The property owner does request that the Council consider waiving the 25 foot landscape buffer along the waterway to the south. I owner is also interested in subdividing the property. If he moves forward with a split, can we wait until we have a project for south parcel to address the reduced buffer and landscape? I believe Maverik will agree to install landscape to the full access on Locust Grove when they do their project. Regarding the signs, we all know what needs to happen. Instead of tying the removal to a bond, can we come up with a different solution? I am ashamed to say that Maverik won the lease negotiation here and it’s not going to take much for the owner to move on. Maverik wants the signs gone was much as we do. Instead of placing the watchdog burden on the City, what if we added language in the ground lease (and included it in the DA?) that abates 100% of Maverik’s rent until the signs are removed, after 45 day following termination of the lease? I still like the idea of executing a document that transfers the leases to the City at 11:59 of the last day of the lease. The owner will also execute a document now, which terminates the leases at the end of the term to be included in the DA, if it helps. We all want the same thing. I’m just trying to come up with a way to keep this deal on track. I’m just worried there is going to be an unsurmountable delta between what the council might expect and what the owner will be able to afford or agree to. I also think it’s important for everyone to understand that the owner is NOT a developer and that the Maverik project and hopefully a project on the south parcel will be his retirement. Frankly, it’s either this or I’ll have to become a “junk yard” broker and find someone to lease the junk yard. I don’t want to be a JYB. Please help! Please let me know your thoughts.
