This letter is to confirm the Director approved your request for alternative compliance to Unified
Development Code (UDC) 11-3B-12C for the subject property based on the required findings
listed in UDC 11-5B-5E as follows:
1. Strict adherence or application of the requirements are not feasible; or
The UDC (11-3B-12C) requires a 5-foot wide landscape strip along each side of
pathways landscaped with a minimum of one tree per 100 lineal feet ofpathway
along with vegetative groundcover.
Because a stormwater drainage facility was constructed on the site adjacent to the
pathway on Lot 6, Block 3 that was not shown on the landscape plan approved with
the final plat, there is not adequate area to construct the required landscape strip
making strict adherence to UDC 11-3B-12C infeasible.
2. The alternative compliance provides an equal or superior means for meeting the
requirements; and
As an alternative, the applicant proposes to plant two (2) trees instead of just the one
required, within the side yard of Lot 7, Block 3 adjacent to the common property line
where the pathway is located (see attached drawing). The Director finds increasing
the tree plantings will improve the aesthetics of this area and will provide additional
shade for the pathway providing an equal means for meeting the requirements of the
ordnance.
3. The alternative means will not be materially detrimental to the public welfare or
impair the intended uses and character of surrounding properties.

The Director finds the alternative means of meeting the requirement will not be
materially detrimental to the public welfare or impair the intended use or character
of the area.
Note: The trees proposed to be planted within Lot 7, Block 3 shall be installed with the
subdivision improvements for Phase I of Woodburn West Subdivision; or surety may be
submitted if installation will take place after the home is constructed.
The applicant, Director, or a party of record may request City Council review of a decision of the
Director. All requests for review shall be filed in writing with the Planning Division of the
Community Development Department on or before March 18, 2015, within fifteen (15) days
after the written decision is issued, and contain the information listed in UDC 11-5A-6B.
If City Council review of the decision is not requested, the action of the Director represents a
final decision on a land use application. You have the right to request a regulatory taking
analysis under Idaho Code 67-8003.

Please accept the attached Development Review Application, Alterative Compliance
Application and associated submittal items.
As you are aware we have completed the development and recorded the Final Plat for
the Approved Woodburn West Subdivision Number 1. but error'ed to make required
adjustments between our Civil/Landscape Plans and Conditions of Approval. This has
created a situation that two pathways as conditioned cannot be constructed as
generally required by the UDC. That said, we believe through Alternative Compliance
we can meet the intent as well as heighten the overall quality and experience within
these two common lots. Please see the attached sketch showing location of
path/openspace/fences/trees for clarity.
We feel Findings can be made through UDC11-313-12C. Specifically the following;
e. - Innovation is being achieved through increased tree plantings above
the minimum requirements and will improve not only the pedestrian
experience but also the overall subdivision. This will add to the
walkability and ascetics of the overall area. We are proposing to
double the required trees in these specific area.
g. - Additional environmental quality improvements are being achieved
via these added trees. This will provide added shade with reduces
•
irrigation demands. This slight reduction in sod/lawn buffer (only one
side) is environmentally considerate while retaining a high level of use
and interest.
In closing, we are confident that this request will both ensure compliance as well as
increase the overall quality of the project. Following approval we will update and
submit formal landscape plans reflecting these changes in conjunction with the
requested lot line adjustment application before you now.
