Broadway Avenue Meridian, Idaho 83642 VIA EMAIL RE: H-2016-0099 TM CROSSING SUBDIVISION The Idaho Transportation Department (ITD) has reviewed the referenced development agreement modification application for TM Crossing Subdivision located at the northeast corner of North Ten Mile Road and I-84. ITD has the following comments: 1. ITD has no objection to the building of a subdivision on this property. 2. I-84 and North Ten Mile Road are full access controlled roadways along the property boundaries of this property and no new accesses will be allowed. West Smithfield Drive was constructed for access to this property. 3. Any work within ITD right-of-way shall require an approved ITD permit before any work begins. The applicant can contact Shona Tonkin for more information 4. Noise barriers are the responsibility of the landowner. ITD will not construct any noise barriers. 5. Idaho Code 40-1910 does not allow advertising within the right-of-way of any State highway system. 6. IDAPA 39.03.60 rules govern advertising along the State highway system. Please contact Suzy Hewlett .at 466-7861 for further information. Located along the south and west boundary of this proposed project, are the Purdam, Gail, and Taylor Drains. The easement for the Purdam Drain at this location is a minis ­.um of eight -five fift Ieet'(8'S'); y feet (50'y'lefE,andthirty-five feet (35') right. The easement f�)r the Gail Drain is sixty feet (60'`)J6i-ty feet (40') left, and twenty feet (20') right. The easemont for the Taylor Drain is sixty feet (60'); forty feet (40') each direction facing downstream. These three facilities must be protected. This easement must be protected. Any encroachment without a, signed License Agreement and approved plan before any construction is started is unacceptable. All municipal surface drainage must be retained on site. If this development is under a "rush" to be finalized, I would recommend that you submit a cashier's check, money order or cash as payment of the fees in order to speed the process up. If you submit a company or personal check, it must clear the bank before processing the application. Should this development be planning a pressure urban irrigation system that will be owned, operated and maintained by the Irrigation District, I strongly urge you to coordinate with Greg G. Curtis, Water Superintendent for the Irrigation District, concerning the installation of the pressure system. Enclosed is a questionnaire that you must fill out and return in order to initiate the process of contractual agreements between the owner or developer and the Irrigation District for the ownership, operation and maintenance of the pressure urban irrigation system.
