We have reviewed this submittal and offer the following comments, as conditions of the applicant. These
conditions shall be considered in full, unless expressly modified or deleted by motion of the Meridian City
Council:
APPLICATION SUMMARY & BACKGROUND
The applicant, T -Mobile USA, has requested Conditional Use permit (CUP) approval to construct a wireless
communications facility consisting of a 100 -foot tall steel monopole and supporting equipment in a C -G zone.
The location of the proposed tower is approximately 1,200 -feet east of Eagle Road, and approximately 1,600 -
feet south of Overland Road. The lease area for the monopole is within Lot 6, Block 2, Silverstone Subdivision.
The tower and all associated equipment for operation will be contained within a sixteen by twenty-four foot (16'
x 24') fenced -off area. Within the fencing are a battery cabinet, meter and PPC cabinet, demarcation cabinet, PCS
antennas, antenna supports, a base transceiver station, and other equipment. The applicant had indicated in their
application that the site would be fenced with a 6 -foot tall chain link fence with three strands of barbed wire at
the top. Staff is recommending that the applicant install sight -obscuring fencing. See Special Consideration "A"
below for fencing analysis.
Due to existing landscaping in the area, and the low visibility of this site, the applicant has requested a waiver of
the required 5 -foot wide landscape buffer around the compound. Staff is supportive of the waiver request. See
Special Consideration `93" below for landscape analysis.
In accordance with Meridian City Code (MCC) the applicant has submitted a letter that will allow for the co -
location of two additional wireless carrier antenna arrays in the future (NOTE: Only one is required by current
City Code). Further, the applicant has submitted adequate documentation that the wireless facility will comply
with the Federal Communication Commission (FCC) standards regarding radio frequency emissions and Federal
Aviation Administration (FAA) standards for construction.

Meridian City Code 11-22 contains standards for wireless communications facilities. Meridian City Code 11-224
requires new communications towers to obtain conditional use permit approval. Included in this report are the
required findings for conditional use permits and the City -adopted standards for wireless communications
facilities.
The applicant has addressed the requirememsfor monopole construction, compiledchartsshowingexistingand
proposed transmission coverage of the subject site, and has demonstrated to staff, through letters and other
documentation, the necessityfor a wireless communications facility in this location. Staffrecommends approval
ojrthe subject application (CUP -04-010) with the conditions contained in this report.
LOCATION & SURROUNDING USES
The subject property address is 2078 South Silverstone Way. The site is located approximately 1,200 -feet east of
Eagle Road, and approximately 1,600 -feet south of Overland Road, in Section 21, Township 3 North, Range 1
East.
The following uses surround the subject property:
North — Office building, zoned C -G
South — Office building, zoned C -G
East — Vacant (approved Silverstone Business Center), zoned C -G
West — Office building, zoned C -G
STANDARDS FOR CONDITIONAL USES
The Commission and Council shall review the particular facts and circumstances of each proposed
conditional use in terms of the following and may approve a conditional use permit if they shall find
evidence presented at the hearing(s) is adequate to establish (11-17-3):
A. That the site is large enough to accommodate the proposed use and all yards, open spaces,
parking, landscaping and other features as may be required by this Ordinance;
Staff finds that the site is large enough to accommodate the required landscaping, yards and other
features required by the Zoning Ordinance. However, the applicant is requesting a waiver to install
additional landscaping around the facility. See Special Consideration `B" below for detailed analysis.
B. That the proposed use and development plan will be harmonious with the Meridian
Comprehensive Plan and in accordance with the requirements of this Ordinance;
The Comprehensive Plan Land Use Map designates the property as "Mixed Use - Regional". Mixed
Use — Regional areas will provide a fids range of commercial, retail and residential uses. Sample uses
include: residential densities of 3 to 40 dwelling units per acre, grocery stores, drug stores, coffee
shops, salons, daycares, professional offices, medical offices, garden centers, restaurants, banks,
drive-thru facilities, service stations, department stores, entertainment uses, major employment
centers, etc. Staff finds that the proposed communications tower is harmonious with the 2002

