Meridian City Code § 12-3-7 on Apri120, 2004, and tabled until Apri127, 2004, and the Council
Ending that the Admirtistrative Review is complete from Wendy Kirkpatrick, AICP, Associate City
Planner, and Bruce Freckleton, Engineering Technician III, dated: Hearing Date: April 20, 2004, to
the Mayor and Council, a~ that Anna Powell Planning Director for the Planning and Zoning
Department, commented at the hearing, and the Council having considered the requirements of the
preliminary pint the Council takes the following action:

The Cerrtral District Health Department requires after written
approval from tbe appropriate entities are submitted, they can approve
this proposal for central sewage and central water; that plans must be
submitted to and approved by the Idaha Department of Health and
Welfare, Division of Environmental Quality for central sewage and
central water; that nxn-off is not t® create a mosquito breeding
problem; and it is suggested that stormwater be pretreated through a
grassy swale prior to discharge to the subsurface to prevent impact to
groundwater and surface water quality; that engineers and architects
should obtain current best management practices for stormwater
disposal and design a stormwater management system that is
preventing groundwater and surface water degradation. Manuals for

1.2 Adopt the Recommendations of Brent A. Claibom of Claibom Waite
Consulting, LLC, regarding the new ACRD roadside drainage Swale
ahernative ss follows:
1. Development improvemer-t plans were submitted to ACRD for
their review on February 23, 2004, and review comments were
received March 25, 2004. The review comments specifically
addressed the stormwater drainage system and do not allow
using the stormwater pond with lift station for off-site discharge.
2. A rneetir-g was held with ACEID to review their determination
on April 1, 2004. At that meeting, ACI-ID personnel confirmed
that the ACIID drainage policy does not allow the pumping
systems for stormwater facilities as designed for SAGELAND
due to existing topographY•
3. During the meeting, and while reviewing conditions existing
topographic limitatiar~ and high groundwater} on the
SAGELAND site, ACIdA offered' and recommended that an
investigation using their newly adopted Roadside Infiltration
Swale as a drainage design alternative be done. This design
alternative was only adopted by the ACRD Commission on
February 25, 2004.
4. Following the meetmg and the 04/05/2004 meeting with ACFID
and Bruce Freckle~on, Meridian DPW, an evaluation design
alternative was done. Are-desigaof SAGELAND to utilize the
ACIdD Drainage Swale ahernative was prepared and revised
plans shall be submitted for the City and ACRD to review.
5. After consulting with the Project Geotechnical Engineer ACRD,
and the City of Meridian, this alternative is the solution for
SAGELAND stomewater drainage.

2. The final plat upon which there is contained the Certification and signature ofthe City
Clerk and phe City Engineer verifying that the plat meets the City's requirements shall be signed only
at such time as:
The Plat dimensions are approved by the City Engineer; and
2. The City Engineer has verified that all off-site improvements are completed
and/or the appropriate letter of credit or caste has been issued guarameeing the
completion of off-site and required on-site improvements.
NOTICE OF FINAL AG'I'ION
AND RIGHT TO REGULATORY TAILINGS ANALYSIS
The Applicant is hereby notified that pursuant to Idaho Code 67-8003, the Owner
may request a regulatory taking analysis. Such request must be in writing, and must be filed with
the City Clerk not more than twenty-eight (28} days after the final decision concerning the matter
at issue. A request for a regulatory takings analysis will toll the time period within which a
Petition for Judicial Review maybe filed.
Please take notice that this is a final action of the governing body of the City of
1VIerrdian, pursuant to Idaho Code § 67-6521. An affected person being a person who has an
interest in real property which maybe adversely affected by this decision may, within twenty-eight
(28} days after the date of this decision and order, seek a,{urlicial review as provided by Chapter
52, Title 67, Idaho Code.

