both the inbound and outbound travel lanes; stacking distance shall be defined as the distance
between the future back of curb of Fairview Avenue to near edge of any internal driveway.
Coordinate the stacking distance of the driveway with District staff.

3. Provide a recorded cross access easement to the parcels to the east, west, and south to use

Requests submitted to the District after 9:00 a.m. on the day scheduled for Commission
action do not provide sufficient time for District staff to remove the item from the consent
agenda and report to the Commission regarding the requested modification, variance or
waiver. Those items will be acted on by the Commission unless removed from the agenda
by the Commission.
2. After ACHD Commission action, any request for reconsideration of the Commission's action
shall be made in writing to the Development Services Supervisor within two weeks of the
action and shall include a minimum fee of $110.00. The request for reconsideration shall
specifically identify each requirement to be reconsidered and include written documentation
of data that was not available to the Commission at the time of its original decision The
request for reconsideration will be heard by the District Commission at the next regular
meeting of the Commission. If the Commission agrees to reconsider the action, the applicant
will be notified of the date and time of the Commission meeting at which the reconsideration
will be heard.

The Meridian Water Department recommends that a 8" or 10" water main be installed on the South side of E.
Fairview Ave. for Domestic and Fire use. With fire hydrants and meter locations on E. Fairview South side.
This water main could connect to the water main that Meridian Fence is going to install, also with the retail
shopping plaza that is being planned now. Meridian Fire approves of this also.

B. On August 27, 1997, the Commission reviewed and approved a conditional use, MCU -21-
97, for a 7,488 -square foot video store, abutting this site's west boundary. As a condition of
approval, the applicant of that parcel was required to construct a 24 to 30 -foot wide driveway
