Conditional Use Permit Modification for the subject property.
The Applicant, Director, or a Party of Record may request City Council review of a decision of
the Director. All requests for review shall be filed in writing with the Planning Division of the
Community Development Department on or before September 22, 2016, within fifteen (15) days
after the written decision is issued, and contain the information listed in UDC 11-5A-6B.
If City Council review of the decision is not requested, the action of the Director represents a
final decision on a land use application. You have the right to request a regulatory taking
analysis under Idaho Code 67-8003.

SUBJECT: Walmart Fuel Sales & Kiosk —MCU (H-2016-0277)
I. APPLICATION SUMMARY
The applicant, Wal-Mart Real Estate Business Trust, requests approval to modify the existing
conditional use permit (CUP-00-004) to expand the Walmart site to include an 8-station fuel sales
facility and associated kiosk. The property consists of 19.3 acres of land in the C-C zoning district.
H. SUMMARY RECOMMENDATION
Staff recommends approval of the requested modification to the conditional use permit in accord with
UDC 11-5B-6G and the conditions of approval in Exhibit B.

IV. PROCESS FACTS
A. The subject application is for a conditional use permit minor modification. The Director is the
deciding body on this matter in accord with UDC Table 11-5A-2.
V. LAND USE
A. Existing Land Use(s) and Zoning: The subject property is currently being used as a parking lot for
the Walmart grocery/retail store.
B. Character of Surrounding Area and Adjacent Land Use and Zoning:
1. North: E. Fairview Avenue, an arterial street, and vehicle sales (CarMax), zoned C-G
2. West: Multi -tenant commercial property, zoned C-C
3. South: Parking lot, zoned C-C
4. East: Walmart grocery/retail store, zoned C-C

B. History of Previous Actions: This property was annexed (AZ-99-012) into the City in 1999 with
the requirement of a development agreement (#100042750 & 100088407). A conditional use
permit (CUP-00-004) was previously approved for this site for the expansion of the Meridian
Crossroads shopping center to include the subject Walmart store.
VI. STAFF ANALYSIS
The applicant requests a modification to the previously approved conditional use permit (CUP-00-
004) to expand the use of the property to include a fuel facility and associated kiosk for Walmart.
The previously approved site plan depicted parking in the subject area where the fuel facility and
kiosk are proposed and a seasonal garden center at the northwest end of the Walmart building next to
the auto service department. At some point, the garden center was relocated to the area where the fuel
facility is now proposed. The applicant proposes to relocate the garden center back to the area
originally identified on the site plan; there is also an area depicted on the site plan as "new outdoor
sales area" within the subject portion of the site.
The proposed site plan depicts an 8-station fuel facility with a canopy and a 1,481 square foot kiosk
and associated parking. A total of 88 parking spaces are proposed to be removed for construction of
the fuel facility; however, the proposed parking still complies with the minimum standards listed in
UDC 11-3C-6B.
The Unified Development Code (UDC) (11-5B-6G) authorizes the Director to approve or deny
specified minor modifications, provided such modifications were not the subject of review during the
original public hearing and will not adversely impact adjacent properties. Such minor modifications
include, but are not limited to the, the following:
a. A reduction in density not exceeding 25% of the total units;
Not applicable — no residential units are proposed.
b. Minor relocation of dwelling units or building pads for practical reasons such as road
alignment, topography or access;
Not applicable — no residential units or building pads are proposed to be relocated.
c. Minor changes to the recreation area or open space design, but not elimination or reduction in
area; and
Not applicable — no recreation or open space areas are existing or proposed.
d. Increase in building square footage, not exceeding 20%, provided that the parking and
landscaping requirements are met.
The square footage of the proposed kiosk does not exceed 20% of the existing building square
footage; parking and landscaping requirements are still met.
Based on the above criteria, the Director finds the proposed modification will not adversely impact
adjacent properties. The applicant must obtain certificate of zoning compliance (CZC) and design
review (DES) approval of the revised plans shown in Exhibits A.3 & A.4.

Exhibit B — Conditions of Approval
1. The applicant shall comply with all applicable terms of the conditional use permit (CUP-00-004)
and all other previous conditions of approval associated with this site (CPA-99-002; AZ-99-012;
RZ-99-007, Development Agreement #100042750 & 100088407).
The applicant must obtain certificate of zoning compliance (CZC) and design review (DES)
approval for site, landscape and building design prior to submittal of a building permit
application.
