(File No. PP-04-003) We have reviewed the above referenced submittals and offer the following comments, as conditions of approval. These conditions shall be considered in full, unless expressly modified or deleted by motion of the Meridian City Council: APPLICATION SUMMARY The applicant, Shawn Fickes, has applied for preliminary plat approval of a two (2) lot industrial subdivision, located on a 2.7 acre lot within the previously approved Cafazelli Subdivision, located on 1950 West Franklin Road. This subdivision is a resubdivision of Lot 1, Block 1 of Caffarelli Subdivision. The two proposed subdivision lots are 1.20 and 1.50 acres in size. Both proposed lots meet all dimensional standazds for the I-L zone. LOCATION AND SURROUNDING LAND USES The subject property is located approximately'/a mile west o$he northwest intersection of Franklin Road and Linder Road. The following uses surround the subject property: North -Industrial use, zoned I-L. The Meridian School District owns the property located northwest of the subject property. The school district plans to site a bus depot on this property. The Eight Mile Lateral is located directly to the north of the subject property. South -Franklin Road is located directly south of the subject property. Property located south of Franklin Road is zoned RUT (Ada County.) West -Owned by SSC, zoned I-L. SSC may site a transfer station on this property in the future. East - Reyco, Cafarelli Subdivision, zoned I-L. PRELIMINARY PLAT FINDINGS AND REQUIREMENTS Sections 12-3-3 J.2 and 12-3-5 D read as follows: "In determining the acceptance of a proposed subdivision, the Commission/Council shall consider the objectives of this title and at least the following: a. The conformance of the subdivision with the Comprehensive Development Plan; Staff finds the subdivision to be in conformance with the City's adopted Comprehensive Plan. The Future Land Use Map depicts the property as "Industrial" which allows for the proposed industrial subdivision. b. The availability of public services to accommodate the proposed development; Staff finds that public services, including water, police, and fire, are available to accommodate the proposed development, however the subject site is not serviceable via the City of Meridian's gravity sewer system. The applicant proposes to utilize individual grinder pumps on each lot that would pump to an existing manhole east of the subject site. c. The continuity of the proposed development with the capital improvement program; Staff finds that the subdivision will not require the expenditure of capital improvement funds. Since the proposed subdivision is a resubdivision of a previously platted lot, services, as mentioned above, are already available to the site. d. The public financial capability of supporting services for the proposed development; Staff fords that the development will not require major expenditure of public funds for providing supporting services. Since the proposed subdivision is a resubdivision of a previously platted lot, services, as mentioned above, aze already available to this site. e. The other health, safety or environmental problems that may be brought to the Commission's attention. 2 Staff finds that there should not be any other health, safety or environmental problems associated with this subdivision to be brought to the Council or Commission's attention that have not been addressed previously. SPECIAL CONSIDERATIONS Private Road The two proposed subdivision lots will not have access to the private road located immediately to the west of the subject property. The applicant will be required as a condition of approval to fence the western side of the subject property to prevent usage of the private road by tenants of the proposed subdivision. The private road is being constructed by Joint School District No.2 and will not be dedicated to the public until development north of the private road is completed by the school district. SSC will pay for half of the construction costs of the private road if SSC uses the road to access their property in the future. The date for the dedication of the private road to the public is not known. Pressurized Irri ag tion The applicant has requested a waiver from the requirement to install a pressurized irrigation system. The applicant is making this request because Cafarelli Subdivision was previously approved without a pressurized irrigation system. The existing landscape buffer is supplied with irrigation water from the City's domestic water system. Public Works supports this waiver request. Access to Lot 1 Access for the proposed Lot 1 will be provided by a cross access easement. The easement depicted on the preliminary plat is only 15' in width. The applicant's engineer has indicated that a 15' easement exists on the adjoining lot in Cafazelli Subdivision No. 1 and that this easement along with the proposed 15' easement for Cafarelli Subdivision No. 2 will be used together to provide a 30' cross-access easement for the subject property. This easement must be shown on the preliminary plat and the width of the cross access easement (the total combined easements from the two subdivisions) must be a minimum of 25' in width. Additionally, a vehicle turnaround at the end of the cross access easement must be approved by the Meridian Fire Department for Lot 1, Block 1 of the proposed subdivision. Prior to City Council, a revised plat showing the vehicle turnaround and the cross access easement must be submitted. Sanitary Restrictions There is currently a sanitary restriction on Lot 1. Block 1 of Cafarelli Subdivision No. 1. The subject site is not serviceable via the City of Meridian's gravity sewer system. The applicant proposes to utilize individual grinder pumps on each lot that would pump to an