FP-04-048 ORDER OF CONDITIONAL APPROVAL OF FINAL PLAT This matter coming before the City Council for Final Plat approval pursuant to Meridian City Code § 12-3-7 on August 3, 2004, and the Council finding that the Administrative Review is complete from Sonya Allen, Assistant City Planner for the Planning and Zoning Department, and Bruce Freckleton, Engineering Technician 1Il for the Public Works Department, dated: Hearing Date: August 3, 2004, to the Mayor and Council, and the Council having considered the requirements of the preliminary plat the Council takes the following action: IT IS HEREBY ORDERED THAT: 1. The Final Plat of"PLA T SHOWING SOUTHS TONE SUBDIVISION LOCATED IN NW % OF THE SW % T.3N., R. lE., SECTION 21., BOISE MERIDIAN, MERIDIAN, ADA COUNTY, IDAHO 2004, HANDWRITTEN DATE: 06/29/04, ORDER OF CONDITIONAL APPROVAL OF FINAL PLAT FOR SOUTHS TONE SUBDIVISION / (FP-O4-048) Page 1 of4 PINNACLE ENGINEERS, INC , Evans Construction Management, Developer, is Conditionally Approved subject to those conditions of Staff comments as set forth in the Memorandum to the Mayor and City Council from Sonya Allen Assistant City Planner for the Planning and Zoning Department and Bruce Freckleton, Engineering Technician III for the Public Works Department, dated: Hearing Date: August 3, 2004, listing 17 SITE SPECIFIC REQUIREMENTS/FINAL PLAT and 10 GENERAL REQUIREMENTS, a true and correct copy of which is attached hereto marked Exhibit "A", and consisting of 4 pages, and by this reference incorporated herein, and by this reference incorporated herein, and the response letter from Pinnacle Engineers, Inc. , a true and correct copy of which is attached hereto marked Exhibit "B" and consisting of I page, and by this reference incorporated herein, and the additional requirements from the action of the Council taken at their August 3, 2004 meeting as follows, to-wit: 1.1 Adopt the Recommendation of the Central District Health Department as follows: The Central District Health requires after written approval from the appropriate entities are submitted, they can approve this proposal for central sewage and central water; that plans must be submitted to and approved by the Idaho Department of Health and Welfare, Division of Environmental Quality for central sewage and central water; that run-off is not to create a mosquito breeding problem; and it is suggested that the stonnwater be pretreated through a grassy swale prior to discharge to the subsurface to prevent impact to groundwater and surface water quality; that engineers and architects should ORDER OF CONDmONAL APPROVAL OF FINAL PLAT FOR SOUTHSTONE SUBDIVISION 1 (FP-O4-048) Page 2 of 4 obtain current best management practices for stonnwater disposal and design a stonnwater management system that is preventing groundwater and surface water degradation. Manuals for guidance: 1. State of Idaho Catalog of Stonnwater Best Management Practices for Idaho Cities and Counties. Prepared by the Idaho Division of Environmental Quality, July 1997. 2. Stonnwater Best Management Practices Guidebook. Prepared by City of Boise Public Works Department, May 2000. 2. The final plat upon which there is contained the Certification and signature of the City Clerk and the City Engineer verifYing that the plat meets the City's requirements shall be signed only at such time as: 1. The Plat dimensions are approved by the City Engineer; and 2. The City Engineer has verified that all off-site improvements are completed and/or the appropriate letter of credit or cash has been issued guaranteeing the completion of off-site and required on-site improvements. NOTICE OF FINAL ACTION AND RIGHT TO REGULATORY TAKINGS ANALYSIS The Applicant is hereby notified that pursuant to Idaho Code 67-8003, the Owner may request a regulatory taking analysis. Such request must be in writing, and must be filed with the City Clerk not more than twenty-eight (28) days after the final decision concerning the matter at issue. A request for a regulatory takings analysis will toll the time period within which a Petition for Judicial Review may be filed. Request for Final Plat Approval of Eight (8) Building Lots on 3.06 Acres in an L-O Zone for Southstone Subdivision, by Pinnacle Engineers, Inc. (File No. FP-O4-048) We have reviewed the above-referenced submittal and offer the following comments, as conditions of approval. These conditions shall be considered in full, unless expressly modified or deleted by motion of the Meridian City Council: APPLICATION SUMMARY & LOCATION The applicant, Pinnacle Engineers, Inc., has requested approval for Southstone Subdivision, located on the north-east corner of Eagle Road and Girdner Lane, in the SW Y40f Section 21, T.3N., R.1E. This subdivision includes 8 commercial office building lots on 3.06 acres of land in an L-O zone. The submitted final plat substantially complies with the approved preliminary plat. Staff recommends approval of the fmal plat for Southstone Subdivision with the comments and conditions stated in this report. SITE SPECIFIC REOUIREMENTS 1. Applicant is to meet all terms of the approved Annexation (AZ-04-006) and preliminary plat (PP-04-008). 2. Sanitary sewer service to this development shall be via an extension from mains installed with Sutherland Farm Subdivision. Subdivision designer to coordinate main sizing and routing with the Public Works Department. Applicant shall execute City of Meridian standard fonn of easements, for any mains that are required to provide service. Municipal water service to this development shall be via an extension from mains installed adjacent to this property. Applicant will be responsible to construct the water mains to and through this proposed development, thereby making them available to adjacent properties. Subdivision designer to coordinate main sizing and routing with the Public Works Department. Applicant shall execute City of Meridian standard fonn of easements, for any mains that are required to provide service. Applicant shall be required to pay Public Works development plan review, and construction inspection fees, as detennined during the plan review process, prior to signature on the final plat per Resolution 02-374. Show the landscape buffer easement on the face of the plat and label with a note. Revise the landscape plan as follows: a. Show a detached sidewalk along S. Eagle Road in compliance with MCC 12-13- 10-8. 