Request for Vacation of Utilities, Drainage and Irrigation Easement on Lots 22 & 23,
Block 2 of Packard Acres Subdivision No. 2, by Packard Estates Development, LLC
(File No. YAC-04-003).
We have reviewed this submittal and offer the foddowing comments, as conditions of the Applicant.
These conditions shall be considered in full, unless expressly modified or deleted by motion of the
Meridian City Council:
APPLICATION SUMMARY
The Applicant, Packard Estates Development, request the City's concern to vacate the existing ten
(10) foot utilities, drainage and irrigation easement that lies oa We interior lot line between Lots 22
and 23, Block 2 of Packard Acres No. 2. This is the standazd easement, five (5) feet on either side of
an interior lot line, which is created via recorded final plats. The easement is no longer needed in this
location as it is no longer adjacent to a platted lot line. It now runs through the middle of Lot 23,
Block 2 and must be vacated before any building permits can be issued for this lot. The Public Works
Department has confirmed that there are no existing utilities within the subject easement to be
vacated.
The subject lots are in the northeast comer of the subdivision and were both affected by a Lot Line
Adjustment (LLA) that was signed by the City Engineer in May 2004 and recorded as Instrument No.
104067468 on May 18, 2004. The purpose of the LLA was to create two lots which the developer
believed were more balanced in area and size and, therefore, more marketable. The Record of Survey
also slightly adjusted the lot line between Lots 23 and 24, Block 2.
City Ordinance 12-10-2 requires that "any property owner desiring to vacate an existing...easement
shall complete and file an application [for vacation]."
Staff is recommending approval of the proposed vacation, with the comments listed below.

SURROUNDING USES
North -Pasture land/nual residential uses, zoned RUT (Ada Co.).
South -Chateau Meadows, zoned R-8, and a 5-acre parcel, zoned RUT
East -Packard Acres No. 1, zoned R-4, and two, 5-acre parcels, zoned RUT.
West -Chamberlain Estates Subdivision, zoned R-8
OWNER OF RECORD
The owner of record of the two (2} lots on which the subject easement lies is Packard Estates
Development, LLC. Mr. Wirt Edmonds, representing Packard Estates Development, has submitted a
notarized consent for proposed vacations.
SPECIAL CONSIDERATIONS
Process: The Subdivision and Development Ordinance (Title 12), Chapter 10, requires the
Planning & Zoning Conunission to review and make a recommendation on Vacation
applications. A public hearing is then required before the City Council.
CONDITION OF APPROVAL
Prior to issuance of a Certificate of Occupancy on Lots 22 or 23, Block 2 of Packard Acres
No. 2, the Applicant shall submit evidence that the requested vacation has been approved by
all required agencies and authorities. Letters of relinquishment shall be provided from utility
companies, as required by the Public Works Department.
2. Prior to issuance of a Certificate of Occupancy on Lots 22 or 23, Block 2, a new PUDI
easement shall be prepared and submitted to the City Engineer to be located five (5) feet
either side of the adjusted interior lot line between Lots 22 and 23, Block 2 of Packard Acres
No. 2.
RECOMMENDATION
Staff recommends approval of application VAC-04-003 with the conditions and comments noted
above.
