Overland Road Boise, Idaho 83702 Application Information: The Ada County Highway District (ACRD) staff has received the above referenced application requesting preliminary and final plat approval to re-plat Lot 14, of Woodside Creek Subdivision phase 1. No changes to the roadways are being proposed. The exterior boundary lines of the original plat are not being adjusted only the re-platting to split one internal lot into two. The 0.33-acre site is located on the east side of New Creek Avenue and the west side of Ten Mile Road. Acreage: 0.33-acres Current Zoning: R-8 (Medium Density Residential District) Residential Lots: 2 Site History: On August 26, 2003, the Ada County Highway District Commission reviewed and granted preliminary approval for an application (Woodside Creek Subdivision phase 1) to rezone 4.47-acres from R-4 to R-8 and preliminary plat approval for 15 building lots and 5 other lots. Findings of Fact Trip Generation: This development is estimated to generate 10 additional vehicle trips per day (10-existing) based on the Institute of Transportation Engineers Trip Generation Manual.'The actual trips will be determined when the District receives a development application. 2. Impact Fees: There will be an impact fee that is assessed and due prior to issuance of a building permit. Impact fees are based on the impact fee ordinance that is in effect at the time of construction. 3. Traffic Impact Study: This proposed development is estimated to generate less than 1,000-trips per day therefore a traffic impact study was not required with this application. 4. Site Information: The site currently has a single family dwelling with an out building; that is to be removed. 5. Description of Adjacent Surrounding Area including Zoning: a. Woodside Creek Subdivision as a site specific requirement the dedication of 48-feet from the western side of the centerline of Ten Mile Road. Woodside Creek Subdivision phase I was required to provide the District with a road trust deposit in the amount of $7,280.00 to be used for future sidewalk construction along the Woodside Creek .Subdivision phase 1's frontage. **Due to the existing mature trees along Ten Mile Road, the applicant may opt to construct a meandering sidewalk on Ten Mile Road in lieu of a road trust deposit. The face of sidewalk should not be located any closer than 41-feet from centerline, and an easement should be provided for any sidewalk located outside of the right-of-way. At the property lines the sidewalk should be constructed to match future sidewalk improvements Woodside Creek Subdivision phase 1 will construct Cliff Creek Avenue, New Creek Avenue and Forecast Street as a 33-foot street section within 42-feet of right-of-way with curb, gutter and 5-foot wide concrete sidewalk. Provide written approval from the Meridian Fire Department. 8. Existing Right-of-Way: Woodside Creek Subdivision as a site specific requirement the dedication of 48-feet from the western side of the centerline of Ten Mile Road. ~ 9. ~ Existing Access to the Site: Berkeley Square Subdivision constructed Cliff Creek Avenue at the south property line located between Lot 1 and Lot 19 to provide access to Woodside Creek Subdivision phase 1. Cliff Creek Avenue as proposed will be stubbed to the parcel to the north located 'approximately 290- feet west of the eastern property line. 10. Capital Improvements PlanlFive Year Work Program: Ten Mile Road, from Franklin Road to Cherry Lane, is currently in the District's Five Year Work Program for roadway improvements in 2007 (also in CIP). Ten Mile Road from Cherry Lane to Ustick Road is currently in the District's Five Year Work Program for roadway improvements in 2008 (also iri CIP). 11. Other Development in Area: On October 4, 2002, ACRD reviewed and approved Mosher's Farm, a 25-lot residential subdivision located south of Berkeley Square. On May 16, 2003, ACHD reviewed and approved The Courtyard, a 31-lot residential and 3-lot commercial subdivision, located at the southeast corner of Ten Mile Road and Pine Avenue. B. Findings for Consideration C. Site Specific Conditions of Approval 1. Woodside Creek Subdivision phase 2 is proposing to access the public roadway system through Woodside Creek Subdivision phase 1. Woodside Creek Subdivision (phase 1) has not completed the roadway improvements therefore Woodside Creek Subdivision phase 2 does not have access to the public roadway system at this time. Due to the fact that Woodside Creek Subdivision phase 1 has not completed the roadway improvements, Woodside Creek Subdivision. phase 2, preliminary plat shall be approved contingent upon the improvements within Woodside-Creek Subdivision phase 1 being constructed or a financial surety in place for the construction of the roadways prior to the signature of the final plat for Woodside Creek Subdivision phase 2. 2. Other than the access point(s) specifically approved with this application, direct lot or parcel access to Ten Mile Road is prohibited. Lot access restrictions, as required with this application, shall be stated on the final plat. 3. Comply with all Standard Conditions of Approval. D. Standard Conditions of Approval 1. Any existing irrigation facilities shall be relocated outside of the right-of-way. 2. All utility relocation costs associated with improving street frontages abutting the site shall be borne by the developer. 