Characteristics of the property which prevent compliance with the ordinance: The Ridenbaugh Canal far exceeds the 48 -inch pipe size set forth by the city as a size limitation for tiling a canal. Four blocks exceed the maximum block length of 1,000 feet. The unusual configuration of the parcel limits the lot layout alternatives and creates longer block lengths. The block lengths are excessive due to the Ridenbaugh Canal which abuts the west and north 980204Wariance-app boundary of the parcel. One Micro -Path and a vehicular bridge have been provided to break the block length along the Ridenbaugh Canal. The City Ordinance (Section 9-605c) states that Micro - Paths should be used where long blocks exist. We believe providing pedestrian lineage reduces the block length. 13. Section 9-605M Piping of Ditches "...all irrigation ditches, laterals or canals, exclusive of natural waterways, shall be covered and enclosed with tiling ... the city may waive this requirement for covering such ditches, laterals, or canals if it finds that the public purpose requiring such will not be served in the individual case..." Section 9-605E Blocks: " Every block shall be designed... no more than one thousand feet (1,000') in length." 14, 15 & 16 Hardship: It would be impossible to pipe the Ridenbaugh Canal because of the size of the facility. The unusual configuration of the property inhibits compliance with the maximum block length. The adjoining canal and configuration of the parcel creates a natural hindrance for compliance. The addition of stub streets for block length reduction would serve no purpose with the Ridenbaugh Canal along the exterior and in some cases would create a duplication. 17. Development of the property would be prohibited if all ditches were required to be piped and no flexibility on block length was allowed. 18. The existing canal and configuration of the property are not a result of actions by the applicant. 19. The granting of these variances does no imply special privilege to the applicant since similar variances have been granted on other projects with the same topographic characteristics. 20. The Variance request is confined to standards within the Zoning Ordinance and not addressed in the Comprehensive Plan. 21. Fee attached. 22. The variances requested are not out of convenience but from necessity. Obviously the piping of the Ridenbaugh Canal is cost prohibitive. Corrie: Council there was a request made to the developer to include lot number 58 in block 4 part of the school park site. I guess Becky would you like to address that and tell us what the developer has approved? Bowcutt: Mayor Corrie contacted me and asked me to go back to the developer and see if he would consider the elimination of this lot 58 located right here along the future elementary site. I did meet with the developer, discussed it with him, urged him to go ahead and eliminate that lot because it would improve the access to the school lot which from what I'm hearing the feedback from the school district, that's what's going to happen with that parcel. He has agreed to eliminate lot 58 as a residential lot and merge that lot into the school site which would increase that acreage. I believe it's lot 58, block 4 so we'd like to include that in the record. The other issue I discussed with Mayor Corrie after Council adopted the Findings, two weeks ago the Hanson's meet with me outside and were questioning the lot numbers that were entered into part of the record as part of the Findings. I believe it said lot 21 through lot 14, block 14. Their question to me was is there any way to change that. They would like to see lots 22 through 16 and their reasoning there was their home sits back further on their parcel. And they though the affect of lot 22 was far greater than the affects of the lots further to the south and they said would you please talk to the developer and we'd be willing to forego lot 13 and — I think it 13 and 14. Corrie: 14, 15. Bowcutt: 14 and 15, excuse me. Forego lot 14 and 15 if you would take it clear up to lot 22,which is the last lot that backs up to them. Their home sits right in this vicinity here and their concern is (Inaudible) 14 and 15 are of no consequence but lot 22 we feel is problematic. As you turn the bend then these lots (inaudible) backing up and facing the northern direction. Mayor Corrie said he did receive a letter from them. They reference some different lots. I think they went to 24, but I believe they were going off the old plan, which we renumbered when we made the staffs changes. REcE1VED AUG 2 8 1998 BEFORE THE MERIDIAN CITY COUNCIL CITY OF MERIDIAN APPLICATION OF FARWEST DEVELOPERS AND MARTY GOLD; FOR A VARIANCE TO EXCEED THE MAXIMUM BLOCK LENGTH OF 1000 FEET AND A VARIANCE FROM PIPING THE RIDENBAUGH CANAL FINDINGS OF FACT AND CONCLUSIONS The above entitled variance request having come on for consideration on August 4, 1998, at approximately 7:30 o'clock p.m. on said date, at the Meridian City Hall, 33 East Idaho Street, Meridian, Idaho, and the City Council having heard and taken oral and written testimony, the City Council of the City of Meridian makes the following: FINDINGS OF FACT 1. That notice of the public hearing on the variance was published for two consecutive weeks prior to the scheduled hearing for August 4, 1998 the first publication of which was fifteen (15) days prior to said hearing; that the matter was duly considered at the August 4, 1998, hearing; that copies of all notices were available to newspaper, radio and television stations. 2. That notice of public hearing is required to be sent to property owners within 300 feet of the external boundaries of the land being considered pursuant to 11-2-416 E., 11-2-419 D., and 11-9-612'B. 1.b. of the Revised and Compiled Ordinances of the City of Meridian; that this requirement has been met. 3. The entire property in question is described in the application and is incorporated herein as if set forth in full. 7. That at the public hearing, the Applicant's representative testified that proposed Thousand Springs development has 4 blocks that exceed the maximum block length of 1000 feet per Meridian City Ordinance. She also noted that she would like a variance from having to pipe the Ridenbaugh canal. 7. That the City Engineer, Planning and Zoning Administrator did not submit comments. Nampa Meridian Irrigation had no comment on the project. 8. There was no other testimony at the hearing. CONCLUSIONS 1. That all the procedural requirements of the Local Planning Act and of the Ordinances of the City of Meridian have been met including the mailing of notice to owners of property within 300 feet of the external boundaries of the Applicant's property. 2. That the City has authority to grant variances pursuant to Section 11-2-419 of the Zoning Ordinance and pursuant to FINDINGS OF FACT & CONCLUSIONS OF LAW - PAGE 2 Section 11-9-612 of the Development Ordinances. 3. That the City Council has judged this application by the guidelines, standards, criteria, and policies contained in the Subdivision and Development Ordinance and upon the record submitted to it and the things upon which it may take judicial notice. 4. That the Council may take judicial notice of its own proceedings, those of the Planning and Zoning Commission, governmental statutes, ordinances, and policies, and of actual conditions existing within the City and the State. 5. That the following provision of Section 11-9-612 A. 1., of the'Subdivision and Development Ordinance is noted which is pertinent to the Application: 11-9-612 A. 1. PURPOSE The Council, as a result of unique circumstances (such as topographic - physical limitations or a planned unit development), may grant variances from the provisions of this Ordinance on a finding that undue hardship results from the strict compliance with specific provisions or requirements of the Ordinance or that application of such provision or requirement is impracticable. 7. That the specific requirements regarding a variance that must be evidenced and found by the City Council are as follows: No variance shall be favorably acted upon by the Council unless there is a finding, as a result of a public hearing, that all of the following exist: a. That there are such special circumstances or conditions affecting the property that the strict application of the provisions of this Ordinance would clearly be FINDINGS OF FACT & CONCLUSIONS OF LAW - PAGE 3 impracticable or unreasonable; in such cases, the subdivider shall first state his reasons in writing as to the specific provision or requirement involved; b. We've got this block here obviously exceeds it. We've broken it up with this micro path. It comes up to here. We broke it here with a vehicular connection across the Ridenbaugh. Then we've got this block that runs around like that. We have a pedestrian connection. I'd like to remind you in your ordinance under pedestrian walkways, it recommends them in the middle along blocks where necessary to obtain convenient pedestrian circulation. So we have attempted with our micro paths to break up the block length. Anytime we have a subdivision adjoining a large canal that wraps around it, we always have problems with block lengths. I believe we requested a variance on four blocks. One was this one. We have one here. This one here we took care of that by shooting this street through which staff recommended to take the waterline out to the well lot, and then this is like a thousand eight ten approximately. It's just barely over 1,000. It's kind of hard to measure on the curb. So we're asking for a variance of this, this and this block here, and then obviously a variance to pipe the Ridenbaugh Canal since it exceeds a 48 inch. Do you have any questions? We feel under the ordinance that these are conditions that we didn't create, and so we feel that we do qualify for hardship. It's not a privilege treatment of the property. Thanks. As long as there are fire hydrants down through there that we could on to if we had to some where along the line. Rountree: Shari, any issue with the variance? The request on the canal is I believe consistent with what we've done in the past on these larger drainage canal systems. That's why it's a little late, but if Findings are prepared, it could be acted on for the August 18th, but I have no problem with the variance. Bentley: I have a question for Becky. The Chief brought up the fire hydrants. They are all in place? Bowcutt: Yes, we meet all the hydrant requirements with a hydrant what — every four or five hundred feet. Yes.
