RE: H-2016-0046 CHINDEN AND LINDER CROSSING RETAIL SHELL
The Idaho Transportation Department has reviewed the referenced conditional use application for the
Chinden and Linder Crossing Retail Shell on the northwest corner of US-20/26 (Chinden Boulevard)
and Linder Road. ITD has the following comments:
1. ITD has no objection to the requested application of placing a retail shell at this location.
2. The applicant has submitted an application for an access to the west of this project. Currently
this access has not been approved. No other access is requested and none is approved with this
application.
3. Future modifications to the Chinden and Linder Intersection include a Continuous Flow
Intersection (CFI) or a modified CFI. If an access is approved, the applicant will need to
provide property that will allow for the relocation of any required improvements when the CFI
intersection is constructed. Even if property is provided safety concerns could decrease the
access to a right-out only access or be eliminated when a CFI is constructed.
4. ITD’s corridor plan for this area of US-20/26 requires 100-ft of right-of-way as measured from
the section line in US-20/26. A typical section is shown below. This area includes 86 feet for
the construction of the future widening of the roadway and drainage and 14 feet for the
construction of the future pathway and utilities. If the City requires berms or other
improvements, they should be constructed outside of the 100 feet of right-of-way. ITD
reminds the City that keeping costs down within this corridor will help with future construction
of US-20/26.
5. Applicant must apply for and receive an approved Right-of-Way use permit prior to doing any
work or activity within the highway Right-of-Way. Please have the applicant contact Ken
Couch at 332-7190 for this application. This includes any work within the 10 foot to 20 foot
permanent slope easement north of the 70 foot ITD right-of-way.
6. No trees are allowed within the clear zone of the ITD Right-of-Way. Only planting of forage,
plants, grasses, flowers, and shrubs with a mature height not to exceed 3 feet will be allowed.
7. No rocks over 4 inches maximum size will be allowed in the ITD Right-of-Way.
8. Irrigation systems shall be no closer than 5 feet from the pavement edge and shall be adjusted
so as not to cause water to cover any portion of the highway pavement.
9. Idaho Code 40-1910 does not allow advertising within the right-of-way of any State highway
system.
10. IDAPA 39.03.60 governs advertising along the right-of-way of any State highway system. The
applicant can contact Dion Burch at 334-8355 for more information.
11. The City is reminded that the US-20/26 Corridor is already congested. This project will
increase the number of vehicle trips in the corridor. ITD has no current funding assigned to
widen US-20/26.

❑ 9. The following plan(s) must be submitted to and approved by the Idaho Department of Environmental Quality:

❑ 10. This Department would recommend deferral until high seasonal ground water can be determined if other
considerations indicate approval.
❑ 11. If restroom facilities are to be installed, then a sewage system MUST be installed to meet Idaho State
Sewage Regulations.
12. We will require plans be submitted for a plan review for any:
food establishment ❑ swimming pools or spas ❑ child care center
beverage establishment ❑ grocery store
❑ 13. Infiltration beds for storm water disposal are considered shallow injection wells. An application and fee must be
submitted to CDHD.

Nampa & Meridian Irrigation District (NMID) has no comment on the above -referenced
application as it lies outside of our district boundaries. Please contact Settlers Irrigation at
208-344.2471 or P.O. Box 7571 Boise, ID 83707.
All private laterals and waste ways must be protected. All municipal surface drainage must be
retained on-site. If any surface drainage leaves the site, Nampa & Meridian Irrigation District
(NMID) must review drainage plans.
