RE: Property Boundary Adjustment for 3268 E. Pine Street (Reagan Sub.)
Dear Mr. Tealey:
I, along with the City Engineer, find that your request for a property boundary
adjustment on the property referenced above complies with Unified Development
Code (UDC) 11-613-8. I am granting approval of the property boundary adjustment
as requested by the applicant subject to completion of the following conditions per
UDC 11 -6B -8C2:
a. Cause the property to be surveyed and a record of survey recorded;
b. Execute and record the necessary deeds to accomplish the property
boundary adjustments as approved;
c. Obtain new tax parcel numbers from the Ada County Assessor, and;
d. Provide copies of the recorded record of survey, recorded deeds, and the
new tax parcel numbers to the Director.
The applicant or owner has one year to complete the above conditions of approval.
Upon completion of these items the application shall be deemed approved.

°I day of May, 2006, by and between
ABC2, LLC, an Idaho limited liability company ("GRANTOR") whose address is 2700 W.
Airport Way, Boise, Idaho, 83705 and Vintage Properties L.P., an Idaho limited partnership,
whose address is P.O. Box 1486, Boise, Idaho 83701 ("GRANTEE").
WITNESSETH:
GRANTOR, for and in consideration of the sum of TEN DOLLARS ($10.00) and other
good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged,
does by these presents, convey unto GRANTEE and its successors and assigns forever, all of the
following described real property ("Subject Property") situated in the County of Ada, State of
Idaho;
That Certain real property described on Schedule I attached hereto and by this reference
incorporated herein.
Subject Property is conveyed subject to the following perpetual covenant and restriction
which shall run with the land for the benefit of the real property described on Schedule II
attached hereto, and by this reference incorporated herein:
a.) No building including any retail or restaurant use may exceed Five Thousand
Three Hundred (5,300) square feet of floor area.
b.) If no building on the foregoing Subject Property is used for any restaurant or
retail purpose, then the building or buildings constructed on said Subject Property
shall not necessarily be limited to Five Thousand Three Hundred (5,300) square
feet of floor area, but Subject Property shall provide and allow for four and one-
half (41/2) parking spaces for each One Thousand (1,000) square feet of floor area
in all buildings constructed on the Subject Property.

c.) If any building on Subject Property is used in whole or in part for restaurant or
retail use, then such Subject Property shall provide not less than Ninety (90)
parking spaces for the restaurant and retail use, and four and one-half (4 ''/2)
parking spaces for each One Thousand (1,000) square feet of use not constituting
restaurant or retail use.
d.) As used in this provision, retail includes restaurant use and same definition as the
use of the term "Retail" in those certain restrictions in a deed dated May 15`h
2003, and recorded as Instrument No. 103081840 records of Ada County, Idaho.
Subject to easements, encumbrances and restrictions of record or appearing on the land.
Together with all and singular the tenements, hereditaments, and appurtenances
thereunto belonging or in anywise appertaining, the rents, issues and profits
thereof, and all estate, right, title and interest in and to the foregoing described
Subject Property in law as well as in equity, except as expressly provided
otherwise in this deed.
TO HAVE AND TO HOLD, all of the above described premises together with the
appurtenances unto GRANTEE and GRANTEE'S heirs and assigns forever.
GRANTOR makes no covenants or warranties with respect to title, express or implied,
other than that previous to the date of this instrument, GRANTOR has not conveyed the same
estate to any person other than GRANTEE, and that such estate is at the time of the execution of
this instrument, free from encumbrances done, made or suffered by the GRANTOR, or any
person claiming under the GRANTOR, except those easements, encumbrances, and restrictions
of record or appearing on the land.
