We are please to submit this application for Conditional Use for our proposed development for
the NW cornu �o�fFairview and Locust Grove This application incorporates two parcels of
approximately�&acres, and is currently being used for both commercial and residential
purposes. These properties have been submitted for request of Annexation into the City of
Meridian, and to be Zoned/Rezoned to C -G commercial.
The north parcel contains a single family dwellings accessed off of Carol St. and is currently
zoned R-8. The south parcel fronts Fairview and Locust Grove, is currently zoned C-2, and
contains a multi -tenant building. If the proper approvals are obtained, the multi -tenant building
would be removed and a new single tenant building would be constructed.
The proposed development is to develop a quality commercial retail use on these parcels that
would enhance the use of this corner to be more compatible with the surrounding properties. Our
development would be compatible with the Fred Meyer and the D&B Supply developments
adjacent to this corner. This development would be designed in a professional manner as to
appropriately integrate with the adjacent commercial uses, and adequately buffer from any
adjacent residential uses.
The proposed development would include an approximately 15,120 sq. ft. Walgreen's pharmacy
with a drive thru window. The drive thru window would be for pharmacy perscription pickup.
The drive thru window is comparable to the drive thru window located right across the street at
the Washington Mutual Bank in the Fred Meyer development.
The frontage on Fairview, a main commercial roadway, and on Locust Grove, adjacent to the
Fred Meyer development, are characteristics that would make this conditional use desirable. The
site improvements and building materials make the proposed development more desirable and
harmonious with the surrounding uses.
We would request that you approve our Conditional Use application allowing the commercial
retail and drive thru window use of this property. If the Conditional Use is granted, Hawkins -
Smith agrees to pay any additional sewer, water or trash fees associated with this development. I
have also read the contents of this application and verify that the information contained herein is

Plats, at Page 1080, as Instrument Number 463011, records of Ada County, State of ISM ,T'
Subdivision, granted to IDAHO POWER COMPANY an easement (the "Easement") for the
construction, operation and maintenance of certain power line facilities upon the following
premises located in Ada County, State of Idaho, to -wit:
Doris Subdivision in SE % SE % Sec_tion 6, Township 3 North, Range I East, B.M., Ada
County, Idaho.
AND, WHEREAS, it is no longer necessary or desirable that a certain portion of the
Easement be retained.
NOW, THEREFORE, in consideration of the premises, IDAHO POWER COMPANY
does hereby release and abandon that certain portion of the Easement over the following
described lands:
The interior lot lines between Lots 2 and 7; Lots I and 8; Lots 7 and 8; Lots I and 2, all
within Block 1, Doris Subdivision, in the SE % SE % Section 6, Township 3 North, Range
I East, BM, Ada County, Idaho.
ALL RIGHTS and privileges under the above-described document in and to the remaining
lands covered by the Easement and any and all prescriptive or other rights the Grantee has
acquired through occupancy and use over time of said remaining lands shall remain and continue
in the Grantee and shall not be affected in any way hereby.

This RELEASE, made the .2/ s day of /%J�i2cff , 2000 by the Ada
County Highway District, a Body Politic and Corporate of the State of Idaho, acting by
and through its Board of Commissioners, hereinafter referred to as "RELEASOR".
WHEREAS, the Final Plat of DORIS SUBDIVISION platted an easement for
public utilities, drainage and irrigation along all sides and back lines of all lots except
Lots 2 and 7, Block 4 and Lots 2 and 5, Block 3 (granted in footnote of Certificate of
Ownership and Dedication), according to the official plat thereof, filed in Book 16 of
Plats at Page 1080, records of Ada County, Idaho, and
WHEREAS, the fee title owner of Lots 1, 2, 7 and 8, Block 1 of said Doris
Subdivision has requested release of such easement in order to obtain a lot line
adjustment from the City of Meridian, Meridian, Idaho, and
WHEREAS, the Easement, insofar as it relates to storm water drainage and any
other rights granted to Releasor thereby, more particularly described as follows:
A parcel of land being a 6.00 feet wide (3.0 feet each side of interior lot line)
drainage easement running over and across portions of Lots 1, 2, 7 and 8, Block
1 of Doris Subdivision, according to the official plat thereof, filed in Book 16 of
Plats at Page 1020, records of Ada County, Idaho, and located in Section 6,
T.3N., R.1 E., Boise Meridian, Meridian City, Ada County, Idaho, said drainage
easement being more particularly described as follows:
A 6.00 foot wide drainage easement, 3.00 feet on each side of the platted
interior lot lines running East-West between Lots 1 and 8, Block 1; Lots 2 and 7,
Block 1; and running North-South between Lots 1 and 2 and 7 and 8, Block 1 of
said Doris Subdivision,
is no longer necessary to the needs of RELEASOR, and RELEASOR desires to release
its interest in such Easement to the Servient Estate.

NOTICE OF HEARING
NOTICE IS HEREBY GIVEN pursuant to the Ordinances of the City of Meridian
and the Laws of the State of Idaho, that the City Council of the City of Meridian will hold
a public hearing at the Meridian City Hall, 33 East Idaho Street, Meridian, Idaho, at the
hour of 7:30 p.m. on January 18, 1999, for the purpose of reviewing and considering the
application of Hawkins Smith for annexation and zoning of 4.34 acres from C-2 and R-8
to C -g for proposed Walgreen's located on the northwest corner of Fairview and Locust

Furthermore, the applicant requests a conditional use permit to construct a
