` Thank you for meeting with us earlier today to discuss the Mussell Comer PFP and PD
applicatiods with Eric Peterson of Cole Poe Architects and Brafl Hawkins-Clark of your
office. We have revised the plat, landscape plan and site plan in ,accordance with the.
ACHD deeds tltiit were iecorded in 1999, which resulted in ACFID, acquiring 48 feet of
- right-of--way measured from the centerline of Victory Road.
Fortunately, ACHD. does not intend to construct Victory Road'as a major anerial.
roadway and only 70 ft, of right-of-way is required for the build-out of the road (instead
of 96 feet of rigbt-of--way). ACRD is onl}t requiring the construction-of half of a 46-foot .
street section within the existing '48' right-of-way, consequently there is room £or
' landscaping to be constructed within ACHD's right-oF way behind the detached sidewalk
and between the curb and sidewalk along Victoryr.. As w,e discussed with Lori Den-Hertog
from ACRD, a license agreement will be required for the landscaping within theright-of-
way, and the vegetation may. be limited to groundcover with no,trees. Without this
landscaping the land in front of the existing buildings would not be able to be landscaped'
or else the parking would have to~be eliminated.• The landscaping within ACHD's
pzoperty will come close to providing the minimum required landscaping buffer in front
' ~ of the existing buildings adjacent to Victory.
The `pond" amenity, or the' existing pond will be left in its current state within ~ the
nursery for the time being. As the propetty're-develops the pond will lie retained and
protected as an amenity and will be incorporated into future development.
After our meeting I stopped by Toe Silva's office to discuss the need for a turnaround that
maybe required because of the ACHD requirement to Blase one of -the access points
along Victory Road. Joe. stated that if we can connect the .proposed gas station to the -
existing commercial use in a manner that would provide .a secoridajry route of access in
and out, anew turtmaraund would not be required..We have; revised to plat to
accommodate the additional cross access.

The revised plat still indicates the use of the northemzxiost existing access to SH=69 this -
access is used by ~1~MID for ditch maintenance and by the existing retail stone business (a -
• parr of Victory Greens). The proposed subdivision does not yet include the development
of a frontage/backage road to the existing access. We ask that we be allowed to continue ~ -
to use the access,, iu addition-to the new access located in the midpoint of the subdivision, -
until northernmost iot of the subdivision is re-developed-• .:
