Your approval of the subject application is conditioned upon ongoing compliance with the standards forborne occupations listed in Unified Development Code (UDC) 11-4-3-21, including but not limited to, the following: A. In no way shall the home occupation cause the premises to differ from its residential character in the appearance, lighting, signs, or in the emission of noise, fumes, odors, vibrations, or electrical interference. B. The home occupation shall be conducted entirely in the dwelling, and not more than twenty-five percent (25%) of the gross floor area of said dwelling shall be used for a home occupation or for storing goods associated with the home occupation. Materials may be stored in an attached garage or storage area, provided it shall not reduce the required off-street parking below the standard established for that district. C. No activity connected to the home occupation or any storage of goods, materials, or products connected with a home occupation shall be allowed in any detached accessory structure. D. The home occupation shall not have more than two (2) out -going pickups per day from a common carrier. E. The home occupation shall not serve as a headquarters or main office where employees come to the site and are dispatched to other locations. G. No retail sales shall be permitted from the dwelling except the sale of 1) services or items produced or fabricated on the premises as a result of the home occupation; or 2) products secondarily related to the personal service aspect of the home occupation; or 3) products sold online that are delivered to customers by mail. H. Off-street parking shall be provided as set forth in UDC 11-3C-6, in addition to the required off-street parking for the dwelling.. I. All visits by clients, customers, and/or employees shall occur between the hours of 8:00 a.m. and 8:00 p.m. J. The home occupation shall only be allowed as an accessory use to an allowed residential use. If you fail to maintain compliance with the above standards or limitations your approval may be revoked or modified by City Council in accord with UDC 11-1-11D. The Applicant, Director, or a Party of Record may request City Council review of a decision of the Director. All requests for review shall be filed in writing with the Planning Division of the Community Development Department on or before February 23, 2016, within fifteen (15) days after the written decision is issued, and contain the information listed in UDC 11 -5A -6B. If City Council review of the decision is not requested, the action of the Director represents a final decision on a land use application. APPLICATION SUMMARY The applicant, Hannah Curtis, has requested approval for a home occupation to operate a photography studio out of her home located at 744 W Pickford Street, Meridian, Idaho. LOCATION The property is located at 744 W Pickford Street. APPLICABLE CODE The property is zoned R-8, which allows for a home occupation with written approval from the Planning Director. Section 11-4-3-21 of the Unified Development Code (UDC) for the City of Meridian lists specific criteria for home occupations, which serve clients or have a nonresident employee: A. However, UDC 11-3C-7 allows for parking alternatives. The clubhouse parking area is for the use of the residents and can therefore be applied as an alternative to meet the parking requirement. This legal document is provided to each homeowner during financial closing, and each homeowner is expected to abide by its conditions. Owners Assessments Under authority in the CC&Rs, the Owners association levies and collects assessment from each homeowner. Financial statements, which reflect the use of the assessments, are prepared regularly and are available to all Owners. The assessments are subject to change depending on the decisions of the board of directors and the needs of the association. Community Center General Policy - The Community Center in Paramount is intended for use by the members and guests of our community. Please join us in keeping all neighborhood amenities clean and safe for all by following these rules and guidelines. The Board may immediately terminate an Owners rights to use the Community Center in the Board's discretion upon an infraction of these rules and guidelines. No Liability — Each person who uses the community center and pools assumes personal responsibility for any injury or accident that may occur there. The Owners Association is not liable or responsible for any such injury. Users assume all risk in utilizing the community center and the equipment and facilities located within. There are no lifeguards on duty at the pools. Open and Close — Pools are open from Memorial Day to Labor Day each summer. Pool hours are 8:00 a.m. to 10:00 p.m. These times are subject to change. The pool, deck and patio areas must be vacated by 10:00 p.m. each day during the season. The period from 8:00 p.m. to 10:00 p.m. is considered "quiet time" when all community center users should keep noise and other sounds to a minimum. Fitness equipment and facilities and the dressing rooms are available year round from 5:00 a.m. to 10:00 p.m. daily and must be vacated by 10:00 p.m. each day. The community center is available for private parties and other events year round by reservation only. Community Center Parking — Over night parking is not allowed in the community center lot. Community Center Access — One electronic key card is issued to each household. Do not lend your key card to another person. Lost key cards can be replaced for $25 each. All persons using the facilities do so at their own risk. Owners and managers will not be responsible for accidents or injuries. 2. Only Association Homeowners in good standing may use the recreational facilities. Doors and gates shall be kept locked at all times. 3. Members must be 13 years of age or older in order to use the facilities alone. All members under the age of 13 years must be accompanied by an adult at all times. 4. Guests are permitted if accompanied by member of the Association in good standing. Children and youths guests must be invited by an adult 18 years or older, and the adult shall assume responsibility of their guests. 5. Pool hours of operation are from 8:00 am to 10:00 pm Monday through Sunday, Memorial Day weekend through Labor Day weekend. Quiet hours are from 8:00 pm to 10:00 pm. 6. The community center and gym is open from 5:00 am to 10:00 pm. Quiet hours are from 8:00 pm to 10:00 pm. The meeting rooms are available for private reservations. 7. There is to be no overnight parking at any facilities. 8. One (1) key will be activated per household, and lost keys may be replaced for a fee of $25.00. 9. All users must shower before entering pool. 10. Members are responsible for reporting any damage to the facilities, and all costs will be billed to the responsible parties. 11. NO RUNNING, JUMPING, DIVING, ROUGHOUSING, or similar at the facilities. 12. No inappropriate behavior—yelling or other loudness. There is "Zero Tolerance" for foul or abusive language or behavior, including touching. 13. Use of pool toys, balls and floatation devises must be used with consideration for others using the pool. Innertubes and oversized floatation devices are not permitted. Any left items will be thrown away. 14. No bikes, skate boards, skates, roller blades, scooters or similar are permitted on the premises 15. No glass or glass containers are permitted, plastic containers only. 16.
