FP-04-015 ORDER OF CONDITIONAL APPROVAL OF FINAL PLAT This matter coming before the City Council for Final Plat approval pursuant to Meridian City Code § 12-3-7 on March 23, 2004, and the Council fmding that the Administrative Review is complete from Sonya Allen for the Planning and Zoning Department, and Bruce Freckleton, Engineering Technician III, dated: Hearing Date: Apri16, 2004, to the Mayor and Council, and that Anna Powell Planning Director for the Planning and Zoning Department, ORDER OF CONDITIONAL APPROVAL OF FINAL PLAT / (FP-04-015) Page 1 of 4 commented at the hearing, and the Council having considered the requirements of the preliminary plat the Council takes the following action: IT I5 HEREBY ORDERED THAT: 1. The final plat upon which there is contained the Certification and signature of the City Clerk and the City Engineer verifying that the plat meets the City's requirements shall be signed only at such time as: 1. The Plat dimensions are approved by the City Engineer; and The City Engineer has verified that all off-site improvements are completed and/or the appropriate letter of credit or cash has been issued ORDER OF CONDITIONAL APPROVAL OF FINAL PLAT / (FP-04-015) Page 2 of 4 guaranteeing the completion of off-site and required on-site improvements. NOTICE OF FINAL ACTION AND RIGHT TO REGULATORY TAHINGS ANALYSIS The Applicant is hereby notified that pursuant to Idaho Code 67-8003, the Owner may request a regulatory taking analysis. Such request must be in writing, and must be filed with the City Clerk not more than twenty-eight (28) days after the fmal decision concerning the matter at issue. A request for a regulatory takings analysis will toll the time period within which a Petition for Judicial Review maybe filed. Please take notice that this is a final action of the governing body of the City of Meridian, pursuant to Idaho Code § 67-6521. An affected person being a person who has an interest in real property which may be adversely affected by this decision may, within twenty- eight (28) days after the date of this decision and order, seek a judicial review as provided by Chapter 52, Title 67, Idaho Code. We have reviewed the above-referenced submittal and offer the following comments, as conditions of approval. These wnditions shall be considered in full, unless expressly modified or deleted by motion of the Meridian City Conncil: APPLICATION SUMMARY & LOCATION The applicant, Iiiltview Development Corporation, has requested final plat approval of the second phase of Champion Park Subdivision (preliminary platted under the name Parkstone Subdivision). This phase of the subdivision consists of 75 single-Family residential lots and 1 I common lots on 22.16 acres and is located approximately '/z mile west of N. Eagle Road and approximately t/a mile north of E. Ustick Road, in the south'/z of Section 32, T.4N., R.1E. The gross density of the subdivision is 3.38 d./u, per acre. The net density is 4.53 d./u. per acre. Although the proposed subdivision is located in an R-8 zone, a Conditional Use Permit for a Planned Development (File No. CUP-02-049) has been approved for the subdivision that allows a portion of the subdivision to be developed in a commercial manner. The CUP also allowed for reductions to the front & side setbacks, min. lot size, min. street frontage, min. house size; and allowance for block lengths to exceed 1,000-feet. Staff recommends that the Council not require the applicant to complete condition No. 2.A.7. from the Preliminary Plat Findings. The wndition requires that the applicant construct a micropath between Lots 48 and 49, Block 12 as shown on the preliminary plat. As a result of ~: b~t "~-" 10~~ Mayor & City Councll Hearing Date: Apri16, 2004 Page 2 of 4 discussion at the City Council public hearing, this requirement should have been removed as there is not a connectian to Setter Cave Subdivision to the west. Staff has removed this requirement as a condition of approval. Staff finds that the proposed final plat substa~rtially complies with the approved Preliminary Plat. An additional common area lot (Lot 14) to be used for drainage was added to Block 17. No building lots were lost due to this change. Staff recommends approval of the second phase of Champion Park Subdivision with the wmments and conditions stated in this report. CONDTITONS OF APPROVAL 1. Applicant shall meet all terms of the approved Preliminary Plat (PP-02-033), Planned Development (CUP-02-049), and Development Agreement (Inst. No.103085229). _ 2. The pressurized irrigation system within this development is to be owned and maintained by the Home Owner's Association. The City of Meridian requires that pressurized imgation systems be supplied by a year-round source of water. If a creek or well source is not available, asingle-poim connection to tbe municipal water system shall be required. Plans and specifications for the irrigation system shall be reviewed by the Public Works Department as part of the developmem plan review process, and a draft copy of the pressurized irrigation system O&M manual must be submitted prior to plan approval. if a single-point connectioa is utilized, the developer shall be responsible for the paymem of assessmems for the common areas prior to signature on the final plat by the Meridian City Engineer. 