CC: File, Gary Smith, PE, City Gerk Date: 7/1/04 Re: Trunk Line Water & Sewer Assessment, Connection and Miscellaneous Fee Proposal -July 6 Continued Public Hearing The Building Contractors Association -Builders Council allowed me to present this matter to them at their June 8 meeting. The reactron to the fee proposal was, in my view, sign'fiicantly negative. I perceived their comments to doubt the methodology of the fee calculations and well as the legal basis for them. Alter discussing this matter with Gary Smith, I recommend that we retain a third party consutlant to review my fee structure and plculatron methodology before proceeding with the public hearing. If Mayor and Council accept this recommendation, lintend to contact Scott Harder of the Environmental Finance Group in Minnesota to begin this work. A copy of his resume is attached. Preliminary indications are that he could complete a "desk-top" analysis of this proposal by the end of July. In order to allow this review to be completed and respond to the Developers and Builders Councils of the BCA, I ask the July fi public hearing be oontrnued to August 24, 2004 . Using cigarette taxes and other revenue sources, the fund has evolved into an important source of revenue for cash-strapped municipalities„ (State of Washington, 1983-4) Multi.lurisdictional Water Supply Planning, Design Development and Capital Programming: Scott provided technical assistance in developing regional water supply plans for King County, Washington. He also supported design development and capital programming of water and wastewater treatment facilities in Washington and California. (Economic and Engineering Services, 1985-7) Yucca Mountain Nuclear Waste Repository: Scott provided technical assistance in developing regional ernnomic and fiscal models to support the development of a federal nuclear waste repository at Yucca Mountain: Nevada. (Planning Information Corporation, 1988) Utility Mergers, Acquisitions, and Management: Scott provided pricing and negotiations support for over $100 million in revenue bonds for Palm Beach County to support expansion of its water and wastewater systems. Scott supported valuation, pricing and negotiations support for acquisitions of private water and wastewater utilities in Charlotte, St. Lucie, and Palm Beach counties in Florida. Scott provided ratemaking, financial policy development, and financial management services to Palm Beach County, and other clients. (Montgomery Watson, 1968-92) Wastewater Collection System Master Plan, City of Fort Collins, Colorado: Scott served as project manager for this planning effort. It involved calibrating computer model results using a number of flow meters placed at points in the collection system (Morr(gomery Watson, 7989) Solid Waste Commercial Assessment Program: Scott co-developed a commercial assessment program to support repayment of $500 million in revenue bonds issued to construct a solid waste incinerator. The effort involved convincing insurers, rating agencies and bondholders of the ability to secure sufficient waste to pay debt service (Momgomery Watson 1991) Assessment-Backed Infrastructure Financing: Scott provided financial consulting services to the City of Miramar, Florida to develop an innovative program to develop water, wastewater and road infrastructure programs backed exclusively by assessments to raw land. The program involved negotiations with developers and development of financial policies and plans. Errvironmenta! Palm Beach County, Florida: Scan has served as financial rate consultant to Palm Beach ~ County Water Utilities Department since 1989. Over that time, he has assisted in the acquisition and integration of three smaller util'dies into the growing regional County system. He has conducted four connection fee studies and three major rate studies. His role in these efforts was economic analysis and development of capital improvements plans. In 1996, he assisted in updating the County's Guaranteed Revenues policy, helping to avert a legal challenge. He developed the department's first wastewater reuse rates and the procedure for developing Expansion Project Percentage calculations in response to bond counsel concerns in the early 1990's He routinely supports the Countys water and wastewater bond issues, providing financial and debt service coverage projections,. working closely with department staff. The methodology, a net replacement cost less accumulated depreciation, was stipulated by Idaho case law regarding wnnection fees and impact fees. Scott also prepared a financial plan to support the water master update in 1997. (Environmental Financial Group, 1993 and ?997) Wyoming Water Development Commission: Scott supported the Development Commission on several water master planning projects to evaluate the economic and financial feasibility of state investments in local water systems. These analyses included "ability-to-pay' determinations. Paul, Minnesota: Scott has served as economic and finanaal consultant on two on-going Council master planning efforts. As sub- consultant to major environmental engineering firms, he is ensuring that capital improvement planning is being done in accordance with the Council's Capital Planning Guidance policy. Using the life cycle cost analysis methodology he developed for a previous Council project, he is extending that approach to assist in comparing more complicated alternatives involving mukiple wastewater treatment facilities and technologies (Environmerrta/ Financfe/ Group, 9999 - 2001) Accelerated Project Delivery for the Metropolitan Council Environmental Services: Scott supported the Metropolitan Council to develop and execute innovative, accelerated project delivery of its new South Washington County wastewater treatment facility (Environmental Financial Group„ 9999-2000) Utility Development Services: Scott has served the Duluth !North Shore Sanitary District as financial and business planning consultant since 2000. Over that time, the District has developed plans fora $13 million wastewater force main, storage, and collection system to alleviate water quality problems along the north shore of Lake Superiorjust north of Duluth. The project is 50% funded by state grents, (Environmerrtal Financia! Group, 2000-2) Joint Water Commission (Golden Valley, New Hope and Crystal, Minnesota): Scott is currently negotiating a new water supply contract between the JWC and the City of Minneapolis. He also conducted a study evaluating the feasibility of the JWC developing a new water treatment system using groundwater supplies and membrane treatment technology.
