At the July IS, 2004 hearing, testimony was provided by the following people: Staff testified on the proposed applications. Mike Wardle and Joe Canning, representatives for the developer, testified in favor of the subject applications. 2 neighboring property owners testified regarding concerns about potential impacts of the proposed development Key Commission Changes to Staff Recommendation: . The Commission made no modifications to the conditions included in the staff report. Outstanding Issues for City Council: Neighborhood Center: Meridian's Comprehensive Plan has designated a Mixed-Use Neighborhood Center on the west side of Locust Grove Road halfway between McMillan Road and Ustick Road. The Comprehensive Plan states that only ten acres of non-residential uses may be permitted for each Mixed-Use Neighborhood Center. Currently there are 11.21 acres of nonresidential uses which have been approved for the Locust Grove Neighborhood Center. Heritage Commons has 3.8 acres of commercial uses which were approved as a use exception and Razzberry Subdivision has 3.31 acres of L-a zoning. Brockton Subdivision was approved at the July 13, 2004 City Council hearing for 4.1 acres of nonresidential uses. NOTE: The applicant has submitted copies of a revised landscape plan depicting minor modifications to the landscape plan and detailed plans for proposed open space area amenities. Staff is supportive of the revised plans. BEFORE THE PLANNING AND ZONING COMMISSION IN THE MATTER OF THE ) REQUEST FOR ANNEXATION & ) ZONING OF 9.8 ACRES TO R-8 AND ) CoN ZONES FOR A PLANNED ) DEVELOPMENT ) ) ) ) Case No. AZ-O4-011 RECOMMENDATION TO CITY COUNCIL Lonnie Johnson, Applicant 1. The property is approximately 9.8 acres in size and is located on Locust Grove Road, approximately \l2mile south of the southwest intersection of McMillan Road and Locust Grove Road, Meridian. The property is designated as Mixed Use- Neighborhood. 2. The owners of record of the subject property are Lonnie and Karen Johnson. 3. Applicant is Lonnie Johnson. 4. The subject property is currently zoned RUT and consists ofan existing single family home. s. The Applicant requests the property be zoned as CoN and R-8 . 6. The subject property is bordered to the north by L-a zoning, to the south by R-R zoning, to the east by R-4 zoning, and to the west by R-4 zoning. 7. The property which is the subject of this application is within the Area of Impact of the City of Meridian. 8. The entire parcel of the property is included within the Meridian Urban Service Planning Area as defined in the Meridian Comprehensive Plan. 9. The Applicant proposes to develop the subject property in the following manner: as a residential and commercial planned development 10. The Applicant requests zoning of the subject real property as CoN and R-8 which is consistent with the Meridian Comprehensive Plan Future Land Use Map which designates the subject property as Mixed-Use Neighborhood. 11. There are no significant or scenic features of major importance that affect the consideration of this application. RECOMMENDATION TO CITY COUNCIL FOR APPROVAL OF REZONE FOR Alexandria Subdivision, RZ-O4-011 Page 1 RECOMMENDATION The Meridian Planning and Zoning Commission hereby recommends to the City Council of the City of Meridian that they approve the requested Annexation and Zoning as requested by the applicant for the property described in the application, subject to the following: A. Adopt the Recommendations of the Meridian Planning & Zoning Department as follows: 1. The legal description submitted with the application appears to meet the requirements of the City of Meridian and State Tax Commission and places the parcel contiguous to existing city limits. 2. The requested zoning designations of R-8 and CoN are compatible with the City Comprehensive Plan and Meridian's Zoning Ordinance. 3. The subject property is within the Urban Service Planning Area. Essential City services are available to the subject property. 4. Any existing domestic wells and/or septic systems within this project will have to be removed from their domestic service per City Ordinance Section 5-7-517. Wells may be used for non-domestic purposes such as landscape irrigation. S. The applicant has requested the following reductions for setbacks, lot sizes, and lot frontages: Setbacks- Citv Requirements (R-8) Rear: 15' Street side: 20' Proposed Setbacks Rear: 10' Street side: 12' Lot Size- Citv ReQuirements R-8 zone: 6,500 sq. ft.