Comprehensive Plan and Future Land Use Map. If the applicant complies with the conditions outlined
in this report, the proposed development will meet the requirements of Titles 11 and 12 of Meridian
City Code.
C. That the design, construction, operation, and maintenance will be compatible with other uses in
the general neighborhood and with the existing or intended character of the general vicinity and
that such use will not adversely change the essential character of the same area;
As a use, staff believes that a cell tower should be compatible with the residential, commercial, and office
uses that currently in the area, as well as the future uses. Applications for cell towers often bring
opposition from near -by property owners that do not believe that towers are compatible. However, ifthe
applicant as outlined in this report constructs the monopole, fencing, and other improvements, stafffinds
that the general design, construction, operation, and maintenance should be compatible with other uses in
the general neighborhood and with the existing and intended character of the area.
Due to potential opposition in the area, staff recommends that the Commission and Council rely upon
public testimony, staffs analysis, and other agency comments when determining if the proposed CUP is
compatible with other uses in the neighborhood and if the use will adversely change the existing and
intended character of the area.
D. That the proposed use, if it complies with all conditions of the approval imposed, will not adversely
affect other property in the vicinity;
If the site is designed, constructed, operated and maintained in accordance with the conditions of
approval contained herein, and the applicable City Ordinances, staff does not anticipate that the proposed
use will have an adverse affect on the other property in the vicinity.
The Council and Commission should rely upon public testimony to determine if the development will
adversely affect the other properties in the vicinity.
E. That the proposed use will be served adequately by essential public facilities and services such as
highways, street, police, and fire protection, drainage structures, refuse disposal, water, sewer or
that the person responsible for the establishment of proposed conditional use shall be able to
provide adequately any such services;
On April 9, 2004, a joint agency/department comments meeting was held with representatives of key
service providers to this property. (See detailed comments and conditions from these agencies at the
end of this report.) The Meridian Fire Department has submitted a list of needs and conditions to
adequately serve the project.
Staff finds that the proposed development will be adequately served by the public facilities and services
listed above.
F. That the proposed use will not create excessive additional requirements at public cost for public

facilities and services and will not be detrimental to the economic welfare of the community;
Staff finds that the proposed use will not create additional requirements at public cost for public facilities
and service and will not be detrimental to the economic welfare of the community.
G. That the proposed use will not involve activities or processes, materials, equipment, and conditions
of operation that will be detrimental to any persons, property, or general welfare by reason of
excessive production of traffic, noise, smoke, fumes, glare or odors;
The FCC has design guidelines for RF exposure. The applicant has submitted documentation showing
that it is unlikely that this wireless facility will expose humans to excessive RF levels. Because of the
submitted design of the facility, this use will be categorically exempt from routine compliance checks for
RF levels by the FCC. Staff does not anticipate that the proposed use will be detrimental to the general
welfare of the community by means of increased traffic, noise, smoke, fumes, glare, odors, or RF
frequencies generated by the use.
H. That the proposed use will have vehicular approaches to the property which shall be so designed
as not to create an interference with traffic on surrounding public streets;
The applicant is using the existing, previously approved, vehicular approaches to the property for the
proposed use. Staff finds that the proposed use will not create any interference with any traffic on the
surrounding public streets.
L That the proposed use will not result in the destruction, loss or damage of a natural, scenic or
historic feature considered to be of major importance.
Staff is not aware of any natural or scenic feature(s) of major importance in the area that may be affected
by the proposed development.
SPECIAL CONSIDERATIONS
A. Fencin :Meridian City Code 11-22-5.C.4 requires the base of all towers to be surrounded by a sight
obscuring security fence. The applicant had indicated in their application that the site would be fenced
with a 6 -foot tall chain link fence with three strands of barbed wire at the top. Since the submittal of
the application, the applicant has indicated to staff that a wood fence would be acceptable to them. In
accordance with Meridian City Code, the applicant should install sight -obscuring fencing rather than
chain link fence around the lease area. Said fence should be at least 6 -feet, but no taller than 8 -feet, in
height. See Site Specific Condition #2 below.
B. Landscaoing: Meridian City Code 11-22-5.C.5 requires all tower facilities to construct a minimum 5 -
foot wide landscape strip along the perimeter of the compound. However, in locations where the
visual impact of the tower is minimal, the Planning & Zoning Administrator may waive this
requirement. The applicant has worked with the landlord to locate this facility in an area that will
have the lease impact (both visually and physically) to the business park and the surrounding
community. Staff believes that the visual impacts of this tower will be minimal (see Special