3. Sanitary sewer and water service to these lots shall be via main line extensions from existing mains adjacent to the subdivision. Applicant will be responsible to construct the sewer aad watef mains to and through this proposed development, thereby making them available to adjacent properties. Subdivision designer to coordinate main sizing and routing with the Public Works Department 4. Applicant shall be required to pay Public Works development plan review, and construction inspection few, as determined dut>ittg the plan revievr process, prior to signature on the final plat per Resolution 02-374. Any drainage areas (detention/retention basins} must be designed. to ensure that water will percolate or discharge within a period of time not tm exceed 24 hours for all storms up to and including a 140-year storm event. (All areas being counted toward the 10% open space amenity shall be free of "wet ponds" or other such nuisances.). 6. Revise note No. 8 to read: "Buildin¢ setbacks and dimensional standards in tlris subdivision shall be in compliance with Title 11 and Title 12 of the Meridian City Code unless otherwise modified by Conditional Use Permit (CUP-02-0491 b. Revise note No. 13 to include Instrument No.103085229. c. Revise note No. 11 to read: "All single family detached units within this subdivision shall have a minimum square footage of 1,200 square feet, exclusive of garages. This shall exclude lots adjacent to the western and northern oro~y lines which shall be a minimum of 1,500 s f for a single story and 1 800 s f for a two story buildine." (Per Preliminary Plat Finding No. 13.A.2.) 7. The Landscape Plan dated 3-1-04, prepared by Harvest Design, is approved as submitted. 8. Any existing domestic wells and/or septic systems within this pmject shall be removed from their domestic service per City Ordinance Section 9-1-4 and 9-4-8. Wells may be used for non-domestic purposes such as lamiscape irrigation. 9. Street lights shall be installed in compliance with the approved streetlight agreement. One-Hundred watt (100w), high-pressure sodium streetlights will be required at locations designated by the Public Works Department. Alt streetlights shall be installed at subdivider's expense. Typical locations are at street intersections and/or fire hydrants. Final design locations and quantity are determined after power designs are completed by Idaho Power Company. Street light contractor to obtain design and permit from the Public Works Departmem prior commencing installations. 10. Compaction test results must be submitted to the Meridian Building Department for all _ building pads receiving engineered backfill, where footing would sit atop fill material. 11. Applicaut's engineer will be required to submit a signed, stamped stateme~ certifying that all street finish centerline elevations are set a minimum of three feet above the highest established normal groundwater elevation. 12. Coordinate fire hydrant placement with the City of Meridian's Water Deputy Fire Chief and the Public Works Department. 13. Sidewalks within the proposed subdivision shall be built in accordance with MCC 12- 13-10-8. 14. Anew detailed Conditional Use Permit will be required prior to developmer o€ any of the commercial, office ormini-storage lots within the Champion Park Subdivision. 15. Fencing shall be installed as submitted on fencing plea in accordance with MCC 12-4- 10. 17. Graphically depict a 5-foot wide public utilities, drainage and irrigation easement along the east side of Lot 18, Block 17, Lot 18, Block 16, and Lot 32, Black 15 as these will be side lot line adjacem to a future phase. 18. Graphically depict a 13-foot wide public utilities, drainage and irrigation easement along the north side of Lot 25, Block 15. The extra width is required due to a pressure irrigation main. 19. Street signs are to be in place, water system shall be approved and activated, pressurized irrigation system approved and activated, drainage lots constructed, fencing installed, off-site pathway constructed, and mad base approved by the Ada County Highway 1sstrict prior to applying for building permits. All developmem impmvemems, including fencing, micro-paths, off-site pathway, irrigation, and landscaping shall be installed and approved prior to obtaining certificates of occupancy. A letter of credit or cash surety in the amount of 110% will be required for all fencing, landscaping, pressurised irrigation, sanitary sewer, water, etc., prior to signature on the final plat. 20. All irrigation ditches, laterals or canals, exclusive of natural waterways, imersecting, crossir~ or lying adjacent and contiguous to the area being subdivided shall be tiled per City Ordinance 1211-13. Plans will need to be approved by the appropriate irrigation/drainage district, or lateral users association, with written confirmation of said approval submitted to the Public Works Departmem. 21. Staff's failure to cite specific ordinance provisions or terms of the approved preliminary plat, conditional use permit or development agreement does not relieve Applicant of responsibility for compliance.