existing manhole east of the subject site. Ultimately, this subdivision will be serviceable via an extension of the future Black Cat Trunk Sewer. Staff believes that a better solution to provide service would be for the developer/applicant to install a single pump station adjacent to the Franklin Road frontage, that would pump to the existing manhole east of the subject site. When the future 3 Black Cat sewer is installed in Franklin Road, the individual service lines could then be connected directly, and the pump station taken out of service. With the recordation of the final plat, sanitary restrictions would be lifted under this scenario. (See condition No. 2 Below) CONDITIONS OF PRELIMINARY PLAT Domestic water service to this site shall be via main line extension from the existing mains adjacent to the property. Subdivision designer to coordinate main sizing and routing with the Public Works Department. 2. Sanitary sewer service shall be provided via a single pump station adjacent to the Franklin Road frontage, that would pump to the existing manhole east of the subject site. When the future Black Cat sewer is installed in Franklin Road, the applicant shall be responsible for the connection of the individual service lines, and the decommissioning of the pump station. Please submit all updated groundwater/soils monitoring data to the Public Works Department for review. The original study report indicates that shallow groundwater may be a factor. All drainage areas (detention/retention basins) must be designed to ensure that water is retained only during 100-year storm events, and for a period of time not to exceed 24 hours. Side slopes within drainage areas shall not exceed 3:1. The project engineer should pay close attention to the results of field studies determining the groundwater, soil type & and characteristics during the design and construction phases. The engineer shall be required to certify that the street centerline elevations aze set a minimum of 3-feet above the highest established normal groundwater elevation. 4. A drainage plan designed by a State of Idaho licensed architect or engineer is required and shall be submitted to the City Engineer (Ord. 557, 10-1-91) for all off-street parking areas. Storm water treatment and disposal must be designed in accordance with Department of Environmental Quality 1997 publication Catalog of Storm Water Best Management Practices for Idaho Cities and Counties and City of Meridian standazds and policies. Off-site disposal into surface water is prohibited unless the jurisdiction which has authority over the receiving stream provides written authorization prior to development plan approval. The applicant is responsible for filing all necessary applications with the Idaho Department of Water Resources regazding Shallow Injection Wells. 5. Please submit a copy of the Ada County Street Name Committee's approval letter for the subdivision name, and the lot and block numbering. Make any corrections necessary to conform. 6. Coordinate fire hydrant placement with the City of Meridian Public Works Department and the City of Meridian Fire Department. Prior to signature of the final plat(s) by the City Engineer, a letter of credit or cash surety in the amount of 110% will be required for all fencing, landscaping, pressurized irrigation, sanitary sewer, water, etc. that has not been completed. 4 7. A detailed landscape plan, in compliance with the Landscape Ordinance, shall be submitted for the subdivision with the final plat(s) application. 8. All sidewalks shall be constructed in accordance with MCC 12-5-2.K. Prior to signature of the final plat(s), all sidewalks shall be constructed or a financial guarantee that said improvements will be completed shall be provided (MCC 12-5-3). 9. Streetlights will be required at locations designated by the Public Works Department. All streetlights shall be installed at subdivider's expense. Typical locations are at street intersections and/or fire hydrants. Final design locations and quanfity are determined after power designs are completed by Idaho Power Company. The street light contractor shall obtain design and permit from the Public Works Department prior commencing installations. 10. Developer shall coordinate mailbox locations with the Meridian Post Office. 11. Any existing domestic wells and/or septic systems within this project will have to be removed from their domestic service per City Ordinance Section 9-1-4 and 9-4-8. Wells may be used for non-domestic purposes such as landscape irrigation. 12. Compaction test results must be submitted to the Meridian Building Department for all building pads receiving engineered backfill, where footing would sit atop fill material. 13. Staffs failure to cite specific ordinance provisions or terms of the approved annexation/conditional use does not relieve the Applicant of responsibility for compliance. 14. Preliminary plat approval shall be subject to the expiration provisions set forth in MCC 12-2-4. 15. Ten days prior to City Council, submit a revised plat depicting a minimum 25' cross access easement and a vehicle turnaround. 16. Western side of proposed subdivision lots must be fenced to prevent access to the private road located directly west of the subject property. AGENCY COMMENTS Meridian Fire Department 1. Proposed cabinet shop and welding shop must meet all International Fire Code regulations. 