Consideration `B" below). Because there is existing landscaping that will help screen the facility, and
because the applicant will be required to construct a minimum 6 -foot tall solid fence (see above
Special Consideration), additional landscaping should not be required with this application. See Site
Specific Condition #3 below.
C. Access: The applicant is proposing to utilize the existing access drive from Copper Point Drive for
this facility. Staff is supportive of the access proposal. Said access road shall have a turning radius of
28 feet inside and 48 feet outside and shall have a minimum 20 -foot wide clear driving surface,
available at all times. See Fire Department Comments and Site Specific Condition #4 below.
D. Tower Desian:
En ' germ : Meridian City Code 11-22-4.D.2 requires the applicant to submit a report from a
qualified and licensed structural engineer that describes the tower height and design. The report
should include a cross section of the tower, elevations, and a description of the tower's capacity to
accommodate antennas. The report should also include a description of precautions the applicant will
take to avoid interference with established pubic safety telecommunications. The applicant is willing
to provide the required information when the monopole is ordered after the public hearings. The
applicant is waiting to order the monopole until the public hearing process is complete, to insure that
the correct monopole is ordered. See Site Specific Condition #5 below.
Aesthetics: Meridian City Code 11-22-5.C.1 requires towers and antennas to blend into the
surrounding environment by paint or other camouflaging architectural treatment, except in instances
where the color is dictated by Federal of State authorities such as the FAA. All metal must be
corrosive resistant or treated to prevent corrosion. The applicant is proposing a plain galvanized steel
monopole with no painting. Staff recommends that the applicant paint the monopole structure and
antenna array a matte earthen color or otherwise camouflage the monopole to reduce glare and visual
intrusiveness. See Site Specific Condition #6 below.
Location: Meridian City Code 11-22-5.D.2 requires towers exceeding the maximum height allowance
of the zoning district to be setback one foot (1') for every 10 feet (10) of tower height, in addition to
the zoning district's setback requirements. Meridian City Code 11-22-5.D.4 requires towers to be set
back from all public right-of-way by a minimum of two times the height of the tower. The location of
the proposed tower complies with the above setback requirements.
E. General Requirements: Meridian City Code 11-22-5.E requires an applicant proposing a new
communications tower to demonstrate that the facility cannot be accommodated on an existing tower.
Due to existing topography and the lack of any other monopole or structure to collocate on in the
area, the applicant believes that a new tower in this location is justified (see applicant's letter).
Because there are no other monopoles or structures in this area to collocate on, and because the
applicant is designing the monopole to handle two future carriers, staff believes that the necessity for
a communications tower in this location is appropriate.
SITE SPECIFIC REQUIREMENTS
1. The project is subject to all conditions of the Development Agreement (signed with Sundance

Investments), the Conditional Use Pemlit (File No.CUP-01-002) and the Preliminary and Final Plats for
Silverstone Subdivision as approved by the City Council.
2. Install sight -obscuring fencing around the lease area. Said fence shall be at least six feet (6), but no taller
than eight feet (8'), in height.
The existing landscaping and new fencing will help screen the facility; additional landscaping shall not be
required with this application.
4. Provide vehicular access to the site that complies with the requirements of the Meridian Fire Department.
Said access shall have a turning radius oftwenty-eight feet (28') inside and forty-eight feet (48') outside
and shall have a minimum twenty -foot (20') wide clear driving surface, available at all times.
5. Prior to Certificate of Zoning Compliance (CZC) approval, submit a report from a qualified and licensed
structural engineer that describes the tower height and design. The report shall include a cross section of
the tower, elevations, and a description of the tower's capacity to accommodate antennas. The report
shall also include a description of precautions the applicant will take to avoid interference with established
pubic safety telecommunications.
6. Paint the monopole structure and antenna array a matte earthen color, or otherwise camouflage the
structure and antenna to reduce glare and visual intrusiveness.
7. All lighting, other than that required by the FAA, shall be prohibited.
8. All climbing pegs within the bottom twenty feet (20') of the tower shall be removed and shall be used
only when the tower is being serviced. The tower shall not have any catwalk, crow's nest, or platform
erected thereon except during times of construction or repair.
9. No part of any antenna, disk, array or other such item attache to the tower shall be permitted to overhang
any part of right-of-way or property line.
10. The tower shall be constructed as proposed, to allow for at least two additional antenna arrays and shall
be made available for co -location of other users.
11. Unless a time extension is granted by the City Council, an abandoned or unused communication facility
shall be removed within sixty (60) days of cessation of use as a wireless communication facility. In the
event that the tower and associated facilities are not removed within the sixty (60) days, the tower and
associated facilities may be removed by the City and the costs of removal assessed against the real
proper
GENERAL REOUIREMENTS
1. No building or other structure shall be erected, moved, added to or structurally altered, nor shall any
building structure or land be established or change in use on this site without first obtaining a Certificate
of Zoning Compliance (CZC) from the Meridian Planning and Zoning Department,