3. Replace any existing damaged curb, gutter and sidewalk and any that may be damaged during the construction of the. proposed development. Contact Construction Services at 387-628~b (with file number) for details. 4. Utility street cuts in pavement less than five years old are not allowed unless approved in writing by the District. Contacf the District's Utility Coordinator at 387-6258 (with file numbers) for details. 5. All design and construction shall be in accordance with the Ada County Highway District Policy Manual, ISPWC Standards and approved supplements, Construction Services procedures and all applicable ACHD Ordinances unless specifically waived herein. An engineer registered in the State of Idaho shall prepare and certify all improvement plans. 6. The applicant shall submit revised plans for staff approval, prior to issuance of building permit (or other required permits), which incorporates any required design changes. 7. Construction, use and property development shall be in conformance with all applicable requirements of the Ada County Highway District prior to District approval for occupancy. 8. Payment of applicable road impact fees are required prior to building construction in accordance with Ordinance #198, also known as Ada County Highway District Road Impact Fee Ordinance. 9. It is the responsibility of the' applicant to verify all existing utilities within the right-of-way., The applicant at no cost to ACHD shall repair existing utilities damaged by the applicant. The applicant shall be required to call DIGLINE (1-800-342-1585) at least two full business days prior to breaking ground within ACHD right-of-way. The applicant shall contact ACHD Traffic Operations 387-6190 in the event ahy ACHD conduits (spare or filled) are compromised during any phase of construction. 10. No change in the terms and conditions of this approval shall be valid unless they are in writing and signed by the applicant or the applicant's authorized representative and an authorized representative of the Ada County Highway District. The burden shall be upon the applicant to obtain written confirmation of any change from the Ada County Highway District. 11. Any change by the applicant in the planned use of the property which is the subject of this application, shall require the applicant to comply with all rules, regulations, ordinances, plans, or other regulatory and legal restrictions in force at the time the applicant or its successors in interest advises the Highway District of its intent to change the planned use of the subject property unless a waiver/variance of said requirements or other legal relief is granted pursuant to the law in effect at the time the change in use is sought. E. Conclusions of Law The proposed site plan is approved, if all of the Site Specific and Standard Conditions of Approval are satisfied. 2. ACRD requirements are intended to assure that the proposed use/development will not place an undue burden on the existing vehicular and pedestrian transportation system within the vicinity impacted by the proposed development. Appeal Guidelines 5 Request for Appeal of Staff Decision Appeal of Staff Decision: The Commission shall hear and decide appeals by an applicant of the final decision made by the ROWDS Manager when it is alleged that the ROWDS Manager did not properly apply this section 7101.6, did not consider all of the relevant facts presented, made an error of fact or law, abused discretion or acted arbitrarily and capriciously in the interpretation or enforcement of the ACHD Policy Manual. a. Filing Fee: The Commission may, from time to time, set reasonable fees to q~e charged the applicant for the processing of appeals, to cover administrative costs. b. Initiation: An appeal is initiated by the filing of a written notice of appeal with the Secretary of Highway Systems, which must be filed within ten (10) working days from the date of the decision that is the subject of the appeal. The notice of appeal shall refer to the decision being appealed, identify the appellant by name, address and telephone number and state the grounds for the appeal. The grounds shall include a written summary of the provisions of the' policy relevant to the appeal and/or the facts and law relied upon and shall include a written argument in support of the appeal. The Commission shall not consider a notice of appeal that does not comply with the provisions of this subsection. c. Time to Reply: The ROWDS Manager shall have ten (10) working days from the date of the filing of the notice of appeal to reply to the notice of the appeal, and may during such time meet with the appellant to discuss the matter, and may also consider and/or modify the decision that is being appealed. A copy of the reply and any modifications to the decision being appealed will be provided to the appellant prior to the Commission hearing on the appeal. d. Notice of Hearing: Unless otherwise agreed to by the appellant, the hearing of the appeal will be noticed and scheduled on the Commission agenda at a regular meeting to be