HomeMy WebLinkAbout Selway Parking ModificationsCERTIFICATE OF ZONING COMPLIANCE REPORT DAHO DATE: June 8, 2016 TO: Chris Laraway, Evergreen Architecture FROM: C.Jay Coles, Assistant City Planner SUBJECT: Selway Apartments Parking Modification - CZC - A-2016-0192 OWNER: HZ Selway Apartments LLC DESCRIPTION OF APPLICANT'S REQUEST The applicant, Chris Laraway, requests Certificate of Zoning Compliance (CZC) approval to convert 11 ADA parking spaces to regular parking spaces; overall number of parking spaces onsite will not change. On 10.103 acres of land in the R-4 zoning district. The site is located at 2552 W. Selway Rapids Lane. ADA requirements and the number of said spaces required are governed by the Federal Government and the Americans with Disabilities Act. This CZC only addresses the conversion in terms of ensuring the converted parking spaces meet City Code dimensional standards and to ensure that the overall number of parking spaces is not reduced. CZC does not grant approval to actually convertADA parking stalls nor does it in any way modify ADA requirements. DECISION The applicant's request for Certificate of Zoning Compliance is approved with the conditions listed in this report. Note: This is not a building permit. Please contact Building Services at (208) 887-2211 to verify if you need a building permit and/or inspection. If you do need a building permit, you must complete that process before you commence the use or construction. Please contact Building Services for additional details about building permits and inspections. Process Conditions of Approval 1. No signs are approved with this application. Prior to installing any signs on the property, the applicant shall submit a sign permit application consistent with the standards in UDC Chapter 3 Article D and receive approval for such signs. 2. The applicant shall complete all improvements related to public life, safety, and health as set forth in UDC 11 -5C -3B. A surety agreement may be accepted for other improvements in accord with UDC 11 -5C -3C. 3. The site plan prepared by Christopher Laraway on May 23, 2016, labeled 91 and 92, is approved as shown in Exhibit B, with the following comments: a. Parking stalls shall meet the dimensional standards of UDC Table 11-3C-5. 4. The approved site plan may not be altered without prior written approval of the City of Meridian Planning Division. 5. The applicant shall pay any applicable impact fees prior to the issuance of a building permit. 6. If any changes must be made to the site plan to accommodate ACHD requirements, the applicant shall submit a new site plan to the City of Meridian Planning Division for Conditions Document 1 Selway Apartments Parking Modification - CZC - A-2016-0192 approval prior to issuance of the building permit. 7. The applicant shall complete all required improvements prior to issuance of a Certificate of Occupancy. It is unlawful to use or occupy any building or structure until the Building Official has issued a Certificate of Occupancy. Ongoing Conditions of Approval 1. The applicant and/or assigns shall have the continuing obligation to provide irrigation that meets the standards as set forth in UDC 11-3B-6 and to install and maintain all landscaping as set forth in UDC I1 -3B-5, UDC 11-3B-13 and UDC 11-313-14. 2. The applicant shall comply with the outdoor storage as an accessory use standards as set forth in UDC 11-3A-14. 3. The project is subject to all current City of Meridian ordinances and previous conditions of approval associated with this site (CUP -07-016; CZC-08-020). 4. The issuance of this CZC does not release the applicant from any previous requirements of the other permits issued for the site. 5. The applicant and/or property owner shall have an ongoing obligation to prune all trees to a minimum height of six feet above the ground or sidewalk surface to afford greater visibility of the area. 6. The applicant shall have an ongoing obligation to maintain all pathways. 7. The applicant has a continuing obligation to comply with the outdoor lighting provisions as set forth in UDC I I -3A-11. 8. The applicant and/or property owner shall have an ongoing obligation to maintain all landscaping and constructed features within the clear vision triangle consistent with the standards in UDC 11-3A-3. 9. The applicant and/or assigns shall have the continuing obligation to meet the specific use standards for the proposed use as set forth in UDC 11-4-3-27. CITY COUNCIL REVIEW The applicant or a party of record may request City Council review of a decision of the Director. All requests for review shall be filed in writing with the Planning Division on or before June 23, 2016, within fifteen (15) days after the written decision is issued, and contain the information listed in UDC I I -5A -6B. If City Council review of the decision is not requested, the action of the Director represents a final decision on a land use application. You have the right to request a regulatory taking analysis under Idaho Code 67-8003. EXPH2ATION Certificates of Zoning Compliance issued in conjunction with a proposed use shall expire if the use has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. Certificates of Zoning Compliance issued in conjunction with construction or alteration of a structure shall expire if the construction or alteration has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. Selway Rapids Ln.-(Selway Apartments) Meridian, Ada County, ID 83642 Site Assessment & Evaluation for Handicap Parking Dear Plan Reviewer: This Site Evaluation Report for the above reference project was generated from our on site visit and Alta Survey of the Subject Property. The Purpose of the Site Evaluation was to assess the existing site Handicap Parking ratio to provided additional spaces allowing for more standard parking for the tenants in the Apartment Complex. This request was made by the tenants to the owner for more parking. The Owner is therefore requesting a reduction of Handicap Spaces from 27 spaces to 16 spaces. Site History of the Parcel in question is a 10.10 acre site, fully developed with single car garages, open and covered parking. The subject parcel was developed in 2013, with a Total of 272 parking spaces, 27 of which were handicapped spaces. (See Alta Survey Drawing #1) Assessments of the subject site were conducted with the City of Meridian Planning Staff, and the Americans with Disabilities Act (ADA) for Handicap Parking Requirements, for any limitations of the site based upon current conditions. The requirements on said parcel are as follows: American with Disabilities Act (ADA) requires a Total of 7 Parking Spaces be provided for Handicap Parking in parking area with 201-300 parking spaces, of which 2 spaces must be Van Accessible. City of Meridian Staff indicated that ADA would govern the compliance of the parking. No Neighborhood Association was noted or contacted for this assessment. Evaluation of the subject parcel for the proposed parking lot modification is consistent with ADA requirements and City Staff, that of the 272 parking spaces, a reduction from 27 spaces to 16 spaces is still in excess of the required ADA minimum, and that a minimum of 2 Van Accessible Parking Spaces will still be provided in the revised provided spaces of 16 Handicap Parking Spaces. This assessment is based upon visual inspection of the site and physical meetings with the listed parties. Some agencies (such as Central District Health and public sanitation, etc) may not have been contacted if they were not specific to the site evaluation and are based upon the occupancy type, so it is possible that other restrictions may exist.