2. Preliminary building lay-out and turnaround must be approved by Meridian's Fire Department. Meridian Police Department 5 1. To increase emergency access to the site, the applicant shall provide a stub street to the property. Prior to the next public hearing, the applicant shall submit a revised plat /site plan to reflect this requirement. No changes to the shared access are being proposed. The exterior boundary lines of the original plat are not being adjusted only the re-platting of one commercial lot into fwo. The development consists of a cabinet shop and a welding shop. The site is located on the north side of Franklin Road, approximately 1,100 feet west of Linder Road. Findings of Fact 1. Trip Generation: This development is estimated to generate 33 additional vehicle trips per day (0 existing) based on the Institute of Transportation Engineers Trip Generation Manual. 2. Impact Fees: There will be an impact fee that is assessed and due prior to issuance of a building permit. The assessed impact fee will be based on the impact fee ordinance that is in effect at that time. 3. Traffic Impact Study: This proposed development is estimated to generate less than 1,000-trips per day therefore a traffic impact study was not required with this application. 4. Roadway Improvements Adjacent To and Near the Site Franklin Road is a two lane minor arterial roadway with detached sidewalk abutting the site. 8. Existing Right-of-Way Cafarelli Subdivision # 1 dedicated 48-feet of right-of-way from the centerline of Franklin Road. 9. Existing Access to the Site Cafarelli Subdivision # 1 constructed a 24 to 30-foot wide driveway, approximately 210-feet east of the west property line as a shared driveway between Lots 1 and 2 as proposed. The applicant was required to pave the driveway its full required width and at feast 30-feet beyond the edge of pavement of Franklin Road and install pavement tapers with 75-foot radii abutting the existing roadway edge. 10. Site History District staff has not reviewed this site as an application or prepared a report in the past year. 11. Capital Improvements Plan/Five Year Work Program This location is not programmed into the District's current Capital Improvements Plan and/or Five Year Work Program for reconstruction or any roadway improvements. 12. Other Development in Area The Meridian School District proposed to construct a bus facility with an accessory 94,850 square foot service building and an 8,250 square foot administration building just west of this development site. The Meridian School District was approved to construct adriveway/future street on fhe east property line. The School District was to pave the driveway/street a minimum of 30-feet into the site beyond the edge of pavement of Franklin Road and install pavement tapers with 15-foot radii abutting the existing roadway edge. If the roadway is to be dedicated to the public it should be constructed as a 40-foot street section with curb, gutter and 5-foot wide sidewalks. In addition, the following requirements must be met if the applicant wishes to dedicate the driveway/street to ACRD: • Dedicate a minimum of 54-feet ofright-of--way for the road. • Construct the roadway to the minimum ACND requirements. B. Findings for Consideration Right-of-Way District policy requires 96-feet of right-of-way on arterial roadways (Figure 72-F1 B). This right-of-way allows for the construction of a 5-lane roadway with curb, gutter, 5-foot concrete detached sidewalks and bike lanes. Cafarelli Subdivision # 9 dedicated 48-feet of right-of--way from the centerline of Franklin Road. Therefore the applicant should not be required to dedicate any additional right-of--way with this application. 2. Sidewalk District policy requires 5-foot wide (minimum) concrete sidewalk on all collector roadways and arterial roadways (7204.7.2). Cafare!!i Subdivision # 1 constructed the required roadway improvements abutting Franklin Road. Therefore the applicant should not be required to construct any additional roadway improvements wrth this application. 3. Minor Improvements District policy 7203.6 requires the applicant of a proposed development to make improvements to existing damaged sidewalk; curb and gutter construction or replacement; replacement of unused driveways with standard curb, gutter and sidewalk; installation of pedestrian ramps; pavement repairs; signs; traffic control devises; and other similar items in order to correct deficiencies or replace deteriorated facilities. 4. .Driveways Graveled driveways abutting public streets create maintenance problems due to gravel being tracked onto the roadway. In accordance with District policy, 7207.9.1, the applicant should be required to pave the driveway its full width and at least 30-feet into the site beyond the edge of pavement of the roadway and install pavement tapers with 15-foot radii abutting the existing roadway edge. District policy 7207.9.3 restricts commercial driveways with daily traffic volumes over 1,000 vehicles to a maximum width of 35-feet. Most commercial driveways will be constructed as curb-cut type facilities if located on local streets. Curb return type driveways with 15-foot radii will be required for driveways accessing collector and arterial roadways. Cafarelli Subdivision # 1 constructed a 24 to 30-foot wide driveway, approximately 210-feet east of the west property line as a shared driveway between Lots 1 and 2. The applicant should be required to pave the driveway its full width and at least 30-feet beyond the edge of pavement of Franklin Road and install pavement tapers with 15-foot radii abutting the existing roadway edge if not already completed. The applicant is proposing to apply for a second access when the Meridian Joint School District dedicates the street to ACND that is currently under construction to the west of the site abutting this parcel. C. Site Specific Conditions of Approval Utilize the existing 24 to 30-foot wide driveway, approximately 210-feet east of the west property line as a shared driveway between Lots 1 and 2 as proposed. Pave the driveway its full width and of least 30-feet into the site beyond the edge of pavement of the roadway and install pavement tapers with 15-foot radii abutting the existing roadway edge if not already completed. 