Dear Mr. Huber: We have received your letter requesting a waiver of the requirements to use surface irrigation water as your primary irrigation source for your Shops at Victory Subdivision project. At this time we find that your supporting evidence does provide adequate proof that the surface water distribution is inconsistent and not dependable for a pressurized irrigation system, and therefore we are granting your request with the following condition: The existing irrigation ditch crossing the property shall be relocated and piped in such a way that it would not preclude the conversion and utilization of irrigation water in the future if better supply becomes available. 1 This letter shall serve as our official decision and waiver of the requirements to utilize surface irrigation water as the primary source for irrigation within the Shops at Victory Subdivision project. The reason for the waiver request is that at this particular location water distribution is inconsistent and therefore,not dependable. The project is a relatively small commercial development. We understand that the available non-potable irrigation sources from the canals in the area cannot provide reliable water and would risk the project's landscape health. We have calculated the size of the project landscape areas as follows: • Phase 1 developed landscape area: 40,000-sf • Estimated future landscape to be added with development of Pad B and Pad C areas: 10,000-sf Therefore the total estimated landscape area at complete site buildout will be 50,000-sf. Jeffrey C.Huber: The above-mentioned property is serviced by the United States' McDonald Lateral and is a part of a rotation. A rotation is when there are two or more water users serviced by one delivery point off of our system. This particular rotation has five water users on it and the rotation manager is Mr. Bob Aldridge who is responsible for ordering the water and setting up a schedule to accommodate the other users. Whereas the Boise Project's water is mainly supplied from water held in storage from Arrowrock and Anderson Ranch Reservoirs, the amount of water available varies from year to year depending on weather conditions. Our water supply is also a finite resource that needs to be managed by the end user to insure that they don't run out of water during the middle of the summer months. We strive to service our patrons in a reliable and consistent manner, however, our water must be ordered 24 hours prior to wanting it, then used for a 24 hour block of time and shut offs require a 24 hour notice. This is due to the fact that the Boise Project regulates our canal systems up and down daily, depending on customer usage, to conserve this precious water resource. As this property is developed into a commercial center and the landscaping will be a minimal portion of this property, the Boise Project can see where it may be more practical to utilize city water in this case.
