Mumbarto Ave. Boise,ID 83713 RE: 1725 W.Pine Avenue- (A-2016-0321) Dear Mr. Goff: In response to your request for a rebuild letter for the property located at 1725 W. Pine Avenue, please note the following: • The subject property is currently zoned C-N(Neighborhood Business District). • At the time of annexation (AZ-09-001) into the City, the use of this property was a single-family dwelling. As a provision of annexation, a development agreement was required, recorded as Instrument No. 111072107),which contains provisions for future development of the property. • Single-family dwellings are not a permitted use in the C-N zoning district. However, because the residential use has not ceased for 12 consecutive months or been replaced with a conforming use, the use is allowed to continue as a nonconforming use as long as the use remains lawful and is not expanded or extended, subject to the following provisions: 1. Alteration:No existing structure containing a nonconforming use may be enlarged,extended, constructed,reconstructed,moved or structurally altered except: a)through the approval of a conditional use permit in accord with the procedures set forth in chapter 5, article B, "Specific Provisions", of this title; or b)where the use of the structure is changed to a conforming use. 2. Extension: A nonconforming use may be extended to occupy additional land area only through the approval of a conditional use permit in accord with the procedures set forth in chapter 5, article B, "Specific Provisions",of this title.
