Schuerman P&Z Commission Hearing Date: May 6, 2004 Recommendation: Approval. Summary of Public Hearing: The Applicant, Fred Schuerman, testified in favor of the application. No members of the public testified on this item. Key issues of discussion and questioning by Commission included: Sanitary sewer and water service Application fees associated with Area of Impact boundary adjustments Key Commission Additions/Modifications to Staff Recommendation: Staff did not provide a recommendation to the Commission in the staff report. The Planning and Zoning Commission voted to recommend approval of the applicant's request to remove 1.6 acres from the City's Area of Impact. The Commission modified the staff report by removing the paragraph titled "Miscellaneous" on page 2 of the report (see below). This paragraph deals with the lack of a fee associated with processing requests for Area of Impact adjustments. Staff will be brinane back to the Council a reauest to establish a separate fee for processrne these applications in the future. NOTE: Staff inadvertently included language requesting that the City assess a fee for the subject application (sentence #4 below). The applicant paid the fee for a Miscellaneous Application, and should not be assessed additional Planning and Zoning fees for processing the subject application. The property is 1.6 acres in size and is located on the north side of Fairview Avenue, approximately 300-feet east of Venture Avenue, in Section 4, Township 3 North, Range 1 East. 2. Fred M. Schuermari is the current owner of the subject property and he has submitted an affidavit of legal interest to allow the application to be submitted on the subject property. 3. The Applicant is Fred M. Schuerman. 4. The subject property is located in Ada County and is zoned RUT. 5. The Applicant requests the Miscellaneous Application to remove the subject parcel from the City of Meridian Area of Impact. 6. The Planning and Zoning Commission recognized the concerns of Fred Schuerman, expressed at the public hearing. RECOMMENDATION The Meridian Planning and Zoning Commission hereby recommends to the City Council of the City of Meridian that they approve the requested Area of hnpact adjustment requested by the Applicant for the property described in the application.
