Strict adherence or application of the requirements are not feasible; or This site receivedprior alternative compliance approval (ALT -08-026) to construct retaining walls and a plaza within the required street buffers due to the subject property having topographical/shape restraints. These topographical restraints and installed plaza preclude full compliance with the City's landscape standards to install fencing only on the interior edge of the street buffer. Additionally, Staff believes the placement of the fencing in the proposed location is a natural area for such fencing. 2. The alternative compliance provides an equal or superior means for meeting the requirements; and The proposedfencing is wrought iron which is, in nature, more decorative than other fencing materials and therefore provides an equal means of meeting UDC 11-3B- 7C2c. Such fencing does not act as a screen but only a decorative barrier. The other, already installed, landscape buffer and associated features, in conjunction with the proposed fencing, help to create an appealing atmosphere and gathering area for the residents of the assisted livingfacility. Therefore, Staffsupports the fencing being installed as proposed. The alternative means will not be materially detrimental to the public welfare or impair the intended uses and character of surrounding properties. The fence is proposed to be installed as per the site plan included as exhibit A. Pictures also included show how fence would run along grass line. The request is to build a wrought Iron perimeter fence within the 25' landscaping zone as to impede residents from wandering into the street area, "safety". Gates with codes will be installed as well as a safety precaution. The current facility is assisted living and the Nurses assess each resident as to their abilities but at some time with age there is the possibility of Dimentia. When or if this happens this fence would prevent wandering of residents onto street area which could result in dangerous circumstances. The wrought iron fencing will not be noticed by the public due to the slope from the road down to the sidewalk area. There is approximately 5' of fall in the landscape area & rock that would essentially hide the majority of the fencing from the public view.