2. A building permit shall be obtained prior to the start of construction.
3. All exterior lighting shall be down -shielded or otherwise altered so that the light does not spill over onto
adjacent properties or right-of-way.
4. All development shall comply with the Americans with Disabilities Act (ADA) and the Fair Housing Act,
5. Prior to obtaining certificate(s) of occupancy, all development improvements, including perimeter
fencing, irrigation, and landscaping, unless otherwise noted in this report, shall be installed. Prior to
signature of the final plat by the City Engineer, a letter of credit or cash surety in the amount of 110%
will be required for all fencing, landscaping, pressurized irrigation, amenities, sanitary sewer, water, etc.
6. Staffs failure to cite specific ordinance provisions or terms of the approved development agreement,
annexation/zoning, preliminary plat, final plat, or conditional use does not relieve the applicant of
responsibility for compliance.
7. The subject conditional use permit may be revoked or modified by the City Council, upon notice and
hearing, for breach or violation of any condition of approval or limitation of the permit (MCC 11-17-11).
8. This conditional use permit shall be subject to the expiration provisions set forth in MCC 11-17-4.B.

In response to your request for comment, the Ada County Highway District (ACHD) staff has reviewed the
submitted application and site plan for the item referenced above. It has been determined that the Right -of -
Way and Development Services Department does not have any site specific requirements for you at this time.
If the site plan or use should change in the future, ACHD will review the site plan and may require
improvements to the transportation system at that time.
A traffic impact fee may be assessed by ACHD and will be due prior to the issuance of a building
permit. Contact ACHD Planning & Development Services at 387-6170 for information regarding impact
fees.
Prior to the construction or installation of any roadway improvements (curb, gutter, sidewalk, pavement
widening, driveways, culverts, etc), a permit or license agreement must be obtained from ACHD.

