This letter is to confirm the Director approved your request for alternative compliance to Unified
Development Code (UDC) 11-3B-7C2c for the subject property based on the required Findings
listed in UDC 11 -5B -5E, as follows:
1. Strict adherence or application of the requirements are not feasible; or
The main reason for the ten foot fence setback on corner lots is to provide a clear line
of site for motorists turning the corner. The Applicant is proposing a reduced setback
for the fencing thereby potentially increasing the visibility concerns; however, the
proposal still leaves approximately 16 feet of space between the curb and proposed
fence. The Director finds strict adherence is feasible, but not desirable.
2. The alternative compliance provides an equal or superior means for meeting the
requirements; and
The proposed fencing is proposed to be located a distance of 16 feet from the curb.
This distance is one (])foot greater than what would be installed on the site if the
sidewalk was attached, The reduction in the setback would be greater than what is
normally required by code. Therefore, Staffsupports the fencing being installed as
proposed.
3. The alternative means will not be materially detrimental to the public welfare or
impair the intended uses and character of surrounding properties.
Stafffinds that the proposed alternative will not be detrimental to the public wefare
or impair the use%haracter of the surrounding properties.
Mr. Johnson, the owner of the property directly to the east (2743 W Wolf Rapids)
sent a letter to the City in support of the proposed Alternative Compliance request.
The Applicant, Director, or a Parry of Record may request City Council review of a decision of
the Director. All requests for review shall be filed in writing with the Planning Division of the

Community Development Department on or before August 3, 2016, within fifteen (15) days after
the written decision is issued, and contain the information listed in UDC 11-5A-613.
If City Council review of the decision is not requested, the action of the Director represents a
final decision on a land use application. You have the right to request a regulatory�aking
analysis under Idaho Code 67-8003.

I am a homeowner in Lochsa Falls Subdivision at 5874 N Black Sand Ave. I am asking for a variance so
that I can move the fence on the side of my property 4 feet so that I can do some improvements in my
back yard. Currently, Meridian City Code does not allow me to move my fence. The reason I need to
move my fence is because we discovered that the main irrigation line for our subdivision runs 5 feet into
my lot. This is forcing me to make changes to my plans and push everything back including the fence.
Because of the shape of our lot, this is the only place that we can fit the pool we are wanting to put in.
We have lived in this home for 10 years and plan on being here for a very long time. We want to be able
to fully enjoy our property. This backyard renovation will allow us to do that.
Thank you for considering our variance. We are looking forward to moving ahead with our project.
