This letter is to confirm the Director approved your request for alternative compliance to Unified
Development Code (UDC) 11 -3B -12C for the subject property based on the required Findings
listed in UDC 11 -5B -5E, as follows:
1. Strict adherence or application of the requirements are not feasible; or
Due to the Irrigation District not allowing landscaping within their easement for the
Ridenbaugh Canal and the final plat already having been approved by City Council,
the Director f nds that strict adherence to the pathway landscaping requirements is
not feasible as the easement encompasses all of the common lot where the pathway is
located.
2. The alternative compliance provides an equal or superior means for meeting the
requirements; and
The applicant proposes to provide the required trees (I deciduous tree per 35 linear
feet in accord with preliminary plat condition #1.2.6) within the rear yard of the
adjacent building lots rather than in the common area where the pathway is located.
Although not a preferred option, Stafffeels this is an acceptable means far meeting
the requirement.
3. The alternative means will not be materially detrimental to, the public welfare or
impair the intended uses and character of surrounding properties.
The Director finds the alternative means of compliance with UDC 11 -3B -12C will not
be materially detrimental to the public welfare of impair the intended uses and
character ofsurrounding properties. However, because there is a platted 10 foot
wide PUDI (public utilities, drainage and irrigation) easement along the rear
property lines of the building lots where the trees are proposed, the trees shall be
located at the exterior edge of the easement.

The Applicant, Director, or a Party of Record may request City Council review of a decision of
the Director. All requests for review shall be filed in writing with the Planning Division of the
Community Development Department on or before November 15, 2016, within fifteen (15) days
after the written decision is issued, and contain the information listed in UDC 11 -5A -6B.
If City Council review of the decision is not requested, the action of the Director represents a
final decision on a land use application. You have the right to request a regulatory taking
analysis under Idaho Code 67-8003.
