He is also concerned about maintenance vehicles working on the common area lot blocking Wingate Lane as well as drainage potentially impacting his 5 acres. • Helen Sharp presented photos of the area and proposed constructing gates across E. Meadowgrass. • Justin Hall testified on behalf of the Packard Acres HOA with concerns about the 13- foot front setback for the existing house. He is opposed to a variance being granted for this and believes it should be 20 feet. • Craig Groves, developer, responded to concerns and summarized the open space lot features. • Key issues of discussion and questioning by the Commission included: 1. Wingate Lane width and access issues to the subdivision. 2. Open space lot design and access/location. Key Commission Changes to Staff Recommendation: Allow a split rail fence adjacent to Wingate Lane Outstanding Issues for City Council: • Note that a separate Variance application accompanies the AZ and PP applications and a decision should be made on that application before closing the PP hearing. • Reference the revised Preliminary Plat by Tealey's Land Surveying, dated 4/13/04, and received by the City Clerk on 4/19/04 BEFORE THE PLANNING AND ZONING COMMISSION IN THE MATTER OF THE ) REQUEST FOR ANNEXATION & ) ZONING OF 5.27 ACRES TO R-4 ) ZONE FOR PACKARD ACRES NO. ) 3 SUBDIVISION ) Packard Estates Development, LLC, ) Applicant ) Case No. AZ-04-005 RECOMMENDATION TO CITY COUNCIL The property is approximately 5.27 acres in size and is generally located on the west side of Wingate Lane (private), approximately '/ mile south of Ustick Road, Meridian. 2. Packard Estates Development, LLC is the current property owner and they have submitted notarized consent for the subject application. 3. Applicant is Packard Estates Development, LLC. 4. The subject property is currently zoned RUT (Ada County) and consists of agricultural land and a rural residence. 5. The Applicant requests the property be zoned as R-4. 6. The property which is the subject of this applicafion is within the Area of Impact of the City of Meridian. The entire parcel of the property is included within the Meridian Urban Service Planning Area as defined in the Meridian Comprehensive Plan. 8. The Applicant proposes to develop the subject property in the following manner: A 22-lot residential subdivision. 9. The Meridian Comprehensive Plan Generalized Land Use Map designates the subject property as Medium Density Residential. 10. There are no significant natural features that affect the consideration of this application. RECOMMENDATION TO CITY COUNCIL FOR APPROVAL OF ANNEXATION AND ZONING OF 5.27 ACRES TO Rte, BY PACKARD ESTATES, LLC - AZ-04-005 -Page 1 RECOMMENDATION The Meridian Planning and Zoning Commission hereby recommends to the City Council of the City of Meridian that they approve the requested Annexation And Zoning as requested by the applicant for the property described in the application, subject to the following: A. Adopt the Comments and Recommendations of the Meridian Planning & Zoning Department, as modified by the Commission as follows: The legal description submitted with the application (dated 2-13-04, stamped by David N. Marks) shows the property as contiguous to the existing corporate boundary of the City of Meridian and is approved. 2. Any existing domestic wells and/or septic systems within this project will have to be removed from their domestic service, per City Ordinance Section 5-7-517, when services are available from the City of Meridian. Wells may be used for non-domestic purposes such as landscape irrigation. All irrigation ditches, laterals or canals, exclusive of natural waterways, intersecting, crossing or lying adjacent and contiguous to the parcel shall be tiled per City Ordinance 12-4-13. Plans will need to be approved by the appropriate irrigation drainage district, or lateral users association (ditch owners), with written approval or non-approval submitted to the Public Works Department. If lateral users association approval can't be obtained, plans will be reviewed and approved by the Meridian City Engineer prior to final plat signature. 4. Any future subdivision, uses and construction on this property shall comply with the City of Meridian ordinances in effect at the time.
