I find that your request for a property boundary adjustment on the property referenced above
complies with Unified Development Code (UDC) 11-613-8 Therefore, I am granting tentative
approval of the requested property boundary adjustment subject to completion of the following
tasks within 1 year of the date of this letter, in accord with UDC 11 -6B -8C2:
Xa Cause the property to be surveyed and a record of survey recorded;
fb. Execute and record the necessary deeds to accomplish the property boundary
adjustments as approved;
✓c.. Obtain new tax parcel numbers fiom the Ada County Assessor; and,
V -*'d„ Provide copies of the recorded record of survey, recorded deeds, and the new tax
parcel numbers to the Director.
Upon determination by the Director that the final property boundary adjustment is in
conformance with UDC 11-613-8, a letter of approval will be issued.

Mussell Corner Property Boundary Adjustment Narrative
November 9, 2009
In December of 2006, Kuna Victory, LLC entered into an agreement with Tim and Carol
Mussell (Mussell) to purchase the Lot 2, Block 1 of Mussell Corner Subdivision. The
Warranty Deed recorded for this transaction incorrectly transferred any and all interest in
Lot 4, Block 1 of Mussell Corner Subdivision from Mussell to Kuna Victory, LLC. This
error passed legal title of Mussell's approximate 1 -acre un -platted lot to Kuna Victory,
LLC rather than the Lot 2, Block 1 lot as intended by the parties.
To correct this error; Kuna Victory, LLC wishes to adjust the lot lines of the two current
parcels (Lot 1, Block 1 and Lot 4, Block 1) to create a new parcel (Parcel B) that is
approximately equal to Mussell's original un -platted lot. Then, following the recording
of Parcel B, Kuna Victory, LLC will deed this lot to Mussell and Mussell will deed Lot 2,
Block 1 to Kuna Victory, LLC.
The dimension of Parcel B which results from this adjustment exactly equals the same
intended lot within the approved, but un -platted Emerson Park Subdivision. No new
parcels will be created as a result of this boundary adjustment.
