ENCROACHMENT AGREEMENT

This Agreement, made and entered into this _t day of April,
1978, by and between RONNIE T. HOPPINS and GAYLA R. HOPPINS, hus-
band and wife, hereinafter called Sellers, and MICHAEL L. ANDERSOUn
and DONNA J. ANDERSON, hereinafter called Buyers,
WITNESSETH:
THAT WHEREAS, the Sellers are the owners of the SWa SWa cf
Section 4, Township 3 North, Range 1 West, Boise Meridian, Ada
County, Idaho, and
WHEREAS, Buyers are purchasing from Sellers the Wi W2 of the
SWa SWa of Section 4, Township 3 North, Range 1 West, Boise

Meridian, Ada County, Idaho, and
WHEREAS, this purchase by the Buyers from the Sellers is
being made without a formal survey of the property being conducted
at this time,
NOW, THEREFORE, IT IS HEREBY AGREED by and between the pa.rtia
hereto as follows:
1. Any fences or other improvements erected or constructed
after date of this Agreement, which if subsequently determined
by survey shall encroach upon the property of 'the other party
shall be moved or removed at the request of the owner on whose
property the encroachment occurs. In the event that the fence
or other improvements shall not be required to be removed imme-
diately following the survey, it is understood and agreed the-:
the fence or other improvement is being permitted to remain wi:h
the consent of the other party, and that there shall be no adv�r-e
possession against the property of the party upon whose property
the encroachment exists.

this agreement shall have a permanent easement to so remain as
situated as long as the buildings remain and are put to their
present use, which easement shall also include an additional
ten (10) feet around the neri.meter of the encroachment which s
be used for access only.
3. This agreement shall be binding upon the heirs, succes
assigns and personal representative of the parties hereto.
IN WITNESS WHEREOF, the parties have executed this agreement