We have reviewed the above-referenced submittal and offer the following comments, as
eond'rtions of approva4 These conditions shall be considered in full, unless expressly
modified or deleted by motion of the Meridian City Council:
APPLICATION SUMMARY & LOCATION
The applicant, Quasar Development, LLC bas requested approval for Sageland Subdivision.
This subdivision consists of 41 single-family residential building lots and 10 common area lots
on 10.64 acres in 8r1 R-8 zone. The gro3.4 density is approximately 3.85 dwelling units/acre. The
net density is approximately 4.69 dwelling units/acre.
Sageland Subdivision is located at the northeast corner of Victory Road and Locust Grove Road.
A Conditional Use Permit for a Planned Development was approved for this project. The CUP
allowed for the minimum lot size to be reduced to 5,000 s.€. for detached homes and fora 5'
rear setback for garages.
A revised landscape plan rids to be s~rbmitted depicEing the addition of roadside infiltration
swales to the subdivision plat. The swaies were required by ACHD after the preliminary plat
was approved by Council. The addition of the swales will result in the proposed subdivision's
sidewalks being shined to an easement on the subdivision lots. Approximately 2' of the width of
the sidewalks will be located inside the subdivision lots. With this added condition, staff has no

objection to the sidewalk easement. Staff has added a cor-dition stating that setbacks shall be
measured from the sidewalks not property line.
Staff recommends approval of Sagehend Subdivision with the comments and conditions stated in
this report.
STTE SPECIFIC REOLfIR.EMENTS/FINAL PLAT
1. Applicant shall meet. a@1 terms of the approved Preliminary Plat (PP-03-020}, Planned
Development (CUP-03-036), Anne~cation and Zoning (AZ-03-015} and Development
Agreement (Inst. #104033485).
2. The pressurised irrigation system within thes developmem is to be owned and
maintained by the Nampa & Meridian Irrigation District. The City of Meridian requires
that pressurized irrigation systems be supplied by a year-round source of water. If a
creek or well source is not available, asingle-point connection to the culinary water
system shall be required. If a single-point connection is utilized, the developer shall be
responsible for the payment of assessments for. the common areas prior to signature on
the final plat by the Meridian City Engineer.
3. A revised landscape plan west be submitted depicxing the roadside infiltration swales
and all trees vehicle will be relocated from the originally approved landscape plan due to
the addition of the swales.
4. Sidewalk easements and shared driveways must be depicted on the revised final plat.
5. Fencing shall be constructed in conformance with the Prelimir-ary Plat Findings of Fact
and Conclusions of Law and MCC 12-4-10.
6. Sanitary sewer service to this site shall be via mainline extension from the trunk line
installed for the Tuscany Village development. Applicant will be responsible to
construct the sewer mains to and through this proposed development. Subdivision
designer to coordinate main sizing and routing with the Public Works Department.
7. Municipal water service to this site shall be via main line extensions from existing
mainlines installed adyacxret to the proposed developmem. Applicant will be responsible
to construct the water mains to and through this proposed development.
8. Applicant shall be required to pay Public Works development plan review, and
construction inspection fees, as determined during the plan review process, prior to
signature on the final plat per Resolution 02-374.
9. Complete the Certificate of Owners and its accompanying Acknowledgement.

10. The bearing and distance calls on the face of the plat don't match the bearing and
distance calls in the legal description of the Certificate of Owner's. Please make the
appropriate revisions.
11. Graphically depict eight (8') foot wide public utilities, drainage and irrigation easements
along the south side of Lot 13, Block 2, and the north side of Lot 6, Block 2: The extra
width is acquired due to the location of the pressurized irrigation mains.
12. Applicant shall add a permanent shared access easemem, centered on the lot line
between Lots 17 & 18, and Lots 19 & 20 Block 2; Lots 17 & 18, Block 1 for the
purpose of a common driveway. The access easement shall be a minimum 20 feet wide
by 20 feet long for Lots 17-2Q Block 2, and 40 feet tong for Lots 17 & 18, Block 1.
Add a reference for each case to plat Note #9.
13. Please revise the Landscape Plan as follows:
a. Stomrwater swales must. meet standards outlined in Section 12-13-14-2a of
Meridian's Zoning Ordinance.
b. Contour lines must be shown on landscape plan.
c. Roadside infihration swales must be shown on landscape plan.
d. Show where trees which were originally located in the swale azeas will be
relocated.
14. Please add or revise the following plat notes:
6. All rear lot lines and those common to a public right-of--way have a ten (10')
foot wide permanent public utilities, drainage, street light and irrigation
easement, except for [hare dots with sidewalk encroachment, in those cases the
easement width shall be twelve(12) foot.
9. Re-word.- A cross access easement is herby dedicated for the purpose of shared
driveways.
11. Complete recording information.

