He said he agrees with us not recording a separate grant of easement (specifically to Meridian) for the pathway portions outside the ROW in Phase 1 given that we have already recorded those at ACHD's request giving public access to the pathway. He agreed recording over those areas would add confusion and the City is already covered. I asked that he email Sonya and let her know we have talked and that this condition is addressed. Below was a follow up email. I was thinking Jon was going to check to see if we still needed to grant an easement to the City (basically over top of the ACHD pathway easement for the pathway outside of the ROW). Doesn't seem necessary, since the ACHD easement is specifically for a grant to the public to access the path. Do you want us to follow up on this with Sonya? We've had similar circumstances before where the city accepted the ACHD easement and did not require a separate, specific grant to the City. Tim Mokwa, R.L.A. Also see attached email from Paul. Once the Eagle culvert is installed, Paul will submit a LOMR to FEMA removing the lots in the Floodway. We will have to survey the post -constructed culvert for this application. The dilemma is will the City sign the plat w/out the floodway line shown given that the construction, in -progress will be modifying that line. We discussed earlier that we don't want to show that line on the plat, since if recorded, we'd have to file an "amended plat" to remove. Maybe we add the line, just to get City signature, and just so we can go to the County with the plat. The County could take 4-6 weeks, in which time the Eagle Road culvert would be installed and Paul could get the FP Development Permit, and submit to FEMA. Then, we remove the FW line prior to recording, all done with the City's knowledge of course. (Just brainstorming) Kevin is going to talk to Dave Miles today. Miles is aware of the entire scenario with the culvert and the impact on the FW. We'll update you after talking to Dave Miles. On another issue, in regards to the regional pathway public access easement, on the North side of Taconic, if you'll recall the pathway is 10' asphalt meandering in and out of the ROW. Where it is outside the ROW an easement (in favor of ACHD) has already been recorded, giving public access. The dedication to the City will be most applicable with Phase 3 and 5 along the Ten -Mile Creek. Will the City accept this as the regional pathway easement or will they require that we also dedicate the portions outside of the ROW to the City (in other words the same easement would be in favor of ACHD and the City)? Lastly, the one easement instrument left blank on the Plat was because ACHD dropped the ball on that one. Amanda is aware of this, by and email from Jeanne last week.