held within thirty (30) days following the' delivery to the appellant of the ROWDS Manager's reply to the notice of appeal. A copy of the decision being appealed, the notice of appeal and the reply shall be delivered to the Commission at least one (1) week prior to the hearing. e. We have reviewed the above referenced submittals and offer the following comments, as conditions of approval. These conditions shall be considered in full, unless expressly modified or deleted by motion of the Meridian City Council: APPLICATION SUMMARY The Applicant, Woodside Properties, LLC, has applied for Preliminary/Final Plat approval of the resubdivision of an existing lot in Woodside Creek Subdivision. The property was originally platted as Woodside Creek Subdivision. The final plat for Woodside Creek was approved by City Council on Apri17, 2004. The final plat has not yet been recorded. The proposed plat will split the large lot in the southwest comer of the subdivision into two residential lots. The proposed lot 19 does not meet the 40' frontage requirement for the R-8 zoning district. A common drive will be required to provide access to lots 19 and 20 and to bring the proposed lot 19 into compliance with the zoning code. The required frontage for lots sharing a common driveway is 15'. No changes are proposed to the CC&R's for Woodside Creek from what was previously approved. Staff recommends approval of the plat with the conditions noted in this report. Woodside Creek Subdivision No. 2PFP-04-006 LOCATION The property is located on the west side of N. Ten Mile Road, approximately''/z mile south of Cherry Road. SURROUNDING PROPERTIES North: Rod's Parkside Creek Subdivision, zoned R-4 West: Meridian Joint School District No. 2 property, zoned R-4. East: Thunder Creek Subdivision, zoned R-4 South: Berkeley Square Subdivision, zoned R-8 PRELIMINARY PLAT FINDINGS AND REQUIREMENTS Sections 12-3-3 J.2 and 12-3-5 D read as follows: "In determining the acceptance of a proposed subdivision, the Commission/Council shall consider the objectives of this title and at least the following: a. The conformance of the subdivision with the Comprehensive Development Plan; Staff finds the subdivision to be in conformance with the Comprehensive Plan. The Future Land Use map designates the property as Medium Density Residential. Existing zoning on the property is Medium Density Residential (R-8). The subject plat is intended for residential development in compliance with the Comprehensive Plan. b. The availability of public services to accommodate the proposed development; Staff finds that public services are available to accommodate the proposed development. All adjacent public roadways have been completed and accepted by ACHD. Water and sewer services to both lots will be installed as part of the original subdivision improvements along the proposed lot line within an existing utility easement and have been accepted by the Public Works Department. The applicant has been working with the Public Works Department to facilitate this lot split. c. The continuity of the proposed development with the capital improvement program; Woodside Creek Subdivision No. 2 PFP-04-006 Staff finds that the subdivision will not require the expenditure of capital improvement funds. All required utilities will be installed per the previous plat requirements. d. The public financial capability of supporting services for the proposed development; Staff finds that the development will not require major expenditures for providing supporting services. The developer has already financed the extension of sewer, water, utilities and pressurized irrigation to serve the project. The primary public costs to serve the future residents will be fire and police services. e. The other health, safety or environmental problems that may be brought to the Commission's attention. Staff finds that there should not be any other health, safety or environmental problems associated with this subdivision that may be brought to the Council or Commission's attention. SITE SPECIFIC COMMENTS -PRELIMINARY/FINAL PLAT 1. All landscaping will be required per the approved plans on the original plat (FP-04-014.) The house currently located on proposed lots 19 and 20 must be relocated outside of the required landscape buffer as required by the Woodside Creek final plat. Any incomplete landscaping shall be bonded for prior to signature on the final plat. 2. Sanitary sewer and water service to this development shall be via service line extensions from the existing City of Meridian mains adjacent to the project. Pressurized irrigation within this development will be from the existing system that will be installed as part of Woodside Creek No. 1. 4. This application is subject to the conditions of approval for the original plat (FP-04-014.) 5. Show a common drive for lots 19 and 20 on the plat. 6. Graphically depict 5-foot wide public utility, drainage and irrigation easements along the north side of Lot 20, and the west side of Lot 19, as these are side lot lines adjacent to the previously platted lots. AGENCY COMMENTS This project was discussed at the May 21, 2004 comments meeting. This project has no fire department of sanitary services concerns.