by an imgation/drainage district.
13. Front yard setbacks shall be measured from back of sidewalk for dots where

14. Building setbacks and dimensional stmulitrds in this subdivision shall be in
compliance with Title II and Title 12 of the Meridian City Code unless otherwise
modified by Conditiovral Use Permit (CUP-03-036) which allowed for redarced
setbacks oral lot sizes.
15. Stags failure to cite specific ordinance provisions or terms of the approved preliminary
plat, conditional use permit or development agreemem does not relieve Applicant of
responsibility for compliance.

GENERAL REQUIREMENTS
All irrigation ditches, laterals or canals, exclusive of natural waterways, intersecting,
crossing or lying adjacent and contiguous to the area being subdivided shall be tiled per
City Ordinance 1211-13. Plans will need to be approved by the appropriate
irrigation/drainage district, or lateral users association, with written confirmation of said
approval submitted to the Public Works Department.
2. Any existing domestic wells and/or septic systems within this project will have to be
removed from their domestic service per City Ordinance Section 9-1-4 and 9-4-8. Wells
may be used for non-domestic purposes such as landscape irrigation.
Street signs are to be in place, water system shall be approved and activated, pressurized
irrigation system approved and activated, drainage lots constructed, fencing installed,
and road base approved by the Ada County Highway District prior to applying for
building permits. All' development improvements, including fencing, micro-paths,
irrigation, and landscaping shall be installed and approved prior to obtaining certificates
of occupancy. A letter of credit or cash surety in the amount of 110•~o will be required
for all fencing, pressurized irrigation sanitary sewer, water, etc., prior to signature on the
final plat.
4. Two-Hundred-fifty watt (250w) and One-Hundred watt (100w), high-pressure sodium
streetlights will be required at locations designated by the Public Works Department. All
streetlights shall be installed at subdivider's expense. Typical locations are at street
iffiersections and/or fire hydrants. Final design locations and quantity are determined
after power designs are completed by Idaho Power Company. Street light contractor to
obtain design and permit from the Public Works Department prior commencing
installations.
5. Compaction test results must be submitted to the Meridian Building Department for all
building pads receiving engineered backfill, where footing would sit atop fill material.
6. Submit "Final" letter from the Ada County Street Name Committee, approving the
~rbdivision and street names. Make any corrections necessary to conform.
Applicants engineer will be required to submit a signed, stamped statement certifying
that all street finish cemerline elevations are set a minimum of three feet above the
highest established normal groundwater elevation.
8. Coordinate fire hydrant placement with the City of Meridian's Water Deputy Fire Chief
and the Public Works Department.

9. Provide five-foot-wide sidewalks in accordance with City Ordinance Section 12-5-2.K.
Sidewalks are to provide a clear five-foot-wide (four feet if detached) walkway pathway
without encroachment of mailbox structiues.
10. All development shall comply with the Americans with Disabilities Act and the Fair
Housing Act.

RECOMMENDATION
Staff recommends approval of the final plat for Sageland Subdivision with the above stated
comments and conditions.

We have reviewed the Staff report for our request for Final Plat Approval of 41
single-gamily Residential Building lots on 10.64 acres in an R-8 Zone for Sagelaud
Subdivision and agree with the staff recomroendationawhh the exception of items
mentioned below:

Item #3)
We will revise the landscape plan to show the swells and changes required by
ACRD, however, according to ACRD they will allow for our trees shown on our
current landscape plan to remain in the area of the swells. I have also verified
that the type of trees we are placing in the swell area are acceptable to ACRD.
Therefore, we will not need to relocate the trees as shown oo the Current
Landscape plan.

We are re-routing the irrigation mains so they will not be located on or near lot
13 block 2 and lot 6 block 2, therefore there will not need be a requirement for
he 8' wide easement on those two lots.

As stated earlier, we will nat need to relocate the trees on the revised landscape
plan.
Item #14 number 6
Because of the PD and approved reduced setbacks for rear lot lines, the staff
comment on this item will not work, we will show the 8 ft. easements on lots 16,
17 and 18 Block 2.
