Broadway Street Meridian, ID 83642 RE: Reflection Ridge Subdivision No. 5 Final Plat Submittal Dear Honorable Mayor and City Council Members, On behalf Mission Coast Properties 11), Inc., and Schultz Development LLC, this letter is to accompany the Final Plat submittal for Reflection Ridge Subdivision No. 5. The overall 92 acres site was approved by City Council pursuant to RZ-08-005, PP -08-010, and VAR -09-006 on November 24, 2009. The submitted final plat for the 5'11 phase on 18.88 acres consists of 53 building lots and 9 common lots. The final plat substantially conforms to all of the requirements and conditions of the approved Preliminary Plat with minor exceptions: 1. The site layout was improved to better follow the hillside topography of the site and the orientation and location of some streets were altered slightly without changing the approved total buildable lot count. In addition, we have attached an Amenity Summary and Qualified Open Space Analysis showing the "qualified" open space for the site totaling 19.7% and exceeding the 17.9% approved on the original preliminary plat. 2. The Farr Lateral on the south boundary of Phase 5 and Phase 6 is within a 40 foot -wide exclusive easement for the Boise Project Board of Control and Bureau of Reclamation. As such, no improvements, pathways, or sprinkler irrigation systems are allowed. After consulting with City Planning and Parks Department Staff, we have been given administrative approval to relocate the Farr Lateral Regional Pathway and construct it as a 10 -foot -wide sidewalk with an 8' planter strip behind the south curb of E. Crest Ridge Drive through Phase 5 and Phase 6. 3. We are requesting City Council approval of a waiver of piping the majority of the Farr Lateral adjacent to Phase 5 and Phase 6 (see attached exhibit). The 40 foot -wide common lot for the Farr Lateral will be fenced off with vinyl fencing at the rear of the adjacent lots by the developer. In addition, the area will be owned and maintained by the Reflection Ridge Homeowners Association in its existing state with ditch rider access roads on either side. Due to the required size of 30 -inch diameter, we are requesting the Waiver in conformance with other piping waivers of similar size granted previously on other projects. We have commenced final plat and development plan design and request official approval of our request to move the 10 -foot wide pathway due to the Boise Project Board of Control not allowing pathways within the Farr Lateral easement. In addition, the elevation drop in the rear of the lots abutting the lateral is significant and would complicate construction of the pathway immediately adjacent to the Farr Lateral easement. As such, we request permission to design the 10' pathway within the parallel roadway in front of the adjacent lots instead of the rear of the lots. The attached cross-section indicates the 10' concrete sidewalk will be located within the ACRD right-of-way between an 8' tree -lined planter strip and 2' of the adjacent front yard landscaping.