2. .Other than the access point(s) specifically approved with this application, direct lot or parcel access to Franklin Road is prohibited. Lot access restrictions, as required with this application, shall be stated on the final plat. 3. Comply with all Standard Conditions of Approval. D. Standard Conditions of Approval Any existing irrigation facilities shall be relocated outside of the right-of-way. 2. All utility relocation costs associated with improving street frontages abutting the site shall be borne by the developer. 3. Replace any existing damaged curb, gutter and sidewalk and any that may be damaged during the construction of the proposed development. Contact the District's Utility Coordinator at 387-6258 (with file numbers) for details. 5. All design and construction shall be in accordance with the Ada County Highway District Policy Manual, ISPWC Standards and approved supplements, Construction Services procedures and all applicable ACHD Ordinances unless specifically waived herein. An engineer registered in the State of Idaho shall prepare and certify all improvement plans. 6. The applicant shall submit revised plans for staff approval, prior to issuance of building permit (or other required permits), which incorporates any required design changes. 4 7. Construction, use and property development shall be in conformance with all applicable requirements of the Ada County Highway District prior to District approval for occupancy. 8. Payment of applicable road impact fees are required prior to building construction in accordance with Ordinance #198, also known as Ada County Highway District Road Impact Fee Ordinance. 9. It is the responsibility of the applicant to verify all existing utilities within the right-of-way. The applicant at no cost to ACHD shall repair existing utilities damaged by the applicant. The applicant shall be required to call DIGLINE (1-800-342-1585) at least two full business days prior to breaking ground within ACHD right-of-way. The applicant shall contact ACHD Traffic Operations 387-6190 in the event any ACHD conduits (spare or filled) are compromised during any phase of construction. 10. No change in the terms and conditions of this approval shall be valid unless they are in writing and signed by the applicant or the applicant's authorized representative and an authorized representative of the Ada County Highway District. The burden shall be upon the applicant to obtain written confirmation of any change from the Ada County Highway District. 11. Any change by the applicant in the planned use of the property which is the subject of this application, shall require the applicant to comply with all rules; regulations, ordinances, plans, or other regulatory and legal restrictions in force at the time the applicant or its successors in interest advises the Highway District of its intent to change the planned use of the subject property unless a waiver/variance of said requirements or other legal relief is granted pursuant to the law in effect at the time the change in use is sought. E. Conclusions of Law The proposed site plan is approved, if all of the Site Specific and Standard Conditions of Approval are satisfied. 2. ACHD requirements are intended to assure that the proposed use/development will not place an undue burden on the existing vehicular and pedestrian transportation system within the vicinity impacted by the proposed development. Appeal Guidelines 5 Request for Appeal of Staff Decision Appeal of Staff Decision: The Commission shall hear and decide appeals by an applicant of the final decision made by the ROWDS Manager when it is alleged that the ROWDS Manager did not properly apply this section 7101.6, did not consider all of the relevant facts presented, made an error of fact or law, abused discretion or acted arbitrarily and capriciously in the interpretation or enforcement of the ACHD Policy Manual. a. Filing Fee: The Commission may, from time to time, set reasonable fees to be charged the applicant for the processing of appeals, to cover administrative costs. b. Initiation: An appeal is initiated by the filing of a written notice of appeal with the Secretary of Highway Systems, which must be filed within ten (10) working days from the date of the decision that is the subject of the appeal. The notice of appeal shall refer to the decision being appealed, identify the appellant by name, address and telephone number and state the grounds for the appeal. The grounds shall include a written summary of the provisions of the policy relevant to the appeal and/or the facts and law relied upon and shall include a written argument in support of the appeal. The Commission shall not consider a notice of appeal that does not comply with the provisions of this subsection. c. Time to Reply: The ROWDS Manager shall have ten (10) working days from the date of the filing of the notice of appeal to reply to the notice of the appeal, and may during such time meet with the appellant to discuss the matter, and may also consider and/or modify the decision that is being appealed. A copy of the reply, and any modifications to the decision being appealed will be provided to the appellant prior to .the Commission hearing on the appeal. d. Notice of Hearing: Unless otherwise agreed to by the appellant, the hearing of the appeal will be noticed and scheduled on the Commission agenda at a regular meeting to be held within thirty (30) days following the delivery to the appellant of the ROWDS Manager's reply to the notice of appeal. A copy of the decision being appealed, the notice of appeal and the reply shall be delivered to the Commission at least one (1) week prior to the hearing. e.
