RE: H-2016-0100 CUP MDA THE VILLAS AT TWELVE OAKS SUBIVISION
The Idaho Transportation Department (ITD) has reviewed the referenced conditional use permit and
development application modification application for The Villas at Twelve Oaks Subdivision at 1845
West Franklin Road, north of I-84. ITD has the following comments:
1. ITD has no objection to the conditional use permit and development application modification
for a subdivision being constructed in this location.
2. This property does not abut the State highway system.
3. Idaho Code 40-1910 does not allow advertising within the right-of-way of any State highway
system.
4. IDAPA 39.03.60 rules govern advertising along the State highway system. The applicant can
contact Dion Burch at 334-8355 for more information.

considerations indicate approval.

❑ 13. Infiltration beds for storm water disposal are considered shallow injection wells. An application and fee must be

Dear Jaycee:
The applicant has worked with Nampa & Meridian Irrigation District (NMID) through the
process of tiling the Von Lateral only. A Land Use Change Application will need to be filed,
for review, prior to final platting. Please contact Suzy Hewlett at 466-.7MI for further
information.
The District's Von Lateral lies on the south boundary of this project and ' has a minimum
easement of forty feet (40'); twenty feet (20') each side of centerline. The District's Ten Mile
Drain also courses along the south boundary and has and easement of one hundred feet (100');
fifty feet (50') each side of centerline. These facilities must be protected.
This easement must be protected. Any encroachment without a signed License
Agreement and approved plan before any construction is started is unacceptable.
All municipal surface drainage must be retained on site. If any municipal { `;zrface drainage
leaves the site, the NMID must review drainage plans. The developer must ct`;'iply with Idaho
Code 31-3805.

Dear Mr. Porter:
Enclosed please find a Land Use Change Application for your use to file with the Irrigation
District for its review on the above -referenced development. If this development is under a
"rush" to be finalized, I would recommend that you submit a cashier's check, money order
or cash as payment of the fees in order to speed the process up. If you submit a company
or personal check, it must clear the bank before processing the application.
Should this development be planning a pressure urban irrigation system that will be owned,
operated and maintained by the Irrigation District, I strongly urge you to coordinate with Greg G.
Curtis, Water Superintendent for the Irrigation District, concerning the installation of the
pressure system. Enclosed is a questionnaire that you must fill out and return in order to initiate
the process of contractual agreements between the owner or developer and the Irrigation
District for the ownership, operation and maintenance of the pressure urban irrigation system.
If you have any questions concerning this matter, please feel free to call on me at the District's
office, or Greg G. Curtis, at the District's shop.

Nampa & Meridian Irrigation District (NMID) requires that a Land Use Change Application
be filed, for review, prior to final platting. Please contact Suzy Hewlett at 208-466-7861 for

The District's `Von `Lateral and Ten Mile Drain cross this proposed project and must be
protected. The District's easement for the Von Lateral at this location has a minimum
easement of forty feet (40'); twenty feet (20') each side of centerline. The easement for the
Ten Mile Drain is one hundred feet (100'); fifty feet (50') each side of centerline.
The District would also like to note that plans for the use of reclaimed water :'as the "Primary"
source of irrigation water will not be tolerated. This property holds a surface -:eater right off of
the Ridenbaugh Canal system, that should be used as the primary water source instead.
This easement must be protected. Any encroachment without a signed License
Agreement and approved plan before any construction is started is unacceptable.