The information below is to answer questions related to Title 11, Chapter 22, Wireless
Communications Towers of the Meridian City Code. The paragraph titles correspond
with the applicable zoning code.
11-22-4(D)(1):
Please see attached letter dated April 26, 2004 from Charlie Kennamer, RF Supervisor.
The document is titled "Optional Checklist for Local Government to Determine Whether
a Facility is Categorically Excluded." The proposed wireless facility meets and is in
compliance with all FCC standards regarding RF emissions. The design and expected
traffic (caller usage) shows that this facility will meets the requirements to be
categorically excluded and is unlikely to cause exposure in excess of the FCC's
guidelines.
11-22-4(D)(2):
T -Mobile requests that this information requested in this section of code be added as a
condition of approval. The information will be provided from the tower manufacture
when the monopole is ordered after the zoning hearing. Monopoles are customarily
ordered after public hearings to insure that the correct monopole is ordered.
11-224(D)(3):
Please see attached letter dated April 23, 2004 from Mark Whitlock, Development
Manager. T -Mobile is willing to collocate with future wireless carriers.
11-22-4(D)4):
Please see attached letter dated April 26, 2004 from Charlie Kennamer, RF Supervisor.
There are three documents. They are titled NFR-Traffic Pattern Airspace Analysis",
Public Airports in Proximity of Case", and "Private Landing Facilities in Proximity of
Case". T -Mobile is in compliance with all FAA rules and regulations and will not
interfere with any air traffic patterns.
11-22.4(D)(5):
The attached propagations charts show that need for the additional coverage in the
business park and surrounding neighborhood.
The proposed site is meant to cover two main objectives.
1) To provide better coverage to wireless phone users in the area. Coverage does
exist in the area, however with the new construction of the business park, the coverage
does not penetrate inside the buildings. This proposed facility will allow for users to
have "in building" coverage.
2) To provide additional capacity to the business park. Even if the "in building"
coverage was adequate for the area, the existing infrastructure will not be able to
handle the growth of wireless phone users in the area. As the business park is
developed and new business start occupying the spaces, the use of wireless phones in
the area will increase. For example, T -Mobile is currently construction a call center that
will employee up to 700 people. This is potentially an additional 700 wireless users that
will be present in the area in the next 3 to 6 months.
11-22-4(D)(6):
In October 2003 Larson Architects, who represent Sundance Investments, obtained
input and approval from the Meridian Planning Commission regarding this proposed
location. Meridian planning staff, the Planning Commission, and City Counsel all
thought that this location was the best place to install a new wireless facility.
The surrounding area consists of flat topography with commercial building construction
for warehouse, distribution, and general business use. The are is zoned C -G (General
Retail and Service Commercial). New construction predominates the surrounding area.
This includes T -Mobile's new call center located just south of this proposed facility.
The proposed tower height of 100' is so that there will not be any natural or manmade
impediments to obstruct the adequate wireless phone transmissions. The proposed
facility was designed to provide coverage to the business park and the new T -Mobile
call center.
T -Mobile has worked closely with landlord (The Sundance Company) to locate this
facility in an area that would be the least impact (both visually and physically) to the
business park and the surrounding community. There are other physical locations
within the business park and surrounding area, however to provide adequate wireless
transmission coverage inside buildings throughout the business park, to be located in
an area that was to produce the least visual and physical impact to the business park
and any residential areas, to be located in an area as far from public roads as possible,
and for the facility to best integrate within the existing T -Mobile system, this location
proved to be the best.
T -Mobile did look at the possibility of collocating on an existing structure but with the
lack of any existing verticality in the area for over a half mile distance, this was not an
option.
11-22-5(Cx1):
T -Mobile proposes a plain galvanized steel 100' monopole with no painting. It will be a
galvanized finish similar to most city light poles. If the Planning Commission and/or staff
request that a the tower be painted, T -Mobile is willing to modify the plans and paint the
monopole as requested.
11.22-5(C)(4):
The proposed application drawings show a chain link fence surrounding the lease area.
T -Mobile is willing to accept a zoning condition to change this to a solid wood or
enclosure. T -Mobile believes that a 6' high wood fence would look best in this area.
11-22-5(Cu5):
T -Mobile USA requests that the requirement for a landscape buffer be waived for this
proposed facility. The location was chosen because it was in an area where there is a
pre-existing landscape installed. This includes an over 50% mix of evergreens. Please
refer to the picture below showing the site location from the West.
11-22-5(E)(2):
As stated above in section 11-22-4(D)(6) above T -Mobile has worked closely with
landlord (The Sundence Company) to locate this facility in an area that would be of the
least impact (both visually and physically) to the business park and the surrounding
community.
Existing verticality was not an option because it does not exist in the area. There are no
other monopoles or structures to collocate on. With this being a new corporate and
business park development, no other wireless carrier has developed a monopole to
collocate on. T -Mobile's proposed monopole is being designed to handle up to three (3)
wireless providers (T -Mobile and two other carriers).
11-22.5(E)(3):
The proposed monopole is to be 100' high. T -Mobile will design this structure to handle
three (3) wireless carriers antennas (T -Mobile and two future carriers). This will comply
with Meridian City Zoning Code 11-22-5(E)(3) where a tower of 110' is to accommodate
at least two additional users.
11-22-5(G):
T -Mobile accepts a condition to be added to the approval of the conditional use permit
that within sixty (60) days of the termination of the lease with the landlord, T -Mobile will
removed and the lease area will be restored to its original state minus normal wear and
tear.
The lease agreement with The Sundance Company does not have language that can
be submitted to the City of Meridian stating the requirement to remove the wireless
facility upon termination of the lease.
11-22-6:
On Monday, April 12, 2004, T -Mobile USA through its agent Clark Harris visited all
available neighbors within 600' of the proposed site. The intention of this was to explain
the proposed application and to determine if there was any public input. There was no
negative feedback regarding the proposed facility.

Requirements" as outlined in the Staff Report dated May 3, 2004 for CUP -04-010.
