Watters: This letter is in response to the Village Apartments Staff Report. Under the Landscaping requirement on page 10, recommends a 35 -foot wide street landscaped buffer along N. Eagle Road with the first phase of development and prior to issuance of the first Certificate of Occupancy for the site. The applicant respectfully requests modification of the condition for installation of the landscaped buffer along N. Eagle Road to occur during the commercial phase of the development. The site is designated C -G zoning and an existing Development Agreement requires mixed use,. To comply with the zoning and Development Agreement requirements, planned use for the 16.62 acres site is multifamily residential rental housing and commercial„ The residential will be located on the Eastern portion of the property away from Eagle Road with the Commercial on the Western portion adjacent to Eagle Road. This layout buffers the residential housing from the noise and traffic on Eagle Road with the Commercial use. Due to the complexity and nature of commercial development, completion of the residential phase will occur first. Requiring development of the buffer along Eagle Road would be an undue significant financial burden to the residential phase. In order to construct the Eagle Road buffer, piping of a portion of the Finch Lateral would have to occur increasing the cost of the buffer. Furthermore, most of the Finch Lateral is already piped along the southern border of the. Approximately 260 feet remains open.. As it would be a major effort to pipe the remaining portion of the lateral, it would also be impractical to pipe only a small segment of the lateral to create buffer along Eagle Road.. The most practical and cost saving way to pipe the lateral is to do it all at once during the commercial phase. Ms. Sonya Waters November 13, 2015 Page 2 of 2 Commercial uses require specific designs dependent on the type of service or product provided„ Therefore, the commercial development cannot occur until identification of a user for the space,. Not to mention developing the buffer along Eagle Road at this time would be inefficient, as much if not all of the improvements would have to be removed or suffer damage at the time the commercial improvements are undertaken. To minimize expense and wasted work for the development of the commercial lot, we request postponing development for landscaping along Eagle Road until the time that the commercial is undertaken..