7. Please add or revise the following plat note(s): a. Note #8: Complete recording infonnation. Also include the property to the north in the note and cross access agreement per Preliminary Plat Finding #14, page 8. 8. Tile all irrigation ditches, laterals or canals, exclusive of natural waterways, intersecting, crossing or lying adjacent and contiguous to the area being subdivided per City Ordinance 12-4-13. Submit written confinnation of plan approval from the appropriate irrigation/drainage district, or lateral users association to the Public Works Department. 9. Submit a recorded copy of a cross-parking/cross-access agreement to the Planning and Zoning Department for all of the lots within the subdivision prior to signature on the final plat per Preliminary Plat Finding #14, page 8. 10. Sign the Certificate of Owners and notarize the accompanying Acknowledgment (Sheet 2 ofthe final plat). 11. Applicant's engineer will be required to submit a signed, stamped statement certifying that all street finish centerline elevations are set a minimum of three feet above the highest established nonnal groundwater elevation. 12. Please add dimensions, or remove the tie 1 ine sh own from the south boundary tot he southwest comer of Lot 6, Block 1. Show the overall length of 2,700.17 feet between the southwest comer of Section 21 and the west quarter comer (basis of bearing) on the west side of the section line, and show the segments 1,659.94' and 1,040.23' on the east side of the section line. E. Easy Jet Drive doesn't exist and shouldn't be shown on this plat, unless Sutherland Farm records first, or the right-of-way is fonnally dedicated prior to this plats recordation. Remove the text "FUTURE ITD ROW" from the plat. Staffs failure to cite specific ordinance provisions or tenns of the approved annexation or preliminary plat does not relieve Applicant of responsibility for compliance. GENERAL REOUIREMENTS 2. 1. Remove any existing domestic wells and/or septic systems within this project ftom their domestic service per City Ordinance Section 9-1-4 and 9-4-8. (Wells may be used for non-domestic purposes such as landscape irrigation.) Install 250-watt high-pressure sodium streetlights at locations designated by the Public Works Department. Street light contractor shall obtain an approved design and permit from the Public Works Department prior to commencing installations. 3. Underground vear-round pressurized irrigation must be provided to all lots within this development. The City of Meridian requires that pressurized irrigation systems be supplied by a year-round source of water. Applicant shall be required to utilize any existing surface or well water for the primary source. If a surface or well source is not available, a single-point connection to the culinary water system shall be required. If a single-point connection is utilized, the developer shall be responsible for the payment of assessments for the common areas prior to signature on the final plat by the Meridian City Engineer. 4. Street signs are to be in place, water system shall be approved and activated, pressurized irrigation system approved and activated, drainage lots constructed, fencing installed, and road base approved by the Ada County Highway District prior to applying for building pennits. All development improvements, including fencing, micro-paths, irrigation, and landscaping shall be installed and approved prior to obtaining certificates of occupancy. A letter of credit or cash surety in the amount of 110% will be required for all fencing, landscaping, pressurized irrigation, sanitary sewer, water, etc., prior to signature on the final plat. Any drainage areas (detention/retention basins) must be designed to ensure that water will percolate or discharge within a period of time not to exceed 24 hours for all stonns up to and including a 100-year stonn event. Side slopes within drainage areas shall not exceed 3: I. A drainage plan designed by a State of Idaho licensed architect or engineer is required and shall be submitted to the City Engineer (Ord. 557, 10-1-91) for all off- street parking areas. Stonn water treatment and disposal must be designed in accordance with Department of Environmental Quality 1997 publication Catalog of Stonn Water Best Management Practices for Idaho Cities and Counties and City of Meridian standards and policies. Off-site disposal into surface water is prohibited unless the jurisdiction that has authority over the receiving stream provides written authorization prior to development plan approval. The applicant is responsible for filing all necessary applications with the Idaho Department of Water Resources regarding Shallow Injection Wells. 6. Coordinate with the Meridian Public Works Department and the Meridian City/Rural Fire Department to determine fire flow requirements. Provide a letter from the Fire Department stating required fire flow requirements prior to final plat approval. 7. Coordinate fire hydrant placement with the City of Meridian's Water Deputy Fire Chief and the Public Works Department. 8. Submit compaction test results to the Meridian Building Department for any building pads within lots receiving engineered backfill. 9. Developer shall coordinate mailbox locations with the Meridian Post Office. 10. Replace any tree over four (4) inch caliper that is removed ftom the property with an equivalent number of caliper inches of trees. (Required landscape buffer trees will not be considered as replacement trees for those trees that have to be removed.) RECOMMENDATION Staff recommends approval of the final plat, with the above stated comments and conditions.
